FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

WATER OBSTRUCTIONS AND ENCROACHMENTS

E46-1113. Pennsylvania Department of Transport, District 6, 7000 Geerdes Blvd, King of Prussia, PA 19406, Lower Providence, West Norriton, and Upper Merion Townships, Montgomery County; Tredyffrin Township, Chester County, ACOE Philadelphia District.

 To perform the below listed water obstruction and encroachment activities associated with the replacement of the existing US 422 bridges while providing new structures for US 422 project. The US 422 corridor improvements include approximately 1.0 mile of reconstruction and widening of approach roadway work providing for 3 lanes (plus ramp auxiliary lanes) in each direction. Specific Water Obstruction and Encroachments are:

 1. To replace the existing US 422 Bridge over the Schuylkill River (WWF, MF) and construct and maintain in its place a five span prestressed concrete bulb tee bridge approximately 785 feet total span and approximately 157 wide with average underclearance of 45.5 feet.

 2. To construct and maintain scour protection of approximately 4,598 cubic yards rip-rap to facilitate the protection of the proposed bridge abutment.

 3. To temporarily place approximately 33,432 cubic yards of fill in the stream to provide for causeway erection to facilitate the construction of the bridge substructures.

 The project is located at the boarder of Upper Merion and West Norriton Townships in Montgomery County along the Pottstown Expressway (US 422) (USGS Valley Forge Quadrangle Meridian at the center of the proposed bridge -Latitude 40° 06` 27.56"; Longitude 75° 25` 12.34").

EA15-011./WL1515303. Red Clay Valley Association, 1760 Unionville-Wawaset Road, West Chester, PA 19382, East Marlborough Township, Chester County, ACOE Philadelphia District.

 To perform the following water obstruction and encroachment activities along approximately 1,200 linear feet of an unnamed tributary to the East Branch Red Clay Creek (Perennial, TSF, MF):

 1. Installation of in-stream stabilization structures including toe rock protection, toe willow fascines, root wads, rock cross vanes and rock j-hooks.

 2. Installation of native riparian plantings for stabilization and enhancement efforts outside of the channel.

 3. Installation of half-logs as fish habitat enhancement structures.

 4. Temporary impacts to wetlands associated with the installation of various streambank stabilization techniques and grade control structures, including stream-bank grading and installation of rock and root wad structures.

 The southern limit of the site is located at the intersection of North Walnut Road and Longwood Road (Kennett Square, PA USGS Quadrangles, Latitude 39.868889N"; Longitude -75.7025W").

E51-266. Philadelphia Water Department, Office of Watersheds, 1101 Market St., 4th Floor, Philadelphia, PA 19107, Philadelphia County, ACOE Philadelphia District.

 To perform the following water obstruction and encroachment activities within the floodway and floodplain of the Schuylkill River (WWF, MF) associated with the upgrading of the Children's Hospital of Philadelphia (CHOP).

 1. To remove the existing 42-inch RCP combined sewer overflow pipe and replacing with a 54-inch pipe. Total length is about 590 feet; which includes about 144 feet under the CSX railroad. Most of the pipe is in the floodplain.

 2. To rehabilitate and maintain two manholes and RC tide gate chamber in the floodplain.

 3. To rehabilitate and maintain the outfall structure in the floodway for the replaced 54-inch pipe line.

 The site is located along former Bainbridge Street between Schuylkill Avenue and the Schuylkill River (Philadelphia- PA USGS Quadrangle Latitude 39.945402; Longitude -75.186760).

E46-1112. Lower Gwynedd Township, P. O. Box 625, Spring House, PA 19477, Lower Gwynedd Township, Montgomery County, ACOE Philadelphia District.

 To construct and maintain the Lower Gwynedd Pedestrian Trail and these specific water obstruction and encroachment activities associated with this project as follows:

 1) To construct and maintain approximately 8-foot wide by 80-foot long span pedestrian bridge across the Wissahickon Creek (TSF, MF) to facilitate the extension of the trail across the Creek.

 2) To install and maintain a 24-inch diameter HDPE cross pipe approximately 17 feet long within the floodway of the stream to connect the wetland hydraulic flow from one side of the trail to the flow's original discharge point into the stream.

 3) To construct and maintain minor grading and excavation work which will impact approximately 0.05-acre of the floodway on both sides of the proposed bridge to accommodate the project design by connecting the trail to the bridge.

 The project is located along Township Line Road approximately 1,279 feet northwest of the intersection of Township Line Road and Gwynedd Avenue in Gwynedd Township, Montgomery County (Lansdale and Ambler, PA Quadrangle Latitude: 40` 10" 22.5"; Longitude -75` 15" 25.4").

E06-698: City of Reading Fritz Island Wastewater Treatment Plant Facilities Upgrade Project, City of Reading, 815 Washington Street, Reading, PA 19601 in the City of Reading, Berks County, U.S. Army Corps of Engineers Philadelphia District.

