FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To authorize the following water obstruction and encroachments associated with the PA Solar Park electric transmission line:

 1) To construct and maintain a 15-ft wide gravel utility service road across 65 feet of EV wetlands within the Nesquehoning Creek Watershed. The crossing will permanently impact 0.17 acre of EV wetlands.

 2) To construct and maintain a 15-ft wide gravel utility service road across 50 feet of EV wetlands within the Nesquehoning Creek Watershed. The crossing will permanently impact 0.04 acre of EV wetlands.

 3) To construct and maintain a 15-ft wide gravel utility service road across 22 feet of EV wetlands within the Nesquehoning Creek Watershed. The crossing will permanently impact 0.04 acre of EV wetlands.

 4) To remove the existing structure and construct and maintain a gravel utility road crossing of a tributary to Nesquehoning Creek consisting of a 24-inch diameter RCP with headwalls and riprap apron.

 5) To remove the existing structure and construct and maintain a gravel utility road crossing of a tributary to Nesquehoning Creek consisting of a 21-inch diameter RCP with headwalls and riprap apron.

 6) To construct and maintain a stormwater outfall in the floodway of Nesquehoning Creek consisting of a 21-inch diameter RCP, flared end section, and riprap apron.

 The project is located on the north side of the S.R. 54, approximately 2.2 miles west of the intersection of U.S. Route 209 (Nesquehoning, PA Quadrangle, Latitude: 40°51`18"; Longitude: -75°31`32").

 To remove the existing wastewater treatment tanks and appurtenant structures and to construct and maintain an approximately 29-foot by 95-foot encroachment, consisting of a new wastewater treatment facility enclosed by reinforced concrete walls, in the floodway of Brodhead Creek (HW-CWF, MF) for the purpose of upgrading the Stroudsburg Mill wastewater treatment system.  The project proposed directly affects 0.0433 acre of wetland, 0.02 acre of floodway, and 0.06 acre of floodplain, and temporarily impacts 0.4842 acre of wetland and 505.0 linear feet of stream.

E44-146: Mifflin County Conservation District (Hungry Run Stream Restoration), 20 Windmill Hill #4, Burnham, Pennsylvania 17009, in Burnham Borough, Mifflin County, ACOE Baltimore District

 To construct and maintain 951.0-foot long stream restoration including 675.0 feet of streambank grading and the installation and maintenance of: 1) 200.0 feet of R-4 riprap, 2) 56.0 feet of wooden crib wall, 3) one log sill, 4) 12 habitat boulder clusters, 5) two cross rock vanes, 6) three rock vanes, and 7) five plunge pools, all for the purpose of providing streambank stabilization and improving in-stream fish habitat. The project is located near the intersection of Jaspers Drive and 1st Avenue (Burnham, PA Quadrangle, Latitude: 40°38`11.8", Longitude: -77°33`42.7") in Burnham Borough, Mifflin County. No wetlands will be impacted by this project.

 Applicant proposes to construct and maintain three (3) road crossings, each with multiple utility line stream crossings, and two (2) stand-alone utility line stream crossings, of four (4) unnamed tributaries within the Ninemile Run watershed (WWF), for the purpose of installing the infrastructure (i.e. access roads and utility lines), for Phase II (an approximately 70 acre area), of the Westmoreland Air Park industrial development site. Culvert No. 1 will be a 14` wide x 4` high, pre-cast concrete box culvert. Culvert No. 2 will be a 48" diameter concrete pipe culvert. Culvert No. 3 will be a 84" diameter concrete pipe culvert. Both stand-alone utility line stream crossings will consist of 8" diameter ductile iron sanitary sewer pipe. The cumulative stream impact from these crossings will be approximately 411.3 feet; Latrobe, PA Quadrangle N: 1.39 inches, W: 6.68 inches; Latitude: 40° 15` 27.57", Longitude: 79° 25` 22.28". The project site is located near the intersection of Bayhill Road with State Route 981, in Unity Township, Westmoreland County.

E02-1551-A1 Pleasant Hills Authority, Fifth Floor, Suite 520, 1222 Cochrans Mill Road, Pittsburgh, PA 15025, South Park Township & Pleasant Hills Borough, Allegheny County, Pittsburgh ACOE District.

 Applicant proposes to amend their existing permit to include constructing and maintaining a new headworks building, along with other associated upgrades to the wastewater treatment plant, within the floodplain of Lick Run (TSF) for the purpose of preventing sanitary sewer overflows. The project is located approximately 600 feet northwest from the intersection of Wallace Road and Cochran's Mill Road (Glassport, PA Quadrangle N: 4.85 inches; W: 13.9 inches; Latitude 40° 18` 15"; Longitude 79° 58` 30") in South Park Township, Allegheny County.

E37-192, Hickory Run Energy, LLC, 400 Chesterfield Center, Suite 110, Chesterfield MO 63017. Hickory Run Energy Station, in North Beaver Twp and Mahoning Twp, Lawrence County, ACOE Pittsburgh District (Bessemer, PA Quadrangle N: 40°, 59`, 39.65"; W: 80°, 25`, 55.29").

 To construct a natural gas-fired electric generating facility with associated parking and infrastructure. Project includes construction of the generating plant located northeast of the intersection of McClelland Rd and SR 551, a switchyard located southwest of the same intersection, a natural gas metering station and pipeline connecting the plant to an existing natural gas pipeline west of Mohawk School Rd, electric transmission lines to connect the plant to existing transmission lines located to the west of the facility, and a water discharge pipeline to carry plant effluent water to an outfall along the Mahoning River.

 Project impacts include: 0.361 acre permanent wetland impact for 2 road crossings, widening of the existing access road, site grading, and placement of 1 utility pole; 0.253 acre temporary wetland impact for equipment access during road widening and pole placement; 130 LF temporary stream impact to a UNT Mahoning River for an equipment crossing; 8 horizontal directional drilled wetland crossings and 2 horizontal directional drilled stream crossings of UNTs Mahoning River for the natural gas and water discharge pipelines; 2 aerial crossings of wetlands by the electric transmission lines. Applicant proposes a $5,000 payment to the PA Wetland Replacement Fund to compensate for the permanent wetland impacts.

To construct an access road for a proposed gas well pad, crossing a UNT to North Fork Cross Creek, a Warm Water Fishery, in Jefferson Township, Washington County, Pittsburgh ACOE District, State Water Plan Basin 20D. This project will impact 50 linear feet of stream. The applicant proposes to install 50 feet of 36" HDPE culvert at the stream crossing for a permanent access road for the Burkett gas well pad. They will also install (2) 60 feet of 36" HDPE culverts approximately 50 feet west of the stream to convey the 100-year storm event. The upstream watershed drainage at the access road crossing is approximately 212 acres. (Avella Quadrangle, N: 14 inches; W: 12 inches).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
