FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 To perform the following water obstruction and encroachment activities associated the proposed replacement of Montgomery County Bridge No. 135 which carries Arcola Road over Perkiomen Creek (WWF, MF):

 1. To replace and maintain a three-span Composite Prestressed Concrete Bridge with 265 feet three span bridge with width of approximately 43 feet over the Perkiomen Creek (WWF,MF):

 2. To construct a temporary causeway to facilitate the construction of the left abutment and a pier.

 3. To construct and maintain grading associated in the floodway to accommodate roadway approach widening for a new 11 feet wide travel and left turn lane

 4. To remove an existing culvert and restore the stream for the Beedle Property driveway at Parcel No. 9 that will be relocated near the proposed bridge.

 The project site is located approximately 182 feet east of the intersection of Arcola Road and Cider Mill Roads on the Upper Providence Township side spanning over the Perkiomen Creek into Lower Providence Township, Montgomery County, (Latitude N 40° 09` 11" and Longitude W 75° 27` 21").

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341(a)].

E07-450, PA Department of Transportation Engineering District 9-0, 1620 North Juniata Street, Hollidaysburg, PA 16648-108 in Allegheny Township, Blair County, U.S. Army Corps of Engineers, Baltimore District

 To remove the existing structure and to install and maintain a single span prestressed concrete splayed box beam bridge with a normal span of 55.66 feet, underclearance of 6.38 feet and a length varying from 44.85 feet to 65.32 feet with approximately 1,000 cubic yards of fill in the floodway, all associated with Sugar Run (CWF-MF) for the purpose of improving roadway safety. Construction will include a two-phase temporary cofferdam. The project is located along S.R. 4002, in Allegheny Township, Blair County (USGS Quadrangle: Hollidaysburg, PA; Latitude: 40° 28` 4.6"; Longitude: -78° 26` 22.8").

E22-601: Hershey Entertainment & Resorts Com-pany, 300 Park Boulevard, Hershey, Pennsylvania 17033, in Derry Township, Dauphin County, ACOE Baltimore District

 To 1.) install and maintain three kiddie rides and one small games venue, 2.) demolish and remove one large games building and one storage shed, and 3.) relocate and maintain an existing games venue, in the floodway of Spring Creek (WWF) (40° 17` 12", -76° 39` 17"), as part of the proposed continuous improvement project at Hersheypark. The project is located near the intersection of Park Avenue and Park Boulevard in Derry Township, Dauphin County. No wetlands will be disturbed.

E36-921: Lancaster Liederkranz, 722 South Chiques Road, Manheim, PA, 19545 in Rapho Township, Lan-caster County, ACOE Baltimore District

 To install and maintain: 1) a 6.0-foot high, 150.0 foot long imbricated rock wall along the right bank of Chiques Creek (WWF, MF); 2) one rock vane in Chiques Creek (WWF, MF); and 3) 26 boulder clusters in Chiques Creek (WWF, MF); and to remove 1,050 cubic yards of from floodway of Chiques Creek (WWF, MF), all for the purposes of stabilizing the channel, improving in-stream aquatic habitat, and improving storm water management. The project is located immediately downstream of the South Chiques Road Bridge (Latitude 40°6`31", Longitude -76°26`44") in Rapho Township, Lancaster County. No wetlands will be impacted by this project.

E41-647. Pennsylvania Department of Transportation, Engineering District 3-0, PO Box 218 Montours-ville, PA 17754-0218. S.R. 0042 Section 066, SR 0118 Intersection Improvement, Jordan Township, Lycoming County, ACOE Baltimore District (Lairds-ville, PA Quadrangle N: 41° 14` 57"; W: -76° 31` 15").

 PA DOT Engineering District 3-0 proposes to improve the intersection of SR 0042 and SR 0118. The project will include the relocation of the intersection and structure replacement. The existing structure is a single span concrete T-Beam Bridge with a Normal Span of 27 ft., Skew of 45°, Roadway width of 30 ft., Underclearance of 6.6 ft., Low Chord of 1013.88 ft. and Hydraulic Opening of 160 ft2. The proposed structure is a single span precast concrete rigid frame with a Normal Span of 30 ft., Skew of 70°, Roadway width of 57 ft., Underclearance of 7.17 ft., Low Chord of 1015.77 ft. and Hydraulic Opening of 199 ft2. The proposed structure will be located approximately 325 ft. upstream of the existing structure. The existing structure will be used as a detour route during construction and removed after the proposed intersection is finished. The stream bank will be stabilized with approximately 70 Ft. of R-8 Rip-Rap and planted with live stakes in the area of existing bridge removal. The project will permanently impact 0.03 acre of jurisdictional wetlands and does not require mitigation. The project is located over Little Muncy Creek. Little Muncy Creek is classified as an Exceptional Value Stream by Title 25, Chapter 93 Water Quality Standards. The project will require mitigation. This permit also includes 401 Water Quality Certification.

E04-344. Chippewa Township Sanitary Authority, 2811 Darlington Road, Beaver Falls, PA 15010; Chippewa Township, Beaver County; ACOE Pittsburgh District.

