THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should contact a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

 Description of Proposed Action/Activity: Issuance of an amendment to a Water Quality Management Permit for an existing sewage treatment facility, to re-rate the treatment capacity to 10,117 gpd and revise the effluent criteria for the discharge to the at-grade adsorption beds. The revised effluent criteria are: 20 mg/l CBOD5 and TSS as a 30-day average, and 30 mg/l CBOD5 and TSS as an instantaneous maximum.

 Description of Proposed Action/Activity: Permit approval for the construction / modification / operation of manure storage facilities consisting of a new 161` x 769` x 9` deep Breeding / Gestation Barn with concrete underneath deep pit manure storage that will store about 7,790,000 gallons at a 0.5` freeboard; a new 117` x 510` x 2` deep Farrowing Barn with concrete underneath shallow pit manure storage that will store about 442,000 gallons at a 0.5` freeboard. The Farrowing Barn will be drained to the Breeding / Gestation Barn when needed; A new 71` x 486` x 6` deep Gilt Grower Finishing Barn with concrete underneath deep pit manure storage that will store about 1,390,000 gallons at a 0.5` freeboard. All three new barns will include a leak detection perimeter drain that will each be connected to an observation well with shutoff valves on the inlet and outlet for control of any leakage.

 This proposed facility is located in Lower Heidelberg Township, Berks County.

 Description of Proposed Action/Activity: Permit approval for the construction of sewage facilities consisting of an 8-inch gravity collection system with a basis of design of 0.0218 mgd of average daily flow and 0.0872 mgd of peak instantaneous flow; a new duplex pumping station which will be rated at 70 gpm at 85.6 feet of total dynamic head; 1,607 ft of new 3-inch cast iron forcemain between the new pumping station and the existing gravity sewer manhole in Bayberry Lane.

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation tobe done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department regional office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. R. E. West, Inc., Interstate 80 @ MM 215 E, Turbot Township, Northumberland County. Northridge Group, Inc., 1172 Ridge Road, Northumberland, Pa 17857, on behalf of R. E. West, Inc. submitted a Final Report concerning the remediation of site soils contaminated with Benzene, Toluene, Ethylbenzene, Cumene, Nap-thalene, 1,3,5-Trimethylbenzene, 1,2,4-Trimethylbenzene, Methyl Tertiary Butyl Ether, Lead, Benzo(a) anthracene, Benzo(a) pyrene, Benzo(b) fluoranthene, Benzo (g,h,i)-perylene, Chrysene, Indento (1,2,3-cd) pyrene, Pyrene. The Final Report did not demonstrate attainment of the Statewide Health and Site Specific standards, and was disapproved by the Department on April 7, 2014.

BWISE Manufacturing LLC / Route 283 Gasoline Release, State Route 283 Westbound and Route 772, Mount Joy, PA, Rapho Township, Lancaster County. Environmental Products & Services of Vermont, Inc., 5100 Paxton Street, Harrisburg, PA 17111, on behalf of Ridgewood Manor, 223 North Strickler Road, Manheim, PA 17545 and BWISE Manufacturing, LLC, 1086 Wayne Avenue, Chambersburg, PA 17201, submitted a Final Report concerning remediation of site soils contaminated with unleaded gasoline released in a vehicle accident. The Final Report demonstrated attainment of the Residential Statewide Health standard, and was approved by the Department on April 7, 2014.

Charles Lafferty Residence, 24 3rd Street, Doug-lassville, PA 19518, Amity Township, Berks County. Trimpi Associates, Inc., 1635 Old Plains Road, Pennsburg, PA 18073, on behalf of Mr. and Mrs. Charles Lafferty, 24 3rd Street, Douglassville, PA 19581 and State Farm Insurance, PO Box 106110, Atlanta, GA 30348-6110 submitted a Final Report concerning site soils contaminated with No. 2 fuel oil. The Final Report demonstrated attainment of the Residential Statewide Health standard, and was approved by the Department on April 8, 2014.

Former Carnegie Tar & Asphalt Property, 107 Dark Hollow Road, Borough of Oakmont, Allegheny County. KU Resources, Inc., 22 South Linden Street, Duquesne, PA 15110 on behalf of Kacin Companies/ Edgewater Properties, L.P., Inc., 3875 Old William Penn Highway, Murrysville, PA 15668 submitted a Final Report concerning the remediation of site soils and groundwater contaminated with arsenic, iron, benzene, trichloro-ethylene, and cis-1,2,-dichlorethene. The Final Report demonstrated attainment of the Site-Specific standard for soil and groundwater and was approved by the Department on April 9, 2014.
