THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

 This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements.

 For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.

 Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).

 Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Application No. PA0248746, Concentrated Animal Feeding Operation (CAFO), Country View Family Farms, LLC, 1301 Fulling Mill Road, Suite 3000, Middletown, Pennsylvania 17057.

 Country View Family Farms, LLC has submitted an application for an Individual NPDES permit for an expanding CAFO known as New Hope Sow Farm, located at 23177 Back Road, Concord, Pennsylvania 17217 in Fannett Township, Franklin County.

 The CAFO is situated near an UNT to Doylestown Stream in Watershed 12-B, which is classified for cold water fishery. The CAFO will be designed to maintain an animal population of approximately 2,715.95 animal equivalent units (AEUs) consisting of 5,880 sows, 2,000 gilts, and 15 boars. Manure will be collected and stored in concrete underneath storage. Prior to operation of the manure storage facilities, the design engineer will be required to submit certification that the facilities were constructed in accordance with appropriate PA Technical Guide Standards. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 100-year, 24-hour storm event.

 The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.

 Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701

PA0234087, CAFO, 0213, 0211, Philip D. Courter, 6527 Jacksonville Road, Mill Hall, PA 17751-8876. This proposed facility is located in Porter Township, Clinton County.

 Description of Proposed Activity: New CAFO operation due to expansion of an existing swine and beef facility near Mill Hall, PA. The farm consists of 20 cow/calf pairs and 4600 finishing hogs for a total of 690.01 AEUs. The farm consists of 160 acres which includes about 22 acres of pasture land, about 124 acres of cropland, and the balance is in farmstead and woods. The excess manure will be exported to a nearby farm. The beef herd produces 129 tons of solid manure per year and the hogs produce 1.6 MG of liquid manure per year. The hog manure is stored in two underbarn concrete pits and a round concrete pit for a total storage of 1.86 MG.

 The receiving stream, Cedar Run, is in the State Water Plan Watershed 09C (Beech Creek) and is classified for: HQ-CWF.

 The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25-year/24-hour rain storms, the CAFO permit is a non-discharge NPDES permit. Where applicable, compliance with 40 CFR federal effluent limitation guidelines is required. The permit requires no other numeric effluent limitations and compliance with the Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the state narrative water quality standards.

 In addition to the effluent limits, the permit contains the following major special conditions.

 1. Compliance with the farm's Nutrient Management Plan

 2. Compliance with the farm's Preparedness, Prevention and Contingency Plan

 3. Compliance with the Farm's Erosion & Sedimentation Control Plan for plowing and tilling

 4. Erosion & Sedimentation Control Plan requirements for stormwater during construction activities

 5. Animal mortality handling and disposing requirements

 6. Certification requirements for manure storage facilities

 7. Requirements for storage of feed and other raw materials

 8. Best Management Practices requirements.

 9. Manure that is stockpiled for 15 consecutive days or longer shall be under cover or otherwise stored to prevent discharge to surface water during a storm event up to and including the appropriate design storm for that type of operation under § 91.36(a)(1) and (5) (relating to pollution control and prevention at agricultural operations).

 10. The permittee shall maintain a minimum of 6 inches freeboard at the hog barn underbarn liquid manure storage structures at all times. The permittee shall maintain a minimum of 1 foot freeboard at the round, concrete manure storage facility at all times.

 11. If the permittee exports manure, then the permittee shall complete the Manure Exportation Report form and submitted it to the Department with the CAFO Quarterly Self-Inspection Report.

 The EPA waiver will not be in effect.
