FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 To abandon the existing outfall and to construct and maintain a 36-inch diameter outfall from the Schuylkill Haven Wastewater Treatment Facility to the Schuylkill River consisting of smooth-lined corrugated polyethylene pipe, concrete endwall and rock apron. The project is located approximately 0.3 miles southeast of the intersection of S.R. 0443 and Main Street (Friedensburg, PA Quadrangle Latitude 40°37`13"; Longitude: -76°10`22") in Schuylkill Haven Borough, Schuylkill County. E54-345. Schuylkill County Municipal Authority, 221 South Centre Street, Pottsville, PA, 17901 Deer Lake Borough and West Brunswick Township, Schuylkill County, Army Corps of Engineers Philadelphia District.

 To authorize the following water obstructions and encroachments associated with the: 1. Deer Lake Wastewater Treatment Plant Expansion, 2. Deer Lake Pump Station Upgrade, and 3. Deer Lake Sanitary Sewer Collection System. The project will permanently impact 0.91 acre of wetlands and temporarily impact 1.00 acre of wetlands. The permittee is required to provide 0.91 acre of replacement wetland.

 1. Deer Lake Wastewater Treatment Plant Expansion—To place and maintain an average of 3 feet of fill in approximately 2.2 acres of the floodplain of Pine Creek (CWF); to place fill in 0.91 acre of PEM wetlands; and to construct and maintain a treated wastewater outfall pipe with an endwall and riprap apron in the floodway of Pine Creek (CWF). The Deer Lake Wastewater Treatment Plant Expansion is located on the south side of SR 0895 (Market Street) approximately 0.3 miles southwest of its intersection with SR 0061 (Auburn, PA Quadrangle Latitude: 40° 36` 59"; Longitude: -76° 03` 40") in West Brunswick Township, Schuylkill County.

 2. Deer Lake Pump Station Upgrade—To place and maintain an average of 3 feet of fill in approximately 0.1 acres of the floodplain of Pine Creek (CWF) and to construct and maintain an 8-inch diameter sanitary PVC force main across Pine Creek (CWF) (Stream Crossing 9) and approximately 45 feet of adjacent PEM wetlands.  To construct and maintain a 9-foot wide wooden pedestrian bridge, having a 13-foot span and a 4-foot underclearance, across a tributary to Little Lehigh Creek (HQ-CWF), locally known as Briarwood Spring. The bridge is also located within the 100-year floodway of Little Lehigh Creek (HQ-CWF). The purpose of the project is to serve an adjoining 8-foot wide gravel walking trail, a portion of the Little Lehigh Parkway Trail System. The project is located along in the Queen City Trout Nursery on the north side of Fish Hatchery Road (S.R. 2010), approximately 0.3 mile east of its intersection within South Cedar Crest Boulevard (S.R. 0029) (Allentown West, PA Quadrangle Latitude: 40°33`49"; Longitude: -75°30`45").  To construct and maintain the Monocacy Park and Streetscape Project with work consisting of excavation and placement of fill in approximately 0.55 acres of the floodway/floodplain of Monocacy Creek (HQ-CWF) and the construction of walkways, benches, patio areas and other site amenities within the same area. The project is located on the north side of S.R. 0987 (West Main Street) at its intersection with S.R. 0329 (Race Street) (Catasauqua, PA Quadrangle Latitude: 40°43`34.5"; Longitude: -75°23`41.6").  To maintain a 16-inch and 14-inch natural gas pipeline crossing of an unnamed tributary to Pettis Creek (WWF) with work consisting of placing an 85-foot long articulating grout mat over the 2 exposed pipelines and adjacent streambanks The project is located on the west side of Rafferty Road, approximately 0.10 mile south of its intersection with Hawley Road (Montrose West, PA Quadrangle Latitude: 41°49`13"; Longitude: -75°53`35"). Subbasin: 4D.

 To remove a portion of Reilly's Pond Dam and to construct and maintain a road crossing of a tributary to Nescopeck Creek (HQ-CWF) consisting of a 33-foot long open-bottom precast concrete arch culvert having a 12-foot span and a 5-foot underclearance and to construct and maintain a 6-foot wide, 175-L.F. vegetated trapezoidal channel through a de minimus area of EV wetlands equal to 0.01 acre for the purpose of re-establishing natural stream conditions within the former reservoir area. The project is located in Nescopeck State Park along the north side of Charles Drive, approximately 300 feet east of the intersection of Lake Francis Road and Co. Road 41 (Honey Hole Road) (Freeland, PA Quadrangle Latitude: 41° 05` 29"; Longitude: -75° 52` 50") in Dennison Township, Luzerne County. Subbasin: 5D.

E58-288. Hop Bottom Borough, P. O. Box 75, Hop Bottom, PA 18824. Hop Bottom Borough, Susquehanna County, Army Corps of Engineers Baltimore District.

