NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

STORMWATER MANAGEMENT

Plan Description: The Corrective Action Plan (CAP), submitted as a plan update revision to the Township's Official Sewage Facilities Plan, proposes a systematic investigation that will identify and propose corrective measures for portions of the Hazle Township wastewater collection system that may be subject to excessive amounts of infiltration/inflow (I/I). The CAP is also intended to reduce hydraulic overloading at the Greater Hazleton Joint Sewer Authority's Wastewater Treatment Facility. The CAP also contains an implementation schedule for its investigative activities. The CAP is now to be considered an integral part of Hazle Township's Official Sewage Facilities Plan.

 Should conditions be encountered during the implementation of the CAP, which require the alteration of the approved CAP, Hazle Township shall contact the Department, in writing, and discuss the need to alter the CAP at the earliest possible time. Any additional wastewater-related improvements, additions, deletions or changes outside of those explicitly described in the CAP must be in compliance with the Department's regulations and be submitted to and approved by the Department in writing.

 Plan Description: Approval of a revision to the Official Sewage Plan of Middlesex Township, Cumberland County. The plan revision provides for the use of a small flow treatment facility with a discharge to an unnamed tributary of Conodoguinet Creek, to serve the long term sewage disposal needs of a single family dwelling that is currently served by an on lot sewage disposal system. The property is located at 21 Mountain Road, Carlisle PA. The Department's review of the plan revision has not identified any significant impacts resulting from this proposal. The DEP Code Number for this planning module is A3-21915-214-3S. Any required WQM Permits must be obtained in the name of the property owner.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Jacqueline Beck, HDR Engineering, Inc., 1720 Spillman Drive, Suite 280, Bethlehem, PA 18015-2165 has submitted a Final Report (on behalf of her client, Michael Snisky, 819 Center Avenue, Jim Thorpe, PA 18229), concerning the remediation of soil found to have been impacted by home heating oil as a result of a release at a home heating oil delivery. The report was submitted to document attainment of the Residential Statewide Health Standard for soil. A public notice regarding the submission of the final Report was published in The Morning Call on December 25, 2010.

Rockwood Pigments (Metal Shop), 1525 Wood Avenue, Easton City, Northampton County. Thomas J. Martinelli, JMT Environmental Technologies, Inc., P. O. Box 22044, Lehigh Valley, PA 18002-2044 has submitted a Final Report (on behalf of his client, Rockwood Pigments NA, Inc., 1525 Wood Avenue, Easton, PA 18042), concerning the remediation of soil found to have been impacted by No. 2 fuel oil as a result of a leaking underground storage tank system. The report was submitted to document attainment of the Statewide Health Standard for soil. A public notice regarding the submission of the Final Report was published in The Express Times on December 13, 2010. A Notice of Intent to Remediate was simultaneously submitted.

Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110

Martin Limestone / Limeville Quarry, Salisbury Township, Lancaster County. The report is intended to document remediation of the site to meet the Residential Statewide Health standard.

Erick Watts Residence, Warwick Township, Lancas- ter County. West Brandywine Environmental, Inc., 16 Ashley Court, West Brandywine, PA 19320-1350, on behalf of Erick Watts, 541 Furnace Hills Park, Lot 2, Lititz, PA 17543 and D & B Associates, 100 Birchview Drive, Coatesville, PA 19320, submitted a Final Report concerning remediation of site soils contaminated with No. 2 fuel oil from an aboveground storage tank. The report is intended to document remediation of the site to meet the Residential Statewide Health standard.

Mary Alice Bingaman Residence, Annville Township, Lebanon County. Meyer Oil Company, PO Box 2004, Cleona, PA 17042, on behalf of Mary Alice Bingaman, 829 East Walnut Street, Annville, PA 17003, submitted a Final Report concerning remediation of site soils contaminated with No. 2 fuel oil released from a vent pipe. The report is intended to document remediation of the site to meet the Residential Statewide Health standard.

Permit Application to Conduct Mining Activities

 The following permit application to conduct mining activities has been received by the Department of Environmental Protection, Moshannon District Mining Office. A copy of the application is available for inspection at the District Mining Office indicated above each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

SMP #17100109, Sky Haven Coal, Inc., 5510 State Park Road, Penfield, PA 15849. Application is for a proposed project located in Boggs Township, Clearfield County and will involve the remining of abandoned surface mined land. Wetlands that have developed in the abandoned pits will be affected and replaced at the conclusion of mining. Total wetlands to be affected are 0.4 acre which will be replaced with 1.03 acres of wetlands.

 Written comments or objection on the permit application and the request for Section 401 water quality application may be submitted to the Department.
