Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The project will include the backfilling of 1.42 acre of nonjurisdictional open water with poor water quality that have developed within the open surface mine pit and approximately 181 feet of channel impacts. HAZARDOUS SITES CLEAN-UP ACT OF OCTOBER 18, 1988

Public Notice of Proposed Consent Order
and Agreement

Seneca Drum HSCA Site

Cranberry Township, Venango County

 Pursuant to Section 1113 of the Pennsylvania Hazardous Sites Cleanup Act, Act of October 18, 1988, P.L. 756, No. 108, 35 P.S. §§ 6020.101—6020.1305 (HSCA), notice is hereby provided that the Department of Environmental Protection (Department) has agreed to a De Minimis Consent Order and Agreement (Agreement) with Daniel Heath regarding the Seneca Drum HSCA Site.

 The Seneca Drum HSCA Site (Site) is an approximately 3-acre area located along Quaker Drive in Cranberry Township, Venango County, where, in May 2008, drums of undercoating materials and other residual wastes were found buried. The Department's investigation of the Site revealed that the drums and waste were buried at the Site sometime between 1973 and June 30, 1992. Samples obtained during the investigation determined that the waste materials and surrounding soil contained isopropyl alcohol, trichlorobenzene, and acetone, which are ''hazardous substances'' as defined in Section 103 of HSCA, 35 P.S. § 6020.103. The presence of these hazardous substances at the Site constitutes a ''release'' and a ''threat of release'' of a hazardous substance, as defined in Section 103 of HSCA, 35 P.S. § 6020.103.

 In June 2008, the Department conducted a response action at the Site that included the excavation and removal of drums containing automotive undercoating waste and associated impacted environmental media and the proper disposal of these wastes. To date, the Department has incurred more than $109,448 in response costs at the Site.

 Since June 30, 1992, Daniel Heath has owned approximately 5.42 acres of property in the area encompassing the Site (Heath Property). The Department's discovery of a release or threatened release at the Site occurred in 2008, after Daniel Heath acquired the Heath Property; and the Department's investigation revealed the hazardous substances were placed at the Site before Daniel Heath became the property owner. Nevertheless, as the owner of the Site during the time of a release or threatened release of hazardous substances, Daniel Heath is a ''responsible person'' pursuant to Section 701 of HSCA, 35 P.S. § 6020.701.

 The Agreement requires Daniel Heath to submit payment of the Department's response costs in the amount of $3,000 made payable to the Commonwealth of Pennsylvania Hazardous Sites Cleanup Fund. The specific terms are set forth in the Agreement.

 The Department will receive and consider comments relating to the Agreement for sixty (60) days from the date of this Public Notice. The Department has the right to withdraw its consent to the Agreement if the comments concerning the Agreement disclose facts or considerations which indicate that the Agreement is inappropriate, improper, or not in the public interest. After the public comment period, the Agreement shall be effective upon the date that the Department notifies Daniel Heath, in writing, that this Agreement is final and effective in its present form and that the Department has filed a response to significant written comments to the Agreement or that no such comments were received.

 The Agreement is available for inspection and copying at the Department's office at 230 Chestnut Street, Meadville, Pennsylvania. Comments may be submitted, in writing, to Mr. Charles Tordella, Acting Environmental Group Manager.
