Referendum on Continuation of the Pennsylvania Wine Marketing and Research Program

 Under the applicable provisions of 3 Pa.C.S. Chapter 45 (relating to Agricultural Commodities Marketing Act), an amendment referendum was held from March 17, 2014, to March 31, 2014, to determine if the producers affected by the Pennsylvania Wine Marketing and Research Program (program) assented to amend the program as described in the Referendum Order published at 44 Pa.B. 1453 (March 15, 2014). A Teller Committee met on April 10, 2014, to count the ballots. The results were as follows: a total of 74 eligible votes were cast with 44 producers voting in favor of and 30 producers voting against the amendment. An additional three ballots were invalid because they were incomplete. Two ballots were ineligible because they were received late. Additionally, eligible producers voting in favor of the program amendment represented 59% of the votes and 72% of production gallons. Producers voting against the proposed amendment represented 41% of the votes and 28% of production gallons. In accordance with the foregoing, the program order is amended as proposed in the Referendum Order published at 44 Pa.B. 1453 and shall become effective 21 days from publication of the notice of issuance in accordance with 3 Pa.C.S. § 4509 (relating to notice of issuance), except Article IX.2 which shall become effective January 1, 2015.