 To construct and maintain three activated sludge tanks, two anaerobic digestion tanks, a new sludge dewatering building, reactors, retrofits to existing treatment facilities, asphalt paved roadways, and associated stormwater management facilities. The project is located at 899 Morgantown Road approximately 0.9 mile north of the intersection with Route 724 (Reading, PA Quadrangle; Latitude: 40° 18`15", Longitude: -75° 55`20") in the City of Reading, Berks County. The purpose of the project is to upgrade the existing wastewater treatment plant.

 ACOE: Pittsburgh

 The applicant is proposing to do the following:

 1. Remove the existing SR 21, 136 ft long, 18 inch plastic/24 inch RC pipe enclosure; construct and maintain a relocated replacement 250 ft long 45 inch elliptical culvert on an unnamed tributary to Muddy Creek (WWF) with a drainage area of less than 100 acres. As part of the culvert replacement, place and maintain fill in 37 ft of the unnamed tributary to Muddy Creek;

 2. Extend by 36 ft and maintain an existing SR 21, 136 ft long, 42 inch RC pipe enclosure with a final length of 172 ft on a second unnamed tributary to Muddy Creek (WWF) with a drainage area of less than 100 acres;

 3. Place and maintain fill in 250 feet of the second unnamed tributary to Muddy Creek; construct and maintain 248 feet of mitigation channel;

 4. In addition install and maintain road associated stormwater outfalls; place and maintain fill in a de minimis 0.013 acre of PEM wetland; and temporarily impact 606 ft of stream and 0.027 acre of PEM/PSS wetland for construction of the encroachments. Stream mitigation will take place onsite.

 These encroachments are associated with the SR 21 and SR 1019 intersection improvement project, located approximately 1.5 miles southwest of Carmichaels, PA in Cumberland Township, Fayette County (Carmichaels quadrangle, North 1.0 inch and West 16.75 inches, Latitude 39° 52` 49" and Longitude -79° 59` 37").

E63-662. PennDOT District 12-0, 825 North Gallatin Ave Uniontown, PA 15401; Peters Township, Union Township, Nottingham Township, Washington County; ACOE Pittsburgh District

 The applicant is proposing to do the following:

 1. Remove the existing 57` long, 15.7` wide, single span SR 1006 bridge with a 76 degree skew and a 5.83` underclearance; construct and maintain a new 87` long, 35` wide single span bridge with a 45 degree skew and a 5.98` underclearance over Peters Creek (TSF) with a drainage area of 8.2 square miles;

 2. Remove the existing 11` long, 18.5` wide single span SR 1006 bridge with a 76 degree skew and a minimum 1` underclearance; construct and maintain a new 32` wide replacement concrete box culvert having a total span length of 10 feet with an 80 degree skew and a minimum underclearance of 2.5` over an unnamed tributary to Peters Creek (TSF) with a drainage area of 0.8 square mile.

 3. In addition construct and maintain stormwater outfalls and temporarily impact 270 feet of stream for the construction of the encroachments.

 The project is located approximately one half mile east of Finleyville (Hackett Quadrangle, North 22.5 inches; West 2.5 inches; Latitude 40° 14` 58"; Longitude -80° 0` 59") in Peters Township, Union Township and Nottingham Township, Washington County.

Northwest Region: Waterways and Wetlands Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481

E20-596, David A. Wood. New Boat Dock and Lake Shore Stabilization, in Sadsbury Township, Crawford County, ACOE Pittsburgh District (Conneaut Lake, PA Quadrangle N: 41°, 36`, 11.6"; W: -80°, 17`, 53.3").

 The applicant proposes to construct and maintain a private recreational wooden boat dock measuring approximately 4 feet wide and extending approximately 120 feet from the shoreline with a boat slip at its southerly end measuring approximately 12 feet by 27 feet on Conneaut Lake (HQ-WWF) at a point approximately 335 feet east of the Conneaut Lake outlet; and to construct and maintain a steel and precast concrete seawall along the shoreline of Conneaut Lake beginning at a point approximately 335 feet east of the Conneaut Lake outlet and extending to the east approximately 115 feet; and to reconfigure and maintain an existing private recreational wooden boat dock (originally authorized by Joint Permit #E20-316) measuring approximately 4 feet wide and extending from the shoreline approximately 75 feet and having a platform at its northerly end measuring approximately 20 feet square at a point approximately 390 feet east of the Conneaut Lake outlet.

E4011-003. Pennsylvania Department of Environ-mental Protection, Bureau of Abandoned Mine Reclamation, Wilkes-Barre Office, 2 Public Square, 5th Floor, Wilkes-Barre, PA 18701. Abandoned Mine Land Reclamation Project, in Foster Township, Luzerne County, Philadelphia ACOE District.

 The applicant proposes to backfill an abandoned surface mine, which includes a total of 1,892 linear feet of dangerous highwall. The project will also fill in 5.02 acres of open water and 0.34 acre of wetland that has developed within open surface mine pits. (Hazleton and Weatherly Quadrangles 40° 58` 29.06", -75° 52` 58.01")

This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Description of Proposed Action/Activity: Construction of a 1.2 million gallon combined sewer overflow (CSO) off-line detention basin for CSO's #19 and #20 in the City of Scranton. This basin will temporarily store CSO during extreme rainfall events, allowing subsequent treatment at the Scranton Sewer Authority's wastewater Treatment Plant.
