Federal Consistency under the Coastal Zone Management Act; Maintenance Dredging at Baxter Water Treatment Plant

 This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection (Department), Coastal Resources Management Program has received notice that the Philadelphia Water Department is proposing to dredge the main and emergency water intakes for the Baxter Water Treatment Plant.

 The purpose of the project is to perform maintenance dredging within the Delaware River in the City of Philadelphia to remove accumulated sediment from the area immediately adjacent to the main and emergency intakes at the Baxter Water Treatment Plant using a mechanical clamshell dredge. The proposed maximum dredging depths are 13 feet below mean low water at the main intake and 17 feet below mean low water at the emergency intake. An estimated volume of 1,080 cubic yards will be removed from the main intake and 16,120 cubic yards will be removed from the emergency intake. Dredged material will be placed at the Rehandling Basin at the Weeks Marine's Whites Basin Facility in Logan Township, NJ.

 This project is subject to Department review for Federal consistency because it is a Federal license and permit activity proposed to be authorized by the United States Army Corps of Engineers (CENAP-OP-R-2014-0220), and will have reasonably foreseeable effects on this Commonwealth's coastal resources or uses.

 In accordance with National Oceanic and Atmospheric Administration (NOAA) regulations in 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), the Philadelphia Water Department has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program. Interested parties may request a copy of the Federal Consistency Certification from the Department contact listed as follows.

 The Department will consider all comments received on or before September 19, 2016, before issuing a final Federal consistency concurrence or objection.
