LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environ-mental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department regional office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. The facility is a Natural Minor. The primary sources at the facility are 6 forge furnaces, 2 slow cooling furnaces, 2 press forge furnaces, a temper furnace, hand scarfing, an emergency generator and an immersion degreaser. The emergency generator is subject to 40 CFR 60 Subpart IIII—Standards of Performance for Stationary Compression Ignition Internal Combustion Engines. The conditions of Plan Approval 37-300B were incorporated into this permit. The renewal permit contains emission restrictions, recordkeeping, and work practice requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act. The facility emissions after taking restrictions are: 3.84 TPY; 48.9 TPY; 2.77 TPY; 0.35 TPY; and, 42.3 TPY for PM10, NOx, VOC, SOx, and CO, respectively.

(5100 Joshua Road, Plymouth Meeting, PA 19462) On May 13th 2016 for an Administrative Amendment to State Only (Synthetic Minor) Operating Permit to amend the stack testing requirement for the combination HMA plant in such a manner that stack testing on auxiliary fuels (i.e., fuel oil or WDLF) is only required if consumed for 30 or more cumulative days over a certain period of time (i.e., a 12-month rolling period for fuel oil, or a 4-year consecutive time period for WDLF). This is a combination hot mix asphalt (HMA) plant at its facility located in Whitemarsh Township, Montgomery County.

15-00055: Highway Materials, Inc. (850 Quarry Road Downingtown, PA 19335), On May 13, 2016, for the amendment of a State Only, Synthetic Minor Operating Permit to amend Source 101, Condition # 006(a) in Section D of the permit. The revised condition reads, ''The stack test shall be performed while the source is operating at maximum routine operating conditions and firing Waste Derived Liquid Fuel (WDLF) and natural gas.'' Highway Materials operates an Asphalt Plant located in East Caln Township, Chester County.

 Highway Materials is requesting to use only natural gas as a fuel during source testing. Currently only natural gas is fired in the burner. While the company has not been using WDLF, they requested to preserve the right in the operating permit to use WDLF.

 The modified condition is, ''If on specification WDLF is used for 30 or more cumulative calendar days within a 4-year consecutive time period, the permittee shall conduct performance testing to measure emissions of NOx, CO, VOC, filterable and condensable PM, and opacity. Testing shall be performed using ''on specification'' WDLF no later than 90 days following the 30th day of cumulative WDLF usage.''

 There are no changes to any other conditions and no emissions in the modification of the operating permit. The facility maintains a synthetic minor operating status by maintaining total NOx emissions to less than 12.00 tons per year. The amended permit includes testing, monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable local, state, and federal air quality requirements.

This is the first de minimis emissions increase at the facility during the term of the current operating permit.

This operating permit was revoked because of a permanent shutdown of operations at the West Pittsburgh Plant on April 4, 2012. The sources will be dismantled or removed. The following conditions are applicable to the permanent shutdown of the West Pittsburgh facility and were approved on May 11, 2016.

 a) The following sources are permanently shut down as of April 4, 2012, and prohibited from operation by this condition:

 1) Source 101 (Hot Mix Asphalt Plant) rated at 300 tph.

 b) The facility generated 4.05 tons of NOx, 1.34 ton of SOx, 7.19 ton of PM10, 1.64 tons of VOC, and 9.47 tons of CO Emission Reduction Credits (ERCs) with the permanent shutdown of the 300 tph Hot Mix Asphalt Plant located in Taylor Township. If the facility wishes to restart this source, a plan approval application shall be submitted.

 c) The ERCs generated by the curtailment or shutdown of a facility which are not included in a plan approval and used as offsets will expire for use as offsets 10 years after the date the facility ceased emitting the ERC generating emissions. The use of these ERCs in applicability determinations for netting purposes is limited to the period specified in 25 Pa. Code § 127.203a(a)(1). (25 Pa. Code § 127.206(f)).

 d) The expiration date of ERCs may not extend beyond the 10-year period allowed by subsection (f), if the ERCs are included in a plan approval but are not used and are subsequently reentered in the registry. (25 Pa. Code § 127.206(g)).

 e) ERCs may not be entered into the ERC registry until the emission reduction generating the ERCs has been certified by the Department in accordance with the criteria for ERC generation and creation contained in 25 Pa. Code § 127.207 (relating to creditable emissions decrease or ERC generation and creation). (25 Pa. Code § 127.206(j)).

 f) ERCs may not be traded to facilities under different ownership until the emissions reduction generating the ERCs is made federally enforceable. (25 Pa. Code § 127.206(l)).

 g) ERCs transferred from one facility to another may not be transferred to a third party, unless the transfer of the ERCs is processed by the Department through the ERC registry system. (25 Pa. Code § 127.206(n)).

 h) Pursuant to the provisions of 25 Pa. Code § 127.207(7), if the ERC generating source has not been dismantled or removed, the owner or operator shall on an annual basis certify in writing to the Department the continuance of the shutdown.

 i) The use and transfer of ERCs shall meet the requirements in 25 Pa. Code § 127.208, regarding ERC use and transfer requirements.

 j) These ERCs may be used, traded, or sold after the approved entry of the ERCs by the Department into the Pennsylvania ERC Registry System. (25 Pa. Code § 127.209).

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 To construct and maintain approximately 5.40 miles of new 16-inch diameter pipeline associated with the White Oak Mainline Expansion Project for the purpose of increasing capacity mandated by FERC. The project consists of two loops; the Daleville Loop, 3.30 Miles, and the Kemblesville Loop, 2.10 Miles. The new pipeline will cross Doe Run, an unnamed tributary to West Branch of White Clay Creek, Big Elk Creek and will permanently impact 0.1 acre of wetland. Construction will utilize HDD (Horizontal Directional Drilling) and open cut methods. The Daleville Loop begins at the Daleville Compressor Station and runs to the intersection with existing pipeline at Limestone Road (PA-1) in Cochranville. The Kemblesville Loop runs from the intersection with an existing pipeline at Hess Mill Road to an existing valve cluster south of Walker Road in Kemblesville.

 To construct and maintain a 57 feet long, by 9 feet wide, by 6 feet high pedestrian bridge across the 100-year floodway of Cooks Run (WWF, MF) associated with the construction of a 3/4 mile long by 10 feet wide connector trail a.k.a. Neshaminy Greenway Trail, Upper State Road to New Britain Train Station. This permit will also include modifications to an existing drainage pipe and head and endwall structures.

 The site is located approximately 0.15 mile upstream of the Neshaminy Creek crossings and terminates at Tamamend Avenue (Doylestown, PA USGS map Lat.: 40.293406; Long. -75.1832).

EROSION AND SEDIMENT CONTROL

 The City of Philadelphia, Air Management Services (AMS) intends to issue a Minor State Only Operating Permit for the following facility:

S14-024: Presbyterian Medical Center (51 N. 39th Street, Philadelphia, PA 19104), for the operation of a hospital in the City of Philadelphia, Philadelphia County. The facility's air emission sources include two (2) 16.7 MMBTUs/hr boilers firing natural gas or No. 2 fuel oil, one (1) 10.4 MMBTUs/hr boiler firing natural gas or No. 2 fuel oil, three (3) 6 MMBTUs/hr boilers firing natural gas or No. 2 fuel oil, one (1) 2,500 kWs diesel fuel fired emergency generator (E7), and six (6) emergency generators rated 750 kWs or less firing diesel fuel.

 The operating permit will be issued under the 25 Pa. Code, Philadelphia Code Title 3 and Air Management Regulation XIII. Notice of Planning Grant Awards Under Section 901 of the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101

 The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P.L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).

 Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