 To construct and maintain a stream restoration project along two sections in a 1,500 foot reach of Martins Creek (CWF, MF) using natural stream design techniques. The upstream section impacts approximately 120 feet of stream channel and consists of the placement of a rock cross-vane. The downstream section impacts approximately 350 feet of stream channel and consists of the placement of a rock J-hook, two single arm vanes and 150 feet of bank stabilization using stepped-back stones. The project begins approximately 250 feet downstream State Route 0167 (Main Street) (Hop Bottom, PA Quadrangle Latitude: 41°42`16"; Longitude: - 75°46`01") and ends on the east side of Greenwood Street approximately 1750 feet downstream of State Route 0167 (Main Street) (Hop Bottom, PA Quadrangle Latitude: 41°42`07"; Longitude: -75°45`56"). Subbasin: 4F.

 The applicant proposed to construct, operate and maintain a water intake structure within Pine Creek, an overhead electric conductor across Pine Creek and associated wetlands, and appurtenances within the 100-floodway of Pine Creek for surface water withdrawal to support natural gas well development. The water intake shall be constructed to occupy a maximum 800-square feet of public with no obstruction to navigation or limiting of other recreational use. The water intake structure and electric conductor appurtenances within the 100-year floodway shall be limited two utility poles, a six-inch diameter water supply and electrical conduit, an aerial electrical line crossing wetlands, and a 72-inch diameter manhole. The project is located along the western right-of-way of SR 0414 and Pine Creek Rail Trail approximately 0.5-mile north of Truman Run Road and SR 0414 intersection

 The PAPCO Lot 49 project is located south of Browns Run in the Allegheny National Forest in Mead Township, Warren County. The applicant proposes to construct 2,869 linear feet of roadway with well pads and install pipeline for oil and gas within the roadway. The total acreage proposed to be disturbed is 2.95 acres. The water obstructions and encroachments associated with the project include the construction and maintenance of two pipeline/road stream crossings of a UNT to Browns Run (EV) and four pipeline/road crossings of PEM EV wetlands, resulting in a permanent impact of 107 feet of stream and 0.103 acre of wetland. The construction of 0.103 acre of PEM wetland is proposed as mitigation for wetland impacts. The water obstructions and encroachments for the purpose of installing the roadways and pipeline are described below:

 (1) Wetland A: Construction of a permanent road crossing and a 2" diameter plastic gathering line to be installed by open trench under a palustrine emergent (PEM) EV wetland. Impacted area: 281 square feet; (41° 48` 15" N, 79° 00` 32" W).

 (2) Wetland B: Construction of a permanent road crossing with a 12" culvert and a 2" diameter plastic gathering line to be installed by open trench under a palustrine emergent (PEM) EV wetland. Impacted area: 624 square feet; (41° 48` 15" N, 79° 00` 31" W).

 (3) Wetland C: Construction of a permanent road crossing with 24" culvert at Stream Crossing #3 and a 2" diameter plastic gathering line to be installed by open trench under a palustrine emergent (PEM) EV wetland. Impacted area: 2623 square feet; (41° 48` 16" N, 79° 00` 28" W).

 (4) Wetland F: Construction of a permanent road crossing with a 12" culvert to be installed in a palustrine emergent (PEM) EV wetland. Impacted area: 956 square feet; (41° 48` 13" N, 79° 00` 30" W).

 (5) Stream Crossing #3: Construction of a permanent road crossing with a 49.5 foot long, 24 inch diameter culvert and a 2" diameter plastic pipeline to be installed by open trench across an unnamed tributary to Browns Run (EV). Impacted area: 297 square feet; (41° 48` 15" N, 79° 00` 28" W).

 (6) Stream Crossing #4: Construction of a permanent road crossing with a 57.7 foot long, 12 inch diameter culvert and a 2" diameter plastic pipeline to be installed by open trench across an unnamed tributary to Browns Run (EV). Impacted area: 173 square feet; (41° 48` 15" N, 79° 00` 22" W).

The project will include the backfilling of 0.18 acres of PEM wetlands that have developed within the open surface mine pit. Project will include the construction of 0.18 acres of replacement wetlands on-site. (West Sunbury Quadrangle N: 12 inches, W: 10 inches).

 Description: The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. Brent Community Cooperative Water Association, Inc. has applied for the Design and Engineering for repairing/replacing the existing Public Water Supply system in order to comply with the Safe Drinking Water Rules and Regulations.

 The Department's review of the project and the information received has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby categorically excludes this project from the State Environmental Review Process.

Request for Comments on the Proposed Total Maximum Daily Loads (TMDLs) Developed for the Susquehanna River, Unnamed Tributary 07251 Watershed in Lancaster County Pennsylvania

 The Department of Environmental Protection will accept comments on the proposed TMDLs developed for the Susquehanna River, Unnamed Tributary 07251 Watershed in Lancaster County, PA. These TMDLs were established in accordance with the requirements of Section 303(d) of the Clean Water Act. The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included impaired stream segments in this watershed. The listings of these waterbodies were due to use impairments caused by excessive siltation.

 There currently are no state or federal instream numerical water quality criteria for siltation. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. These proposed TMDLs set allowable loadings of sediment in the Susquehanna River, Unnamed Tributary 07251 Watershed. The sediment loadings were allocated among cropland, hay/pasture land, transitional land and streambank categories present in the watershed. Data used in establishing these TMDLs was generated using a water quality analysis model (AVGWLF) designed by the Pennsylvania State University.

 The following table shows the estimated current sediment loadings for the watershed. Overall load reductions necessary in order to meet the TMDLs are also identified.
