THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

The new relief sewer will run between from the NW corner of South 5th and Main St., generally follow the course of the southern bank of the UNT West Branch Perkiomen Creek, and connect into existing MH # 7 on the west side of Pine St.

 This proposed facility is located in Hamburg Borough, Berks County.

 Description of Proposed Action/Activity:

 The upgrade of the existing pumping station with two new Smith and Loveless, vertical shafted, non-clog drywell sewage pumps outfitted with 10 1/8" impellers and rated at 340 gpm at 98 ft TDH. Additional work on the station includes upgrading and relocating the pump control panel and the installation of VFDs for each pump.

 Description of Proposed Action/Activity:

 This permit approves the construction/operation of manure storage facilities consisting of:

 The existing swine operation will add one new building. A new 406` × 78` Finisher Barn will be built with a 8` deep concrete underbarn manure storage that will store about 1,733,846 gallons at a 0.5` freeboard. The building will have a leak detection system with an observation well, shut off valves within the wells on the inlets and outlets, and animal guards on the outlets

 Description of Proposed Action/Activity:

 This permit approves the construction of sewage facilities consisting of:

 Construction of a mechanical screening unit to be installed upstream of the equalization tank at the Tyrone Township Wastewater Treatment Facility.

 WQM Permit No. 3197403, Sewerage, Mapleton Borough Area Joint Municipal Authority, 13343 Smith Valley Road, PO Box 415, Mapleton Depot, PA 17052-0415.

 This proposed facility is located Union Township, Huntingdon County.

 Description of Proposed Action/Activity:

 This permit approves the construction of sewage facilities consisting of:

 A 14` diameter; 12` SWD mechanical scraped clarifier and a Duplex Return Activated Sludge/Waste Activated Sludge (RAS/WAS) pump station to be used in addition to the existing clarifiers. The new clarifier is designed to handle an average flow of 0.05 MGD and a peak hourly flow of 0.125 MGD with a recirculation flow of 0.05 MGD. The RAS/WAS pumps are 2 centrifugal pumps each rated at 40 gpm at 10 TDH.

 This proposed facility is located in Peach Bottom Township, York County.

 Description of Proposed Action/Activity:

 This permit approves the construction of sewage facilities consisting of:

 The construction of an additional new concrete manure storage structure for a second additional swine finisher barn consisting of an 81` × 258` × 8` deep pit under barn manure storage facility. The new concrete under barn manure storage structure will be located parallel to and next to the existing swine barn constructed off the western side of the existing barn, and will provide 1,065,233 gallons of usable storage capacity at a 6-inch freeboard. This permit shall also include the existing swine barn which has an 81`-6" × 246` × 6` deep pit under barn manure storage facility will provide 738,327 gallons of usable storage capacity at a 6-inch freeboard. Both the new and existing storages will not receive any direct or indirect rainfall runoff.

 The new manure storage facility will consist of a concrete in-ground under barn storage structure with 8-inch thick concrete steel reinforced walls, and a 5-inch thick concrete steel reinforced floor using 4,000 psi concrete. All manure and wash down water will enter the manure storage facility via precast half heavy open grate slats.

 The total estimated annual manure generated per year for the existing barn is estimated to be 816,270 gal./yr. allowing for 11 months of continuous storage and the new barn is estimated to be 1,019,850 gal./yr. allowing for 12.7 months of continuous storage, in which both more than exceed any required winter storage retention.
