Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). To revise the permit for the Bailey Mine & Prep Plant in Richhill Township, Greene County to add underground permit and subsidence control plan area acres for longwall mining, stream restoration may be necessary to alleviate subsidence pooling impacts to stream segments in four areas of Kent Run, four areas of North Fork Dunkard Fork, and one area of Whitehorn Run. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. The proposed will permanently impact 0.06 acre of PEM wetland and temporarily impact an additional 0.07 acre of PEM wetland. At an offsite location, 0.06 acre of wetland mitigation will be provided; 2) Remove the existing structures and install and maintain: a) a 36 inch diameter, 150 foot long, Reinforced Concrete Pipe, b) a 36 inch diameter, 196 foot long, Reinforced Concrete Pipe, and c) a 48 inch diameter, 46 foot long, Reinforced Concrete Pipe, in an unnamed tributary to the Letort Spring Run (CWF) located at mile post 226.7. No wetlands will be affected by this activity. (Latitude 40°13`42.39", Longitude -77°08`59.92"); 3) Relocate 930 lineal feet of an unnamed tributary to the Letort Spring Run (HQ-CWF). The open channel flow of the unnamed tributary will increase from 275 feet to approximately 530 feet and will have an overall 150 foot decrease of stream enclosure. No wetlands will be affected by this activity. (Latitude 40°13`42.39", Longitude -77°08`59.92"), and 4) Permanently impact 0.01 acre of PEM wetland located at mile post 225.3. At an offsite location, 0.1 acre of wetland mitigation will be provided. (Latitude 40°13`26.67", Longitude -77°10`27.42"). The permit was issued effective April 30, 2014.

E06-693: County of Berks, Berks County Service Center, 633 Court Street, 16th Floor, Reading, PA 19601 in the City of Reading and West Reading Borough, Berks County, U.S. Army Corps of Engineers, Philadelphia District

 To 1) repair, replace, and maintain the arch deck/floor beam system and the reinforced concrete superstructure and substructure of the Buttonwood Street Bridge over and across the Schuylkill River (WWF, MF), 2) install and maintain R6 scour protection along the Buttonwood Street Bridge Piers over and across the Schuylkill River (WWF, MF) permanently impacting 60 linear feet and 0.06 acre, and 3) construct a 103-feet long temporary rock causeway with twelve (12) 8-feet diameter CMP pipes, all for the purpose of improving transportation safety and roadway standards and maintain the bridge's ability to service traffic and pedestrians. The project is located along Buttonwood Street (Reading, PA Quadrangle, (Latitude: 40°20`20"N, Longitude: 75°56`32"W) in the City of Reading and West Reading Borough, Berks County. No wetlands are proposed to be impacted. The permit was issued effective May 1, 2014.

E21-437: North Middleton Township, 2051 Spring Road, Carlisle, PA 17013 in North Middleton Township, Cumberland County, U.S. Army Corps of Engineers, Baltimore District giving its consent to 1) Remove the existing structure and install and maintain a 54.0 foot long, 24.0 foot wide bottomless concrete arch culvert over Alexander Spring Creek (CWF) (Latitude 40° 12` 31.8"; Longitude -77° 14` 47.35") located along Meadowbrook Road (T-706) for the purpose of increased roadway safety. The proposed culvert will permanently impact 0.03 acre of PEM wetland and temporarily impact an additional 0.01 acre of PEM wetland. At an offsite location, 0.03 acre of wetland mitigation will be provided and 2) Remove the existing structures and install and maintain a 41.1 foot long, 14.0 foot wide bottomless concrete arch culvert over Alexander Spring Creek (CWF) located along Dyarman Road (Latitude: 40° 12` 33.4"; Longitude: -77° 14` 42.4" ) for the purpose of increased roadway safety. No wetlands will be affected by this activity. The permit was issued effective May 1, 2014.

E12-187. Cameron County Conservation District, 20 East Fifth Street-Room 105, Emporium, PA 15834-1469. Dubler Outdoor Classroom Driftwood Branch— Sinnemahoning Creek Floodfringe and Wheaton Hollow Floodway Development, Shippen Township, Cameron County. USACOE Baltimore District (Rich Valley, PA Quadrangle Latitude: 41° 30` 53.3"; Longitude: -78° 15` 5.7").

