FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

EA17-010. EQT Gathering, LLC, EQT Plaza, 625 Liberty Avenue-Suite 1700, Pittsburgh, PA 15222. Concrete Road Removal and Site Restoration of Jack Dents Branch-Medix Run, Goshen Township, Clearfield County, ACOE Baltimore District (The Knobs, PA Quadrangle Latitude: 41° 13` 24.34."; Longitude: 78° 22` 24.40").

 The applicant proposes to remove an existing concrete road crossing Jack Dents Branch, Medix Run, (High Quality-Cold Water) to restore the natural stream channel cross-section, profile and stability. As proposed, the restoration of the stream channel section, shall include but not be limited to, construction of a temporary rock construction access along the stream left and right over-bank, complete removal of the 12-foot (wide) by 18-foot (long) concrete slab, and stabilization of stream bank along both stream banks that were affected by the concrete road section. Construction of the temporary access road shall be with clean AASHTO rock with minimal Number 1 gradation. Upon completion of the concrete slab removal, the temporary construction access road shall be completely removed with the area graded, scarified, and vegetative cover established to good condition. The concrete slab road section shall be completely removed from the stream channel, floodway and floodplain. Removal of the slab shall be completed in dry work conditions by dam and pumping, fluming or diverting stream flow around the work area. The concrete slab and its encased pipes shall be properly disposed. Since Jack Dents Branch is both a wild trout and stock trout fishery, no in-stream activity shall be conducted in or along the stream channel between October 1 to December 31 and March 1 to June 15 without prior written approval from the Pennsylvania Fish and Boat Commission. As proposed, the project poses no impact to wetlands in restoring 20-feet of the natural channel cross-section. The project is located along the northern right-of-way of Jack Dent Road, approximately 1.8-miles east of Medix Grade Road and Jack Dent Road intersection.

 The project will result in 57 linear feet of temporary stream impacts and 27018 square feet of wetland impacts from water lines and temporary mat crossings. These crossings will accumulate a total of 0.01 acres of watercourse impacts and 0.62 acres of wetland impacts all for the purpose of installing temporary water lines with associated access roadways for Marcellus well development.

 To construct, operate, and maintain:

 (1) one 6 inch water line across Long Run (HQ-CWF, MF) and a temporary stream mat crossing impacting 41 linear feet (Trout Run Quadrangle 41°27`53" N 77°1`14" W),

 (2) one 6 inch water line across an unnamed tributary to Long Run (HQ-CWF, MF) and a temporary stream mat crossing impacting 2 linear feet (Trout Run Quadrangle 41°27`54" N 77°1`12" W),

 (3) one 6 inch water line across Grays Run (HQ-CWF, MF) impacting 47 linear feet (Trout Run Quadrangle 41°27`51" N 77°0`59" W),

 (4) a single-lane, single-span, steel deck beam bridge having a span of 60 feet, a width of 16 feet, and an underclearance of approximately 2.5 feet over Grays Run (HQ-CWF, MF) (Trout Run Quadrangle 41°27`51" N 77°0`59" W).

 The project will result in 90 linear feet of temporary stream impacts from water line crossings. These crossings will accumulate a total of 0.01 acres of watercourse impacts all for the purpose of installing a water line and associated access roads for Marcellus Shale well development.

ENVIRONMENTAL ASSESSMENT

Northcentral Region: Program Manager, Watershed Management Program, 208 West Third Street, Williamsport, PA 17701

EA17-009. Lawrence Township, P. O. Box 508, Clearfield, PA 16803. Montgomery Creek 52A Acid Mine Drainage Treatment System, Lawrence Township, Clearfield County, ACOE Baltimore District

 The applicant proposes to treat Acid Mine Drainage (AMD) from several sources along an unnamed tributary of Montgomery Creek (Cold Water and Migratory Fishery). Montgomery Creek, in this location, is impaired due to low pH and high metals. The AMD originates from the abandoned strip mines upgradient of the area. As proposed, the treatment system will consist of a limestone cell, two bioreactors, two settling basins, and two small anoxic limestone drains. Topographical constraints will only allow treatment of approximately 75% of the average daily flow. Analytical data of the seeps show that the combined discharges contribute approximately 18.3 lbs/day of acidity, 12.7 lbs/day of iron, and 9.5 lbs/day of aluminum to Montgomery Creek. The project is anticipated to result in downstream water quality improvements by reducing acidity, iron, and aluminum loadings. The system is designed to discharge water that is net alkaline, have a pH greater than 6.5, and iron and aluminum concentrations of less than milligram per liter. A 0.1707 acre wetland will be permanently impacted during the construction of the limestone cell. The current AMD drainage channel will be altered by the treatment system and three outfalls will be placed along the UNT to Montgomery Creek. The total impact to the channels is estimated to be 720.44 feet. There will be approximately 6.24 acres of total earth disturbance, which includes the construction spoil and borrow areas. Onsite wetland mitigation is not proposed due to space and topographical constraints. Instead, a $1,000 contribution to the Pennsylvania Wetland Replacement Fund is proposed. Mitigation for the stream channel impact is improved water quality downstream of the treatment system. The applicant is requesting Waiver 16 under Chapter 105.12 of Dam Safety and Waterway Management. (Clearfield, PA Quadrangle Latitude: 41° 1` 29.4"; Longitude: 78° 29` 3.1").

Project proposes to breach and remove Duck Marsh Pond No. 26 dam and an unnamed dam across a tributary to Mosquito Creek (HQ-CWF) for the purpose of eliminating a threat to public safety and restoring the stream to a free flowing condition. The project will restore approximately 2800 feet of stream channel. The dams are located approximately 1.5 miles southeast of the intersection of the Quehanna Highway (SR 2004) and Ardell Road. (The Knobs, PA Quadrangle; Latitude: 41° 14` 03", Longitude: -78° 19` 36").

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.
