FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Dubler Outdoor Classroom Driftwood Branch—Sinnemahoning Creek Floodfringe and Wheaton Hollow Floodway Development, Shippen Township, Cameron County. USACOE Baltimore District (Rich Valley, PA Quadrangle Latitude: 41° 30` 53.3"; Longitude: -78° 15` 5.7").

 This authorization gives consent to construct, operate and maintain a 20-foot by 30-foot, open-sided pavilion within the 100-year flood fringe of Driftwood Branch, Sinnemhanoning Creek and the floodway of Wheaton Hollow. The pavilion is to serve as an outdoor classroom immediately adjacent to the Gary Dubler Memorial Natural Trail. Construction, operation and maintenance of the pavilion shall be performed at existing elevations with no placement of fill. The project is located along the western right-of-way of SR 0046 (West Allegany Avenue) approximately 1485-feet north of Woodland Avenue and West Allegany Avenue intersection in Shippen Township, Cameron County. This permit was issued under Section 105.13(e) ''Small Projects.''

E41-653. DCNR—Pleasant Stream Road, Racheal Carson State Office Building, 6th Floor, P.O. Box 8552, Harrisburg, PA 17105-8552. Pleasant Stream Road Reconstruction Project in Cascade and McIntyre Townships, Lycoming County, ACOE Baltimore District (Bodines, PA Quadrangle Lat: 41° 29` 41.9"; Long: -76° 55` 30.2").

 To restore, construct and maintain Pleasant Stream Road in Cascade and McIntyre Townships—Lycoming County, which is located over Pleasant Stream. The previous roadway and structures were destroyed during Tropical Storm Lee in September 2011. The road has been closed as a result of the damage. The scope of the repairs is to reconstruct the road with generally the same geometry horizontal and vertical cross sections. The project will also consist of streambank stabilization and the removal of a gravel bar.

 A total of approximately 2,050 linear feet of new roadway embankment will be resurfaced with Driving Surface Aggregate (DSA). Approximately 970 lineal feet of roadway embankment will be reconstructed. Approximately 600 lineal feet of riprap slope protection will be installed in three separate areas and 570 feet of gravel bar will be shaved down in two separate areas. The project will also consist of the construction of 14 multi-log vane deflectors and three root wad deflectors.

 The total estimated stream impacts for the project are approximately 39,300 ft2 of permanent impacts. The proposed restorations will not permanently impact wetlands, cultural or archaeological resources, national/state/local parks, forests recreational areas, landmarks wildlife refuge or historical sites. Pleasant Stream is classified with a designated use of High Quality—Cold Water Fishery (HQ-CWF) and with an existing use of Exceptional Value (EV).

E60-218. Union County Commissioners, 155 North 15th Street, Lewisburg, PA 17837. T-309 over Penns Creek, in Hartley Township, Union County, ACOE Baltimore District (Beavertown, PA Quadrangle N: 40°52` 15"; W: -77°11`01").

 To: 1) remove an existing single span riveted through truss bridge with stone masonry abutments / wingwalls with a clear span of 159.4 feet with an underclearance of 15.6 feet, 2) construct and maintain a three span continuous composite pre-stressed concrete bulb-tee beam bridge with reinforced concrete abutments, wingwalls and two piers with a total clear span of 202.5 feet and an underclearance of 13.57 feet at mid-span over Penns Creek, 3) fill 354 square feet of wetlands to construct the new southern pier, 4) construct and maintain a temporary R-7 riprap and culvert pipe causeway in the right half of the stream channel, all of which is located 0.25 mile south on SR 3004 from SR 3001. This permit also includes 401 Water Quality Certification.

 Has been given consent to remove the existing 32.7` long, 15` wide, single span TR 746 bridge with a 76 degree skew and an 8.5` underclearance; construct and maintain a new 56` long, 32` wide single span bridge with a 78 degree skew and minimum 9.3` underclearance over Cowanshannock Creek (WWF) with a drainage area of 16.3 square miles; construct and maintain associated approach road changes; and place and maintain fill in a de minimis 0.002 acre of PEM wetlands. The project is located near the intersection of SR 85 (Rural Valley Pa Quadrangle; N: 7.75 inches; W: 4.5 inches; Latitude 40° 47` 45"; Longitude -79° 16` 58") in Cowanshannock Township, Armstrong County.

 Has been given consent to demolish portions of the high school and to construct and maintain a 124,812—square foot three-story middle/high school building and associated fill with portions of it within the floodplain of the South Fork of the Little Conemaugh River (CWF). The school is located on Locust Street, (Geistown, PA Quadrangle N: 14.56 inches; W: 0.69 inch Latitude: 40° 19` 48"; Longitude: -78° 45` 17") in Adams Township, Cambria County.

 Has been given consent to construct and maintain a box culvert having a span of 15.5 ft. an underclearance of 7 ft. and a total length of 91 ft. with a drainage area of 6.4 square miles replacing the existing 15.2 ft. span, 6.5 ft. underclearance, 36 ft. long bridge on SR 56; temporary encroachments, including a temporary pedestrian access and bridge; and road construction associated stormwater outfalls in Saint Clair Run (CWF).  Has been given consent to construct and maintain a bridge over Valley Brook Road and Brush Run (WWF), having a span of 160`, with a minimum underclearance of 15`6" over Valley Brook Road and approximately 28` over Brush Run, and to construct and maintain various stormwater outfalls to Brush Run, for the purpose of completing a connection between two segments of the Montour Trail, which is a bike/pedestrian trail.
