Finding

 Under section 2002(b) of The Administrative Code of 1929 (71 P. S. § 512(b)), the Director of the Bureau of Project Delivery as delegated by the Secretary of Transportation makes the following written finding:

 The Department of Transportation (Department) is planning to replace a structurally deficient and deteriorating bridge carrying SR 0272, Section 026 over the former Reading Railroad line in Ephrata Borough and Ephrata Township, Lancaster County. The existing superstructure and part of the substructure will be removed. An arch culvert will replace the existing structure and the roadway will be reconstructed to match the existing profile and adjacent roadway widths on SR 0272.

 Permanent Right-of-Way (ROW) takes are required for this project to accommodate the proposed fill slopes. A Temporary Construction Easement will also be required to construct an access road for construction in the northeast quadrant. The ROW acquisition is required from a Section 2002 property, the future rail trail (0.05 acre). The future rail trail under SR 0272, Section 026 currently contains overgrown vegetation making it difficult for passage. The bridge removal project will be completed prior to the conversion of the corridor to the future rail trail, and will provide adequate passage for the trail users.

 In accordance with section 2002 of The Administrative Code of 1929 establishing the Department, a Level-1b Environment Document has been developed for the subject project to evaluate the potential environmental impacts caused by the subject project along with a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use document. The Section 4(f) document also serves as the Section 2002 Evaluation. The approved documents are available in the CE/EA Expert System. The environmental, economic, social and other effects of the proposed project as enumerated in section 2002 of The Administrative Code of 1929 have been considered. Based upon studies, there is no feasible and prudent alternative to the use of the Section 2002 resources for the proposed action.
