FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. E26-370, Pennsylvania Department of Transportation—District 12-0, 825 North Gallatin Avenue, Uniontown, PA 15401, Wharton Township, Fayette County, ACOE Pittsburgh District.

 Has been given consent to replace 78` of the existing SR 381 36" corrugated metal pipe enclosure with an existing total length of 293`, and construct and maintain an additional 55` of 36" reinforced concrete pipe for a final total enclosure length of 348`, carrying an unnamed tributary to Deadman Run (HQ-CWF) with a drainage area less than 100 acres. In addition, place and maintain fill in a de minimis 0.014 acre of PEM wetland, construct and maintain associated replacement stormwater controls, and temporarily impact 314` of stream for the purpose of constructing the encroachments. Stream mitigation will occur off-site on SR 381 on Linn Run (HQ-CWF; Ligonier Quadrangle, North 12.75 inches, West 15.8 inches, Latitude 40°11`45", Longitude -79°14`26") and Laughlintown Run (HQ-CWF; Ligonier Quadrangle, North 17 inches, West 13 inches, Latitude 40°13`18", Longitude -79°13`8") in Ligonier Township, Westmoreland County. The encroachments are associated with the US40/SR 381 Intersection Improvement Project located in Wharton Township, Fayette County (Fort Necessity Quadrangle, North 10.25 inches, West 9.25 inches, Latitude 39° 48` 20.78", Longitude -79° 33` 57.65").

E30-246, PennDOT District 12-0, 825 North Gallatin Avenue, Uniontown, PA 15401, Cumberland Township, Greene County, ACOE Pittsburgh District.

 Has been given consent to:

 1. Remove the existing SR 21, 136 ft long, 18 inch plastic/24 inch RC pipe enclosure; construct and maintain a relocated replacement 250 ft long 45 inch elliptical culvert on an unnamed tributary to Muddy Creek (WWF) with a drainage area of less than 100 acres. As part of the culvert replacement, place and maintain fill in 37 ft of the unnamed tributary to Muddy Creek;

 2. Extend by 36 ft and maintain an existing SR 21, 136 ft long, 42 inch RC pipe enclosure with a final length of 172 ft on a second unnamed tributary to Muddy Creek (WWF) with a drainage area of less than 100 acres;

 3. Place and maintain fill in 250 feet of the second unnamed tributary to Muddy Creek; construct and maintain 248 feet of mitigation channel;

 4. Remove and replace 30 feet of an 18 inch pipe carrying a third unnamed tributary to Muddy Creek (WWF) with a drainage area of less than 100 acres;

 5. In addition install and maintain road associated stormwater outfalls; place and maintain fill in a de minimis 0.013 acre of PEM wetland; and temporarily impact 636 ft of stream and 0.027 acre of PEM/PSS wetland for construction of the encroachments. Stream mitigation will take place onsite.

 These encroachments are associated with the SR 21 and SR 1019 intersection improvement project, located approximately 1.5 mile southwest of Carmichaels, PA in Cumberland Township, Fayette County (Carmichaels quadrangle, North 1.0 inches and West 16.75 inches, Latitude 39° 52` 49" and Longitude -79° 59` 37").

E56-373. CSX Transportation, Inc., 500 Water Street St, J-275, Jacksonville, FL 32202-4423, Jefferson Township, Somerset County, ACOE Pittsburgh District.

 Has been given consent to operate and maintain approximately 1,565 lf of an unnamed tributary to Laurel Hill Creek (HQ-CWF) that was relocated and reconstructed under an Emergency Permit (DEP File No. EP5613201), to prevent water within this watercourse from infiltrating into a railroad tunnel, referred to as the Brook Tunnel. The project site is located along SR 281, near the intersection of Kingwood Road and Colfelsh Road, in Lower Turkeyfoot Township, Somerset County (USGS Confluence, PA Quadrangle, N: 13.92 inches; W: 7.05 inches; Lat: 39°49`0.9"; Long: -79°18`0.9").

 Also to stabilize approximately 500 lf of stream bank along Laurel Hill Creek (HQ-CWF), and 140 lf of stream bank along an unnamed tributary to Laurel Creek (HQ-CWF) to compensate for the approximately 420 lf of the relocated channel that was reconstructed with a concrete lining and 135 lf of the channel that was extensively riprapped. The streams to be stabilized are in Jefferson Township, Somerset County (USGS Bakersville, PA Quadrangle N: 3.11 inches; W: 15.65 inches; Latitude: 40°1`1.6"; Longitude: -79°4`12.5").

District Oil and Gas Operations: Eastern Oil & Gas District, 208 West Third Street, Suite 101, Williamsport, PA

 1. A 12 inch diameter temporary waterline and a 16 inch diameter temporary waterline impacting 2 linear feet of an unnamed tributary to Elk Creek (EV) (Shunk, PA Quadrangle 41°35`15"N, 76°39`56"W).

 The project will result in approximately 2 linear feet of temporary stream impacts for the purpose of installing temporary waterlines for Marcellus Shale gas development in Overton Township, Bradford County.

 3. A 12 inch diameter temporary waterline and a 16 inch diameter temporary waterline impacting 6 linear feet of an unnamed tributary to Elk Creek (EV) (Shunk, PA Quadrangle 41°34`05"N, 76°40`50"W);
