FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To perform work on West Branch Fishers Run (CWF, MF) (Dillsburg Quadrangle 40° 6` 32.3" N, 77° 1` 41.8" W). The applicant proposes to construct a 16-foot by 8-foot single span bridge stream crossing, approximately 615 feet of pervious pavement as a walking path, two 20-foot by 20-foot pervious pavement pads, one 17-foot by 27-foot pervious pavement pad, and associated grading with approximately 300 cubic yards of fill. The total disturbed area for the bridge and walking trail is approximately 28 hundredths of an acre (0.28 ac). There are no proposed wetland impacts.

E28-380: PENNDOT Engineering District 8-0, 2140 Herr Street, Harrisburg, PA 17103-1699 in Washington Township & Waynesboro Borough, Franklin County, U. S. Army Corps of Engineers Baltimore District.

 To remove existing structures and to install and maintain (1) a 76 foot x 56-foot 6-3/8 inch bridge with a 3.91-foot under clearance over West Branch Antietam Creek (CWF, MF), (2) a 27-inch diameter outfall and, (3) an 18-inch diameter outfall along SR 0016 SEC037 in Washington Township & Waynesboro Borough, Franklin County (Latitude: 39° 45` 45.3"; Longitude: -77° 35` 49.1") for the purpose of improving roadway safety. The project proposes to directly affect 81-linear feet of stream channel and 0.02 ac. of wetlands and temporarily affect 75 linear feet of stream channel and 0.01 ac. of wetlands.

 The applicant is proposing to:

 Place and maintain fill in a deminimus amount (0.03 acre) of PEM wetland (aka Wetland 1), and to install a utility line across a deminimus amount (0.01 acre) of PEM Wetland (aka Wetland 6), in association with the construction of a hotel, two (2) eating establishments, parking areas, and other support/ancillary facilities, such as utility lines, stormwater management facilities, etc. The project is located within the Campbells Run Watershed, near the intersection of Ridge Road and Chestnut Ridge Drive (Oakdale, PA USGS topographic quadrangle; Latitude: 40° 26` 13"; Longitude: -80° 9` 4.5"; Pittsburgh Corps District; Sub-basin: 20F), in Robinson Township, Allegheny County.

E02-1726, Findlay Township Municipal Authority, 1271 Rt. 30, P. O. Box 409, Clinton, PA 15026-1536, Findlay Township, Allegheny County, ACOE Pittsburgh District.

 The applicant is proposing to:

 1. Place fill and permanently impact 2.71 acres of the floodplain of Potato Garden Run (WWF);

 2. Place and maintain fill in 1.44 acre of PEM wetlands;

 3. Construct and maintain a 12" diameter outfall pipe along Potato Garden Run (WWF);

 For the purpose of constructing a 0.50 million gallon per day sewage treatment plant to replace the existing 0.15 million gallon per day sewage treatment plant known as the Potato Garden Wastewater Treatment Plant. The project is located at the intersection of Strouss Road and Potato Garden Run Road (Clinton, PA USGS topographic quadrangle; Latitude: 40° 28` 37"; Longitude: -80° 19` 12"; Sub-basin: 20D; Pittsburgh Corps District), in Findlay Township, Allegheny County. The permanent impacts to wetlands will be mitigated at the site by constructing 1.44 acre of wetlands on-site.

E04-351, The Beaver County Board of Commissioners, 810 Third Street, Beaver, PA 15009, Fallston Borough and Bridgewater Borough, Beaver County, ACOE Pittsburgh District.

 The applicant is proposing to:

 Remove the existing 25` 5.5" width, two span Brickyard Road bridge having a total length of 100`, and having a minimum underclearance of 8` 2"; and to construct and maintain 54` upstream a 37` 4.5" wide, 110` long bridge, having a minimum underclearance of 8` 2" over Bradys Run (TSF) with a drainage area of 25.64 square miles. Place and maintain fill in a deminimus 0.018 acre of PEM wetland. In addition construct and maintain associated stormwater management and approach road changes; and temporarily impact 0.003 acre of PEM wetland and 179` of stream for the construction of these encroachments. The Beaver County improvement and relocation project is in Fallston Borough and Bridgewater Borough, PA (Aliquippa Quadrangle; N: 17.25 inches; W: 8.75 inches; Latitude 40° 43` 16"; Longitude -80° 18` 46") in Beaver County.

