Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984.  To perform the below-listed water obstruction and encroachment activities associated with a planned improvement project creating an Operations Staging Area (OSA—Relocated Maintenance Facility) as part of the larger U. S. Route 322 Improvement Project (State Route [S.R.] 0322, Sections 101, 102, and OSA/MIT) to address deficiencies of the existing U. S. Route 322 (U. S. 322) roadway in Concord, Bethel, and Upper Chichester Townships, Delaware County. The Section MIT includes both the OSA site and an off-corridor Wetland Mitigation Site (WMS).

 1. To construct and maintain a 48 feet by 11 feet precast concrete Arch structure stream crossing on an unnamed tributary to Webb Creek (TSF-WWF) to facilitate the realignment of Station Road North/S.R. 2035.

 2. To impact five separate wetlands areas on the OSA site totaling approximately 0.21-acre of temporary impact and 0.22-acre of permanent impact.

 3. To impact approximately 23.1 linear feet of watercourse (UNT Webb Creek) associated with the construction of a stormwater basin outfall structure and impacting approximately 318.7 linear feet of ephemeral channel.

 4. To provide for stream impact mitigation through a cooperative effort with the Pennsylvania Fish and Boat Commission.

 5. To provide for, construct, and maintain approximately 2.33 acres of Wetland for mitigation at the Patterson Tract site located along the East Branch of Chester Creek in Thornbury Township. The created wetlands will consist of 1.53 acre of palustrine emergent, 0.4 scrub shrub, and 0.4 forested habitat.

 The WMS site is located at the intersection of Tanguy Road (S.R. 4012) and Creek Road (S.R. 4011) in Thornberry Township. The OSA site is located at the intersection of State Route [S.R.] 0322 and Station Road/S.R. 2035 on the north side of S.R. 0322 in Concord Township, Delaware County (Meridian at the center of the proposed Precast Concrete Arch structure -Latitude 39°52`49.7"; Longitude 75°30`53.7").

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

 To construct and maintain a stormwater outfall in Spring Brook (HQ-CWF, MF) consisting of a 24-inch diameter HDPE pipe and flap gate. The project is located within the Moosic Flood Protection Project (C35-06) at the southern end of Salina Street (Avoca, PA Quadrangle Latitude: 41°21`2"; -75°43`47") in Moosic Borough, Lackawanna County. Subbasin: 5A.

E35-461. Roaring Brook Township, 430 Blue Shutters Road, Roaring Brook, PA 18444. Roaring Brook Township, Lackawanna County, Army Corps of Engineers Baltimore District.

 To maintain an existing single span stone arch bridge over Stafford Meadowbrook (HQ-CWF, MF) with a span of approximately 18 feet and an underclearance of approximately 8 feet. An improved superstructure was constructed overtop of the existing arch and consists of steel girders and a concrete deck on independent abutments. The project is located on Smith Road at the intersection of State Route 0307 (Moscow, PA Quadrangle Latitude: 41°22`27"; Longitude: -75°36`37"). Subbasin: 5A.

 To construct and maintain two 3-inch diameter communication conduits for a length of 270-foot long in the deck of Pond Eddy Bridge crossing the Delaware River (WWF, MF). The project is located at the intersection of Flagstone Road and Pond Eddy Bridge (Pond Eddy, PA Quadrangle Latitude: 41°26`21"; Longitude: -74°49`11"). Subbasin: 1D.

E58-300A. Constitution Pipeline Company, LLC, 2800 Post Oak Boulevard, Level 17, Houston, TX 77056. Brooklyn, Hartford, New Milford, Jackson, Oakland & Harmony Townships, Susquehanna County, Army Corps of Engineers Baltimore District.

 To amend Permit E58-300 which authorizes the construction and maintenance of various water obstructions and encroachments associated with the installation of approximately 25 miles of 30-inch diameter gas pipeline as part of the Constitution Pipeline Project. The amendment includes the addition of twenty two (22) stream crossings and sixteen (16) wetland crossings; the modification of thirty nine (39) stream crossings and thirty six (36) wetland crossings; and the deletion of four (4) stream crossings and four (4) wetland crossings. The crossings are associated with the pipeline, workspace and access roads. The permit, as amended, authorizes the permanent encroachment on 10.63 acres of wetlands and the temporary encroachment on 5.75 acres of wetlands and encroachment on approximately 6,368 feet of stream channel. The water obstructions and encroachments, as amended, are shown in the attached tables.