 Has been given consent to remove an existing gabion basket wall and construct and maintain a 1650 LF long gabion basket wall in three locations and 60 LF of riprap protection at three locations along the left descending bank of Brady Run (TSF) and to excavate and remove streambed material from 450` along the opposite bank of Brady Run, for the purpose of stabilizing the stream bank and protecting portions of an existing 18" RCP sanitary sewer and associated manholes. The project is located at 701 Constitution Blvd., Chippewa Township, PA 15010 (Beaver, PA Quadrangle: N: 22.5 inches; W: 12.5 inches; Latitude: 40° 44` 56"; Longitude: 80° 20` 25") in Chippewa Township, Beaver County.

E56-372. Pennsylvania Department of Transportation District 9-0, 1620 North Juniata Street, Hollidaysburg, PA 16648, Paint Township and Conemaugh Township, Somerset County; ACOE Pittsburgh District.

 Has been given consent to remove the existing SR 4022, two lane, 20 ft width, two span bridge having a total span length of 128 ft, and having a minimum underclearance of 11.8 ft; and to construct and maintain adjacent to and downstream of the existing bridge a two span, two lane, 29 ft width replacement bridge and having a total span length of 193 ft, and having a minimum underclearance of 7.9 ft over the Stony Creek River (WWF) with a drainage area of 349.8 square miles. In addition the project includes temporary encroachments for construction and demolition, and encroachments associated with modification or replacement of stormwater facilities from the road alignment adjustment and new bridge. The Penndot improvement and relocation project extends between Paint and Conemaugh Townships and is approximately 3.5 miles southeast of Johnstown Pa (Hooversville Quadrangle: N: 9.5"; W: 1.25`; Latitude 40° 13` 35" and Longitude -78° 53` 12") in Paint and Cone-maugh Townships, Somerset County.

 The project consists of constructing approximately 6.6 miles of 12" waterline and 12" natural gas gathering line from the Malling, Thomas Conaty, Wilkes, McNamara, and Wheeler well pads to the Line 419 gathering pipeline in Liberty and Choconut Townships, Susquehanna County. The project will result in 303 lineal feet of temporary stream impacts, 158 lineal feet of permanent stream impacts, and 0.09 acre of wetland impact, all for the purpose of conveying Marcellus Shale natural gas to market.

E5729-065: Appalachia Midstream Services, LLC, 100 IST Center, Horseheads, NY 14845, Forks Township, Sullivan County, ACOE Baltimore District.

 To construct, operate, and maintain:

 1) A temporary access road using a timber mats and a 6 inch diameter well line impacting 6,412 square feet of an exceptional value palustrine emergent (EV-PEM) wetland (Overton, PA Quadrangle 41°33`17"N, 76°31`36"W); 2) A temporary access road using a timber mat bridge and a 6 inch diameter well line impacting 191 linear feet of an unnamed tributary to Streby Run (EV) and 842 square feet of an exceptional value palustrine emergent (EV-PEM) wetland (Overton, PA Quadrangle 41°33`17"N, 76°31`37"W).

 The project will result in 191 linear feet of temporary stream impacts, and 7,254 square feet (0.17 acre) of temporary wetland impacts all for the purpose of installing a gathering line for Marcellus well development in Forks Township, Sullivan County. The permittee will provide 0.08 acre of compensatory mitigation at the Wilmot Mitigation Site (Colley, PA Quadrangle 41°36` 44"N 76°17`27"W) in Wilmot Township, Bradford County.

E0829-071: PVR NEPA Gas Gathering, LLC, 101 West Third Street, Williamsport, PA 17701, Franklin, Monroe, Burlington and Towanda Township, Bradford County, ACOE Baltimore District.

 To construct, operate and maintain:

 1. a temporary timber mat bridge impacting 30 linear feet of an unnamed tributary to French Run (CWF, MF) (Powell, PA Quadrangle, Latitude: 41°42`58", Longitude: -76°31`36");

 2. a temporary timber mat bridge impacting 52 linear feet of an unnamed tributary to French Run (CWF, MF) (Powell, PA Quadrangle, Latitude: 41°42`57", Longitude: -76°31`42");

 3. a 12 inch diameter natural gas line and a temporary timber mat bridge impacting 24 square feet of a Palustrine Forested Wetland (Powell, PA Quadrangle, Latitude: 41°43`07", Longitude: -76°31`43");

 Lawrence Township, in association with the Clearfield County Conservation District and the Montgomery Run Watershed Association, is proposing to construct a passive treatment system that will abate an abandoned mine drainage discharge (Mon 30) in the headwaters of an unnamed tributary to Montgomery Creek. The system will capture the seepage in an equalization basin, then pass through a vertical flow wetland, settling basin and polishing wetland. It is designed to remove up to 40 lbs./ day of acidity, 3 lbs. /day of aluminum and 3 lbs. /day of iron.

Notice of Planning Grant Awards Under Section 901 of the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101

 The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).

 Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