E04-352, PennDOT District 11-0, 45 Thoms Run Road, Bridgeville, PA 15017, Greene Township, Beaver County, ACOE Pittsburgh District.

 The applicant is proposing to:

 Remove the existing 48.65` total length, 11.15` wide, 7` 6" underclearance SR 30 arch culvert; construct and maintain a 70.25` long, 10` wide single span, 7` 6" underclearance SR 30 box culvert depressed 1` over Branch of Little Mill Creek (TSF) with a drainage area of 0.8 square mile; place and maintain fill in 122` of an unnamed tributary to Branch of Little Mill Creek (TSF) with a drainage area less than 100 acres and construct and maintain a 44` long replacement channel; place and maintain fill in a deminimus 0.023 acre of PEM wetland; construct and maintain associated stormwater management and approach road changes; temporarily impact 0.094 acre of PEM wetlands and 233` of stream for the construction of these encroachments. Stream mitigation will take place onsite. The project is located on SR 30 (Hookstown, PA Quadrangle; N: 14.25 inches; W: 13.1 inches; Latitude 40° 34` 44.6"; Longitude -80° 28` 11.9") in Greene Township, Beaver County.

E63-682, Pennsylvania Turnpike Commission, 700 South Eisenhower Blvd., Harrisburg, PA 17057, Robinson Township, Washington County, ACOE Pittsburgh District.

 The applicant is proposing to:

 Place and maintain fill in 1,000 LF of an Unnamed Tributary (UNT) to Saint Patrick Run (aka UNT 7 to Saint Patrick Run) (WWF).

 Construct and maintain an 840` x 7.5` culvert in a UNT to Little Raccoon Run (aka UNT 4 to Little Raccoon Run) (WWF).

 Place and maintain fill in 285 LF of a UNT to Little Raccoon Run (aka UNT 9 to Little Raccoon Run) (WWF).

 Place and maintain fill in 525 LF of a UNT to Little Raccoon Run (aka UNT 17 to Little Raccoon Run) (WWF).

 Relocate and maintain 210 LF of another reach of the aforementioned UNT to Little Raccoon Run (aka UNT 17 to Little Raccoon Run) (WWF).

 Relocate and maintain 267 LF of a UNT to Little Raccoon Run (aka UNT 1 to Little Raccoon Run) (WWF).

 Construct and maintain a 560` x 6` culvert in a UNT to Little Raccoon Run (aka UNT 7 to Little Raccoon Run) (WWF).

 Construct and maintain a 540` X 6` culvert in a UNT to Little Raccoon Run (aka UNT Little Raccoon Run 8) (WWF).

 Relocate and maintain 538 LF of a UNT to Little Raccoon Run (aka UNT Little Raccoon Run 8) (WWF).

 Place and maintain fill in several wetlands (PEM, PSS, and PFO), affecting approximately 2.874 acres of wetlands, and temporarily affecting an additional 0.031 acre of wetlands in the Saint Patrick Run and Little Raccoon Run watersheds.

 In association with constructing a new 3.2 mile section (Section 55A1) of the Pennsylvania Turnpike, between US 22 and Quicksilver Road, as a component of the overall construction of a new 13.3 mile section (aka The Southern Beltway Project) of the Pennsylvania Turnpike, between U.S. Route 22, and Interstate 79 (a.k.a. The Southern Beltway project). The structures and activities requiring authorization for Section 55A1 in Robinson Township, Washington County (Clinton, PA Quadrangle; starting at Latitude: 40° 25` 24" Longitude: -80° 19` 7"; and ending at Latitude: 40° 23` 21" Longitude: -80° 16` 48") will permanently impact a total of approximately 3,616 linear feet (LF) of various watercourses and 2.87 acres of wetland, and temporarily impact a total of approximately 150 LF of various watercourses and 0.061 acre of wetland. Two mitigation projects will compensate for the cumulative total of impacts to watercourses from Section 55A1, as well as for impacts from several future subprojects associated with the overall Southern Beltway Project. Although final plans for future projects are not available, the applicant estimates that the aforementioned future subprojects and the current project will permanently affect a cumulative total of approximately 15,231 LF, and temporarily impact approximately 700 LF, of various watercourses. To compensate for the cumulative total of impacts from the Southern Beltway Project, the stream mitigation plan includes the reconstruction, rehabilitation, and enhancement of approximately 15,672 LF of various tributaries in the Buck Run watershed, in Donegal Township, Washington County (West Middletown, PA Quadrangle; Latitude: 40° 8` 34" Longitude: -80° 25` 10"). As compensation for 6.089 acres of permanent wetland impacts associated with the overall Southern Beltway Project, the applicant will construct approximately 6.98 acres of wetlands, at a site approximately 0.5 mile west of the intersection of S.R. 18, and Joffre Bulger Road, in Smith Township, Washington County (Clinton, PA Quadrangle; Latitude: 40° 23` 16" Longitude: -80° 22` 24").