 Permit E58-300 originally authorized ninety three (93) wetland crossings and eighty eight (88) stream crossings associated with the pipeline, workspace and access roads. It also authorized permanent encroachment on 9.5 acres of wetlands, temporary encroachment on 5.05 acres of wetlands and encroachment on approximately 6,225 feet of stream channel. Subbasin: 4E.

The South Area beginning at South Market Street shall grade of the right bank to a slope of 1.5:1 and place R-5 riprap stabilization, along the left bank this permit authorizes grading of the bank to a 1.5:1 slope and placing R-5 riprap, removal of a failing concrete retaining wall, re-installing a new retaining wall system utilizing a Geogrid Retaining Wall system, creation of a bank full bench 2 feet above bed elevation and stabilize with R-5 riprap extending landward 3 feet then sloping the remaining banks to the existing grade and to remove a failing bridge structure in its entirety and replace it with a 7 foot by 14 foot box culvert depressed 1 foot below bed elevation with the designed baffle configuration; the North Area beginning at South Market Street shall place concrete grout bags and R-5 riprap toe protection to eliminate scour, place R-5 riprap slope protection, remove the failing concrete wall section grade the banks back to a 1.5:1 slope and re-vegetate, and to remove a failing bridge structure in its entirety and replace it with a 7 foot by 14 foot box culvert depressed 1 foot below bed elevation with the designed baffle configuration. This project impacts a total of 600 linear feet of two unnamed tributaries to Shamokin Creek, which are designated as Cold Water Fisheries and does not impact any wetlands (Shamokin, PA Quadrangle Latitude 40°51`53.4"; Longitude 76°33` 9.3") Ralpho Township, Northumberland County. This permit also includes 401 Water Quality Certification.

Notice of Planning Grant Awards under Section 901 of the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101

 The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).

 Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.

PUBLIC HEARING RESCHEDULED

Municipal Waste Management Landfill Expansion Application #100020-A151

 The Department of Environmental Protection has rescheduled the public hearing to accept comments on Municipal Waste Management Permit Application 100020-A151 for a proposed expansion of the IESI PA Bethlehem Landfill in Lower Saucon Township, Northampton County. The application is currently under review.

 The public hearing will be held on Wednesday, April 13, 2016 from 6 to 9 p.m. at the Saucon Valley High School, 2100 Polk Valley Road, Hellertown, PA 18055.

 The major permit modification application was submitted to DEP in January 2015 and requests an expansion of 29 acres. The expansion area is to be located within the current permit boundary and involves expanding over exiting fill areas and a small portion of new disposal area in the southeast corner of the site. The proposed expansion does not include a change in waste acceptance rates.

 The Department requests that individuals wishing to testify at the hearing submit a written notice of intent to Colleen Connolly, Community Relations Coordinator, IESI PA Bethlehem Landfill Public Hearing, PA DEP, 2 Public Square, Wilkes-Barre, PA 18701-1915, or by e-mail at coconnolly@pa.gov.

 The Department will accept notices up to the day of the hearing. The written notice should include the person's name, address, telephone number and a brief statement as to the nature of their presentation. The Department requests that individuals limit their testimony to 10 minutes so that all individuals have the opportunity to testify.

 Written copies of oral testimony are requested. Relinquishing of time to others will not be allowed. Individuals attending the hearing will have the opportunity to testify if they so desire; however, individuals who pre-register to testify will be given priority on the agenda. Persons unable to attend the hearing may submit written statements/comments to the Department on or before April 13, 2016.

 Notice is hereby given that the Department of Environmental Protection, Pottsville District Office, 5 West Laurel Boulevard, Pottsville, PA 17901 will conduct a public meeting on Tuesday, March 29, 2016 between 5:30 p.m. and 10:00 p.m. in the auditorium of the Boyertown Area Junior High School East, 2020 Big Road, Gilbertsville, PA 19525: concerning the renewal of an Individual National Pollution Discharge Elimination System (NPDES) Permit No. PA0224308, which will be operated in association with the Gibraltar Rock, Inc., Gibraltar Quarry, Surface Mine Permit Number 46030301. The NPDES permit renewal application outlines three (3) water discharge points. The receiving stream for the NPDES discharge points is an unnamed tributary to Swamp Creek, which is classified as Trout Stocking (TSF), Migratory Fishes (MF) in 25 Pa. Code Chapter 93. Scioto Creek (TSF, MF) will receive only perimeter berm runoff from the extreme northeast corner of the proposed permit area. At the meeting the Department will be taking testimony from the public regarding the proposed renewal of NPDES Permit Application No. PA 0224308. After the testimony the Department will hold an informal conference to answer questions from the public related to the above-referenced application.
