FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The project is located on the north side of Railroad Street approximately 700 feet southeast of the intersection with Freedom Avenue (Burnham, PA Quadrangle; N: 0.8 inch, W: 9.0 inches; Latitude: 40°37`46.7", Longitude: -77°33`52.3") in Burnham Borough, Mifflin County. The purpose of the project is to make the necessary upgrades for the removal of Total Nitrogen and Total Phosphorous to meet the effluent limits mandated by Burnham's NPDES Permit and the Chesapeake Bay Tributary Strategy. No wetlands will be impacted by this project.

E17-472. Pennsylvania Department of Transportation, Engineering District 2-0, 1924 Daisy Street Extension, Clearfield, PA 16830. SR 0255, Section A06 Bridge Replacement over Sandy Lick Creek in Sandy Township, Clearfield County, ACOE Baltimore District (Sabula, PA Quadrangle; Latitude: 41° 10` 00"; Longitude 78° 39` 45").

 The applicant proposes to remove the existing bridge structure, construct, operate and maintain a new 19 X 9 ft. Single Cell Precast Concrete Box Culvert. The existing structure is a single span concrete T-beam bridge with a normal span of 20 ft., skew of 60° and an average underclearance of 8.27 ft. The proposed structure will be constructed on approximately the same horizontal and vertical alignment as the existing structure. The proposed box culvert has a normal span of 19 ft., skew of 60° and an average underclearance of 8 ft. The box culvert will be depressed one foot and will include baffles in accordance with the BD-632m and PA FBC recommendations. The proposed box culvert has a structure length increase of approximately 28 Ft. upstream to downstream; therefore, it is not eligible for a General Permit 11. The project will not increase water surface elevations for the 100 year storm. Sandy Lick Creek is classified as a Trout Stream Fishery. The project proposes to temporarily impact 0.21 Acres and permanently impact 0.04 Acres of Jurisdictional Wetlands. This is a Deminimus impact and does not require mitigation. This permit also includes 401 Water Quality Certification.

E41-622. Richard A. Leonard, 6589 State Route 973 W, Cogan Station, PA 17728. Leonard River Lot, in Piatt Township, Lycoming County, ACOE Baltimore District (Linden, PA Quadrangle N: 41° 12` 52.3"; W: -77° 01` 57.6").

 To construct and maintain a 12-foot by 24-foot open-sided pavilion on an existing pad of gravel in the left 100-year floodway of the West Branch Susquehanna River located 600 feet east of the southern end of Riverside Lane. This permit was issued under Section 105.13(e) ''Small Projects.''

 The Department of Environmental Protection (DEP) approved a revision to the Susquehanna County Municipal Waste Management Plan on March 1, 2012. Any person aggrieved by this action may appeal, pursuant to Section 4 of the Environmental Hearing Board Act 35 P. S. Section 7514, and the Administrative Agency Law, 2 Pa.C.S. Chapter 5A, to the Environmental Hearing Board, Second Floor, Rachel Carson State Office building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, 800-654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Request for Comments on the Proposed Total Maximum Daily Loads (TMDLs) Developed for the Hunters Creek Watershed in Juniata County

 The Department of Environmental Protection will accept comments on the proposed TMDLs developed for the Hunters Creek Watershed in Juniata County, PA. These TMDLs were established in accordance with the requirements of Section 303(d) of the Clean Water Act. The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included impaired stream segments in this watershed. The listings of these waterbodies were due to use impairments caused by excessive siltation and/or nutrients.

 There currently are no state or federal instream numerical water quality criteria for siltation or nutrients. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. These proposed TMDLs set allowable loadings of sediment and phosphorus in the Hunters Creek Watershed. Phosphorus was chosen as the TMDL endpoint for nutrient impairments due to it being the limiting nutrient in the watershed. The sediment and phosphorus loadings were allocated among cropland, hay/pasture land, transitional land and streambank categories present in the watershed. Data used in establishing these TMDLs was generated using a water quality analysis model (AVGWLF) designed by the Pennsylvania State University.

 The following table shows the estimated current sediment and phosphorus loadings for the watershed. Overall load reductions necessary in order to meet the TMDLs are also identified.
