 The Independent Regulatory Review Commission met publicly at 10 a.m., Thursday, April 18, 2013, and announced the following:

Regulations Deemed Approved Pursuant to Section 5(g) of the Regulatory Review Act—Effective November 14, 2012

 Insurance Department #11-250: Requirements for Funds Held as Security for the Payment of Obligations of Unlicensed, Unqualified Reinsurers (amends 31 Pa. Code, Chapter 163, § 163.1)

Higher Education—General Provisions;
Regulation No. 6-328 (#2990)

 On March 5, 2013, the Independent Regulatory Review Commission (Commission) received this regulation from the State Board of Education (Board). This rulemaking amends 22 Pa. Code Section 31.21. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.

 This one-word amendment changes the specialized associate degree curricula requirement to either 60 semester credit hours or 1,500 clock hours.

 We have determined this regulation is consistent with the statutory authority of the Board (24 P. S. § 26-2603-B(a)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Insurance Department—
Requirements for Qualified and Certified Reinsurers;
Regulation No. 11-249 (#2970)

 On August 22, 2012, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Insurance Department (Department). This rulemaking amends 31 Pa. Code (§§ 161.1—161.9). The proposed regulation was published in the September 1, 2012 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on March 18, 2013.

 This final-form rulemaking updates existing regulations relating to certifying reinsurers to be consistent with amendments to the Insurance Company Law, as well as the model law and regulation developed by the National Association of Insurance Commissioners.

 We have determined this regulation is consistent with the statutory authority of the Department (40 P. S. § 442.1) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Department of Labor and Industry—
Unemployment Compensation;
Active Search for Work;
Regulation No. 12-96 (#2939)

 On April 19, 2012, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Labor and Industry (Department). This rulemaking amends 34 Pa. Code § 65.11. The proposed regulation was published in the May 5, 2012 Pennsylvania Bulletin with a 30-day public comment period. A final-form regulation was submitted to the Commission on November 5, 2012. At its December 13, 2012 public meeting, the Commission voted to disapprove the final-form regulation. On March 26, 2013, the revised final-form regulation was submitted to the Commission.

 This revised final-form regulation establishes the criteria necessary for unemployment compensation claimants to conduct an active search for suitable employment.

 We have determined this regulation is consistent with the statutory authority of the Department (43 P. S. § 761(a)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
