Amendment No. 2 to Proclamation of January 31, 2011

March 31, 2011

Whereas, on January 31, 2011, I declared an emergency declaration due to a winter storm, accompanied by substantial accumulations of snow and ice that impacted the Commonwealth of Pennsylvania with severe weather conditions; and

Whereas, on March 10, 2011, I amended the proclamation in order to respond to localized flooding in certain creeks and streams that caused damage to public infrastructure and caused other adverse impacts upon the population of the Commonwealth; and

Whereas, these severe winter weather conditions have continued throughout February and March and are projected to extend into April, 2011 with potentially additional snowfall, sleet and freezing rain thereby causing another emergency response related to treating Pennsylvania's highways in preparation for the impending winter storm; and

Now Therefore, Pursuant to the provisions of Subsection 7301(c) of the Emergency Management Services Code (35 Pa.C.S.A. Section 7101 et seq. as amended), I do hereby amend my Proclamation of January 31, 2011, as follows:

 1. I hereby authorize the Secretary of Transportation, in his sole discretion, to waive any provision of the Vehicle Code or any other law or regulation which he is authorized by law to administer or enforce as may be necessary to respond to this impending emergency.

 2. I further authorize the Secretary of Transportation, if he so determines, that if the Commonwealth is in need of greater flexibility in the application of state and federal motor carrier regulations to accommodate Department of Transportation truck drivers in responding to this emergency across the state, to hereby waive any laws or Federal or state regulations related to drivers of commercial vehicles.

 3. All state agencies are directed to render additional resources as is necessary to assist county and municipal efforts to mitigate and contend with the magnitude and severity of this continuing and expanding disaster emergency.

 4. The provisions of the January 31, 2011 Proclamation shall remain in effect.

 5. This Amendment to Proclamation shall take effect immediately.
