Final Technical Guidance—New Guidance

DEP ID: 392-2130-015. Title: Guidelines for Development of Critical Area Resource Plans. Description: The Water Resources Planning Act (Act 220 of 2002) provides for the development of a Critical Area Resource Plan (CARP) for any watershed designated as a Critical Water Planning Area (CWPA). The purpose of this policy is to provide guidance to Department staff, Regional Water Resources Committees, the Statewide Water Resources Committee, State and Federal agencies, businesses and the public to assist in development of CARPs. This document outlines the plan elements and process that will be used to develop, review and approve CARPs. These elements are solely for planning purposes and are not intended to reflect existing or future regulatory requirements. This document was published as a draft at 39 Pa.B. 6520 (November 7, 2009). No comments were received during the 30-day public comment period. Related Technical Guidance Document No. 392-2130-014, Guidelines for Identification of Critical Water Planning Areas, describes the process and criteria that will be used to identify CWPAs. After an area receives CWPA designation, a more intensive planning process will be undertaken to produce a CARP. This plan will include a more detailed investigation of water availability and current and future demands for water, with a focus on identifying existing and potential conflicts among users and possible alternatives to resolve the conflicts. The CARP that results from the study is not a regulatory document and will not be binding. It will, however, suggest measures and actions that could be adopted voluntarily to address the potential water shortage in the area. Contact: Questions regarding the technical guidance should be directed to Lori Mohr at (717) 787-4628 or laumohr@state.pa.us.

Effective Date: Final upon publication in the Pennsylvania Bulletin.
