FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period.  The site is located within Church Road and Abrogio Road and along two private properties, (West Grove, PA USGS map; Latitude 39.8388; Longitude -75.7799).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341(a)].

E23-506. Township of Haverford, 2325 Darby Road, Havertown, PA 19083, Haverford Township, Delaware County, ACOE Philadelphia, District.

 To remove existing impervious paving along a portion of Darby Creek (TSF, MF), and restore the riparian buffer as part of a Growing Greener Grant. The project includes the construction of a water quality enhancement (rain garden) and the restoration of a modest portion of the existing impervious area. No change in the base flood elevation and no impacts to the floodway or floodplain are proposed.

 The site is located at 50 Hilltop Road, Havertown PA 19083. (Lansdowne, PA USGS map, Lat. 39.97399, Long. 75.33757).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341(a)].

E05-376: PA Department of Transportation, Engineering District 9-0, 1620 North Juniata Street, Hollidaysburg, PA 16648, Harrison Township, Bedford County, U.S. Army Corps of Engineers, Baltimore District

 To 1) remove the existing structure and to construct and maintain a single-span composite pre-stressed concrete bulb-tee beam bridge skewed 45°, having a total clear span of 102.1`, a width of 33.38`, and an underclearance of 5.8`, across Buffalo Run (WWF, MF); 2) restore/realign 348` of Buffalo Run, permanently impacting 0.16 acre of PEM wetlands; 3) construct and maintain three rock cross vanes in and across Buffalo Run; 4) mitigate 0.16 acre of wetlands on-site; 5) construct a temporary road crossing for public use upstream of the existing bridge using four pipes 5' in diameter across Buffalo Run; 6) place and maintain 794 cubic yards of fill material in the floodplain of Buffalo Run, all for the purpose of improving transportation safety and roadway standards. The project will involve three temporary stages of construction using temporary stream diversion, a causeway, and shoring for the construction and demolition of the bridge and rock cross vanes. The project is located along SR 0096 in Harrison Township, Bedford County (Latitude: 39° 58` 23", Longitude: -78° 37` 29"). The permit was issued on August 15, 2014.

E36-928: Millport Conservancy, 737 East Millport Road, Lititz, PA 17543-9246 in Warwick Township, Lancaster County, U.S. Army Corps of Engineers, Baltimore District

 To install and maintain a 36.0-foot long, 5.0-foot wide wooden pedestrian bridge with concrete abutments and access steps over Lititz Run (CWF, MF), for the purpose of removing pedestrian traffic from the existing one-lane road bridge crossing of Lititz Run. The project is located immediately east of the intersection of Karen Ct. and E. Millport Road (Latitude 40°08`02", Longitude -76°15`29") in Warwick Township, Lancaster County. No wetlands will be impacted by the project.

F67-914: Paradise Township, 82 Beaver Creek Rd. in Paradise Township, York County, ACOE Baltimore.

 To remove structures from the floodplain at the locations listed. The projects propose to temporarily affect approximately .26 acre of floodplains. The issuance of this permit will not constitute approval of Water Quality Certification under Section 401 of the Federal Clean Water Act (33 U.S.C.A. § 1341).