 This authorization gives consent to construct, operate and maintain a 20-foot by 30-foot, open-sided pavilion within the 100-year flood fringe of Driftwood Branch, Sinnemhanoning Creek and the floodway of Wheaton Hollow. The pavilion is to serve as an outdoor classroom immediately adjacent to the Gary Dubler Memorial Natural Trail. Construction, operation and maintenance of the pavilion shall be performed at existing elevations with no placement of fill. The project is located along the western right-of-way of SR 0046 (West Allegany Avenue) approximately 1485-feet north of Woodland Avenue and West Allegany Avenue intersection in Shippen Township, Cameron County. This permit was issued under Section 105.13(e) ''Small Projects.''

E60-215. Silvermoon Development, 145 Dustin Avenue, West Milton, PA 17886-8042. Silvermoon Fairfield Project, in Kelly Township, Union County, ACOE Baltimore District (Northumberland, PA Quadrangle N: 40° 59`40.60"; W: -76°52`25.69").

 To 1) fill 0.17 acre of wetland in the Silvermoon Development located in the southwest corner of the Zeigler Road and SR 15 intersection, 2) construct and maintain replacement wetlands near West Milton north of the intersection of SR 1004 and Sandra Lee Boulevard (40° 1` 30.17" N, -76° 52` 33.72" W), in order to create a suitable building site for a car dealership. This project proposes to permanently impact 0.17 acre of PEM wetlands in the drainage area of the West Branch Susquehanna River, which is classified as a warm water fishery. This permit also includes 401 Water Quality Certification.

Northwest Region: Oil and Gas Management Program Manager, 230 Chestnut Street, Meadville, PA 16335

E42-08-004, Seneca Resources Corporation, 5800 Corporate Drive, Suite 300, Pittsburgh, PA 15237. West Branch Clarion River Surface Water Withdrawal and Waterline, off US Highway 219 in Sergeant and Wetmore Townships, McKean County, United States Army Corps of Engineers Pittsburgh District (Mt. Jewett, PA Quadrangle 41° 37` 35" N, 78° 40` 43" W).

 Seneca Resources Corporation is proposing to construct and maintain a surface water withdrawal intake along the east bank of the West Branch Clarion River and a 2.76-mile waterline. Water will be conveyed from the surface water withdrawal to a pump station, which will then transport freshwater in a buried 10-inch waterline to a freshwater impoundment for use in natural gas well drilling operations.

 The proposed waterline crossing of the West Branch Clarion River will be bored. The remaining pipeline stream crossings will be open trenched under unnamed tributaries to West Branch Clarion River, or trenched underneath existing culverts within an existing access road. One culvert replacement and one new culvert installation across an existing access road are proposed. Proposed stream impacts are limited to 104 feet of permanent impact, with 244 feet of temporary impact.

 Approximately 0.28 acre of temporary wetland impacts are proposed associated with the temporary staging of materials or crossing of equipment. No permanent wetland impacts are proposed.

 The water obstructions and encroachments for the purpose of installing the surface water withdrawal intake and waterline are described below:

 (1) Construction of a surface water withdrawal intake and waterline buried under the streambed of West Branch Clarion River (CWF). Impacted length: 40 feet: (41.626503 N, -78.678739 W).

 (2) A 10-inch waterline to be bored underneath 43 feet of West Branch Clarion River (CWF). Impacted length: 43 feet (bore with inadvertent return contingency plan): (41.626646 N, -78.678648 W).

 (3) Temporary dam and pump bypass for installation of surface water withdrawal in West Branch Clarion River (CWF). Impacted length: 139 feet: (41.626646 N, -78.678648 W).

 (4) Temporary surface wetland impacts within an exceptional value (EV), palustrine forested (PFO) wetland associated with temporary dam and pump bypass. Impacted area: 0.008 AC; (41.626871 N, -78.680509 W).

 (5) Temporary surface wetland impacts from staging of materials and temporary equipment crossing within an exceptional value (EV), palustrine forested (PFO) wetland associated with construction of 10" waterline within adjacent access road. No tree removal is proposed. Impacted area: 0.101 AC; (41.626871 N, -78.680509 W).

 The project consists of constructing approximately 5,748 lineal feet (1.1 miles) of 10" natural gas gathering line, within a maintained 45 to 75 foot permanent right of way located in Bridgewater Township, Susquehanna County. The project will result in 244 lineal feet of temporary stream impacts, 0.72 acre of temporary wetland impacts, and 0.05 acre of permanent wetland conversion impacts, all for the purpose of conveying Marcellus Shale natural gas to market.