 To construct, operate, and maintain:

 1) a temporary road crossing using timber mats impacting 705 square feet of an exceptional value palustrine emergent (EV-PEM) wetland (Nauvoo, PA Quadrangle 41°35`32"N, 77°13`51"W);

 2) A 20 inch diameter steel gas pipeline, a 16 inch diameter HDPE water pipeline, and a temporary road crossing using timber mats impacting 5,870 square feet of an exceptional value palustrine emergent (EV-PEM) wetland and 1,732 square feet of an exceptional value palustrine forested (EV-PFO) wetland (Nauvoo, PA Quadrangle 41°35`38"N, 77°13`42"W);

 3) A 20 inch diameter steel gas pipeline, a 16 inch diameter HDPE water pipeline, and a temporary road crossing using timber mats impacting 4,197 square feet of an exceptional value palustrine emergent (EV-PEM) wetland (Nauvoo, PA Quadrangle 41°35`41"N, 77°13`36"W);

 4) A 20 inch diameter steel gas pipeline, a 16 inch diameter HDPE water pipeline, and a temporary road crossing using timber mats impacting 1,748 square feet of an exceptional value palustrine emergent (EV-PEM) wetland (Nauvoo, PA Quadrangle 41°35`27"N, 77°13`16"W);

 5) A 20 inch diameter steel gas pipeline, a 16 inch diameter HDPE water pipeline, and a temporary road crossing using timber mats impacting 102 linear feet of Custard Run (EV) (Nauvoo, PA Quadrangle 41°35`28"N, 77°13`08"W);

 6) A 20 inch diameter steel gas pipeline, a 16 inch diameter HDPE water pipeline, and a temporary road crossing using timber mats impacting 1,259 square feet of an exceptional value palustrine forested (EV-PFO) wetland and 29 linear feet of an unnamed tributary to Zimmerman Creek (EV) (Nauvoo, PA Quadrangle 41°35`13"N, 77°12`56"W);

 7) A 20 inch diameter steel gas pipeline, a 16 inch diameter HDPE water pipeline, and a temporary road crossing using timber mats impacting 768 square feet of an exceptional value palustrine emergent (EV-PEM) wetland (Nauvoo, PA Quadrangle 41°34`50"N, 77°12`13"W);

 8) A 20 inch diameter steel gas pipeline, a 16 inch diameter HDPE water pipeline, and a temporary road crossing using timber mats impacting 181 square feet of an exceptional value palustrine emergent (EV-PEM) wetland and 86 linear feet of an unnamed tributary to Little Fall Creek (EV) (Nauvoo, PA Quadrangle 41°34`49"N, 77°12`14"W);

 9) A temporary road crossing using timber mats impacting 598 square feet of an exceptional value palustrine emergent (EV-PEM) wetland (Nauvoo, PA Quadrangle 41°34`47"N, 77°12`11"W);

 10) A temporary road crossing using timber mats impacting 575 square feet of an exceptional value palustrine forested (EV-PFO) wetland (Nauvoo, PA Quadrangle 41°34`46"N, 77°12`09"W);

 11) A temporary road crossing using timber mats impacting 518 square feet of an exceptional value palustrine forested (EV-PFO) wetland (Nauvoo, PA Quadrangle 41°34`46"N, 77°12`09"W);

Section VII NPDES NOI for Coverage under NPDES General Permits

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should contact a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.
