NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Plan Description: The Sewage Plan Update of 2016 (2016 Update), approved by DEP on May 4, 2017, includes changes to the proposed Lake Carey Sanitary Sewer Collection and Treatment System Project from what was approved in the 2015 Plan on May 4, 2015.

 The 2016 Update proposes the following changes to the 2015 Plan: (A) Sewer System Changes: (1) Eliminate two lines of the proposed sewer system along backyard of lots along Shore Drive and install single line of the sewer system along the right-of-way of Shore Drive to serve all lots from the front. (2) Eliminate about 900 feet of the proposed sewer along Marina Drive (west of Shore Drive/Indian Spring Road) that was proposed to serve two lots. Both lots will continue to use their existing on-lot sewage disposal systems. (3) Eliminate about 300 feet of the proposed sewer along a private driveway off of Union Chapel Drive that was proposed to serve two lots. Both lots will continue to use their existing on-lot sewage disposal systems. (4) Eliminate about 2,800 feet of the proposed conveyance sewer along the abandoned railroad bed south of Indian Springs Road around the southern portion of Lake Carey (known as the ''Flow Pond''. By installing about 600 feet of the proposed conveyance sewer adjacent to the south side of the causeway bridge that crosses the lake, the sewage flow can be rerouted in the other direction. The change will allow wastewater to go from the lake's west side to the lake's east side. Under this change, the direction of wastewater flow in Indian Spring Road will now go in a northerly direction to Marina Drive and then east along Marina Drive. There is no effect on the number of EDUs to be served, and (B) Wastewater Treatment Plant Changes: (1) Eliminate the specific treatment process Biologically Engineered Single Sludge Treatment (BESST) as proposed in the 2015 Plan in order to be non-proprietary. Otherwise as approved in the 2015 Plan, a 0.120 million gallons per day (MGD) wastewater treatment plant (WWTP) will be constructed to initially serve 382 EDUs and maximum of 480 EDUs, based on 250 GPD/EDU sewage flow from the Lake Carey area of both Townships. The WWTP will be located in Tunkhannock Township. The treated effluent will be discharged to the Tunkhannock Creek which is located within the Chesapeake Bay Watershed. The Chesapeake Bay Nutrient Reduction Strategy will apply to this new discharge.

 The preferred method of financing for the proposed wastewater collection/conveyance system and the WWTP is PENNVEST.

 The Department's review of the 2016 Update has not identified any significant environmental impacts resulting from the proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the Lemon Township & Tunkhannock Township Joint Municipal Sewer Authority (LTTTJMSA) or the municipalities as appropriate.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF
OCTOBER 18, 1988

Public Notice of Proposed Consent Order
and Agreement
Limekiln PCE and Midfield VOC HSCA Sites
Horsham Township, Montgomery

 The Department of Environmental Protection (''Department''), under the authority of the Pennsylvania Hazardous Sites Cleanup Act (''HSCA''), 35 P.S. § 6020.1113, has entered into a Consent Order and Agreement with J&J Development Co., II (''J&J Development'') for remediation of hazardous substances found on the property located at 1116 Horsham Road, Ambler, PA 19002 (''the Property'') and for reimbursement of certain Department response costs incurred to address hazardous substances released and threatened to be released at the Limekiln PCE and Midfield VOC HSCA Sites (''the HSCA Sites'').

 The Midfield VOC HSCA Site is located near the intersection of Midfield Drive and Davis Grove Road in Horsham Township, PA. The Limekiln PCE HSCA Site is located, near the intersection of Horsham Road and Limekiln Pike, in Prospectville, PA. The Property is located in the Midfield VOC HSCA Site and in the vicinity of the Limekiln PCE HSCA Site.

 Both HSCA Sites include commercial and residential properties which were impacted by hazardous substance contamination. To abate the release and threatened release of hazardous substances, the Department installed waterlines at both the Limekiln PCE HSCA Site in 2013 and the Midfield VOC HSCA Site in 2015. The waterlines connected impacted onsite properties to potable public water supplies. The Department's response actions did not include the remediation of certain sources of hazardous substances affecting the groundwater or soil at the HSCA Sites. The Department has determined that the Property is a source of hazardous substance contamination impacting the HSCA Sites.

 The Department and J&J Development have negotiated in good faith. These negotiations yielded the parties' execution of a Consent Order and Agreement in which J&J Development agreed to remediate hazardous substance contamination present on the Property and it agreed to meet an Act 2 cleanup standardi on the Property. Pursuant to the parties' agreement J&J Development will also reimburse the Department for response costs incurred for the HSCA Sites' waterlines in the amount of Fifty Thousand Dollars ($50,000). It is in the public interest for the Department to resolve its potential claims against J&J Development.

 This notice is provided pursuant to Section 1113 of HSCA, 35 P.S. § 6020.1113, which states that, ''settlement shall become final upon the filing of the Department's response to significant written comments.'' The Consent Order and Agreement, which contains the specific terms of the agreement is available for public review and comment. The agreement can be examined from 8 a.m. to 4 p.m. at the Department's Southeast Regional Office, located at 2 East Main Street in Norristown, PA by contacting either Ellen Davies at (484) 250-5731 or Gina M. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 The facility contains air contamination sources consisting of six ''swing'' storage tanks, with storage capacit- ies between 84,000 and 3,100,000 gallons (1-barrel petroleum = 42 US gallons), one 3,900,000 gallons, fixed roof, distillate tank, three ethanol tanks (36,600, 36,000 & 21,000 gallons), two, 42,000 gallons, biodiesel tanks, equipment for barge loading and unloading, and gasoline and distillate loading racks. Emissions are controlled by internal floating roofs and either a Vapor Recovery Unit or a Vapor Combustion Unit. The facility is subject to the applicable requirements of 40 CFR Part 60, Subpart Kb and Subpart XX, as well as 40 CFR Part 63, Subpart Y and Subpart BBBBBB and 25 Pa. Code Chapters 121—145. The permit includes emission limitations, and operational, monitoring, testing, reporting and recordkeeping requirements for the facility.

 No emission or equipment changes have been approved by this action. The emission restriction, testing, monitoring, recordkeeping, reporting and work practice conditions of the SOOP have been derived from the applicable requirements of 40 CFR Parts 60 and 63 and 25 Pa. Code Article III, Chapters 121—145.

The renewal permit contains emission restrictions, recordkeeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

37-00317: Ellwood Mill Products (712 Moravia Street, New Castle, PA 16101) on May 2, 2017, the Department issued the State Only Operating Permit for the iron and steel forging operations facility located in New Castle City, Lawrence County. The sources at the facility include, heat treating furnaces, ringmill milling machines (controlled by a dust collector), an emergency diesel fired generator, a degreaser, shotblaster, and scarfing. The diesel emergency generator (rated at 53.6 HP—2007 model year) is subject to 40 CFR 60 Subpart IIII pertaining to stationary compression ignition internal combustion engines. The natural gas emergency generator (rated at 10.7 HP installed in 2001) is subject to 40 CFR 63 Subpart ZZZZ pertaining to stationary reciprocating internal combustion engines.
