Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). The final action on each application also constitutes action on the NPDES permit application and, if noted, the request for a Section 401 Water Quality Certification. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. Rice Poseidon Midstream, LLC will install the Jaybird Pipeline that will begin at the Back Nine Pond/Swagler Loop (40° 6` 39.1", -80° 3` 5.98") and will terminate at the Zorro to EQT pipeline (40° 5` 42.87", -80° 2` 25.73"). The project is located within the Ellsworth USGS 7 1/2 Minute Quadrangle Map, in Somerset Township, Washington County, and in Subbasin 19C (Middle Monongahela River Watershed). The project will include installation of a 1.37-mi long 24-inch diameter steel natural gas pipeline and an 18-inch diameter HDPE waterline. The project is a Joint Permit Application due to the crossing of a wetland which is greater than 10 acres on National Wetland Inventory maps. This wetland was field verified to be 7.925 acres in size. The project will result in one (1) wetland crossing and one (1) watercourse crossing, resulting in a total of 917 ft2 of permanent wetland impact and 20 linear feet of permanent stream impact.

SPECIAL NOTICE

Water Quality Certification under Section 401 of the Federal Clean Water Act for the York Haven Power Company, LLC—York Haven Hydroelectric Project

 On August 19, 2014 the Commonwealth of Pennsylvania (Commonwealth) Department of Environmental Protection (Department, DEP or PADEP), issued Section 401 Water Quality Certification to York Haven Power Company, LLC (YHPC) for the York Haven Hydroelectric Project (YHHP). The DEP, by this notice, certifies that the construction, operation and maintenance of the YHHP complies with the applicable provisions of sections 301—303, 306, 307 and 316 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316, 1317, and 1326) and with appropriate requirements of state law. The Department further certifies that the operation and maintenance of the YHHP complies with applicable Commonwealth water quality standards and that the operation and maintenance of the YHHP does not violate applicable Commonwealth water quality standards provided that the operation and maintenance of the YHHP complies with the conditions proposed for this certification, including the criteria and conditions set forth below:

Compensatory Mitigation

 1. YHPC will mitigate the impact to aquatic species by constructing a nature-like fishway (''NLF'') at the eastern end of the main dam apex, connecting to the south-western tip of Three Mile Island, in Londonderry Township, Dauphin County. The NLF will facilitate movement of resident and migratory aquatic species over the dam and re-establish upstream/downstream river connectivity by creating a series of steps that will distribute the change in water surface and riverbed elevations caused by the dam over approximately 450 feet of the Susquehanna River. Subsequent to construction of the NLF, YHPC will monitor the performance of the NLF. Maintenance of the NLF to its approved design configuration shall be conducted for the duration of the operation of YHHP as an electric generation facility.

 2. YHPC will provide a minimum of twenty-five thousand dollars ($25,000.00) per year for the continuation of their debris management program for debris removal projects within the Lower Susquehanna River watershed. This program will continue for the duration of this certification.

 3. YHPC will also achieve certain fish passage targets for migratory fish and eels passing through the project area, and will take corrective action if the fish passage targets are not achieved.

 4. YHPC will achieve minimum stream flow criteria to convey flows past the project.

 5. The water quality certification will be revised in 2030, as appropriate, to address demonstrated project impacts and subject to the provisions of this certification, to establish requirements consistent with Section 401 of the Clean Water Act, 33 U.S.C Section 1341.

 Any person aggrieved by this action may appeal, pursuant to Section 4 of the Environmental Hearing Board Act, 35 P. S. Section 7514, and the Administrative Agency Law, 2 Pa.C.S. Chapter 5A, to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, 717.787.3483. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in braille or on audiotape from the Secretary to the Board at 717.787.3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.
