FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. E06-629 (Major Amendment): Prologis, One Meadows Plaza, Suite 100, East Rutherford, NJ 07073 in Bethel Township, Berks County, U.S. Army Corps of Engineers Baltimore District.

 To construct and maintain a 1,084,156 square foot warehouse facility permanently impacting 0.223 acre of PEM wetlands, and 0.43 acre of PEM/PSS wetlands, and permanently filling and impacting 18 linear feet of a UNT to Little Swatara Creek (CWF, MF). To compensate for wetland and stream impacts, the applicant is proposing to 1) construct 1.19 acre of replacement wetlands while temporarily impacting 0.21 acre of a PEM/PSS/PFO wetland to facilitate construction, and 2) construct a new 50 feet long stream channel on-site. The project is located on the South Side of I-78, between exits 15 (Grimes) and 16 (Midway) (Bethel, PA Quadrangle, Longitude: 76°15`5") in Bethel Township, Berks County. Issued May 5, 2017.

 This authorization gives consent to remove an existing single span bridge and construct, operate and maintain single span bridge to carry SR 0044, Section A10, across Little Kettle Creek. The single span concrete bridge to carry SR 0044 across Little Kettle Creek shall be constructed to minimally have a normal clear span of 41.8-feet and underclearance of 5.8-feet. The project is located along the eastern and western right-of-ways of SR 0044 approximately 0.3-mile south of SR 0144 and SR 0044 intersection in Abbott Township, Potter County. The Department has deemed the 0.044 acre of permanent wetland impacts as de minus, for which the permittee shall not be required to provide replacement wetlands as mitigation.

E08-499. Wayne Salsman, 2188 Route 187, Sugar Run, PA 18846, Wilmot Township, Bradford County, U.S. Army Corps of Engineers, Baltimore District.

 Mr. Wayne Salsman applied for a joint permit to place a new pipe culvert in Sugar Run Creek to allow access to private farm land. Presently, the crossing will be installed as a low flow stream crossing, allowing higher streamflow to pass over the top of the roadway to limit any impacts on the 100-year floodplain. The Crossing is in the same location as a previously permitted temporary crossing installed (via GP-8) during oil and gas activities on the same lands. The temporary crossing has been removed.

 The project is located at Quadrangle: Jenningsville; Latitude: 41° 34` 44", Longitude: -76° 13` 21".

 Amend the existing permit to include placement and maintenance of fill in 213 ft of an unnamed tributary to Maple Creek (WWF) with a drainage area less than 100 acres, construction and maintenance of a 200 ft long replacement channel, placement and maintenance of fill in 0.07 acre of PEM/PSS wetland, and additional temporary impacts of 235 ft to an unnamed tributary of Maple Creek (WWF) and 0.01 acre of PEM/PSS wetland. Mitigation for the additional stream impacts will occur offsite on North Branch Pigeon Creek (WWF) in Somerset Township, Washington County. Mitigation for the additional wetland impacts will take place offsite at the State Game Lands 297 Bank in North Bethlehem Township, Washington County. The existing permit authorizes the removal of the existing SR 481, 116 ft long, 10 ft wide by 6 ft high, RC arch enclosure; construction and maintenance of a 10 ft by 8 ft, 80 ft long RC box culvert replacement on a UNT to Pigeon Creek (WWF) with a drainage area of 189 acres, Latitude 40° 7` 29" and Longitude -79° 57` 35"; extension 104 ft upstream and 110 ft downstream, and maintenance of an existing SR 70, 292 ft long, 6 ft by 7 ft RC box enclosure with a final length of 506 ft and with a drainage area of 139 acres; placement and maintenance of fill in a 378 ft long section of UNT to Pigeon Creek between the SR 481 enclosure replacement and the SR 70 enclosure extension; and construction and maintenance of a relocated 328 ft long open channel replacement of the filled UNT Pigeon Creek with a drainage area of 189 acres. In addition the project includes installation and maintenance of road associated stormwater outfalls; placement and maintenance of fill in 340 ft of UNTs to Pigeon Creek (WWF) with drainage areas less than 100 acres; construction and maintenance of a 138 ft long open channel of UNTs to Pigeon Creek with drainage areas less than 100 acres; placement and maintenance of fill in 0.4 acre of PEM/PSS wetland; and temporary impacts to 1,731 ft of stream and 0.17 acre of PEM wetland for construction of the encroachments. Stream mitigation will occur offsite on Sherrick Run (WWF), located in Mount Pleasant Township, Westmoreland County. Wetland mitigation will occur offsite at the State Game Lands 297 Bank in North Bethlehem Township, Washington County.

 In accordance with 25 Pa. Code §§ 129.96—129.100, the Department of Environmental Protection (DEP) has made a determination for an alternate Reasonably Available Control Technology II (RACT II) plan and seeks approval of the amendment to the State Implementation Plan (SIP) for the chocolate manufacturing facility owned and operated by Blommer Chocolate Company in Upper Hanover Township, Montgomery County.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT II determination, have been incorporated into this revised operating permit 46-00198 for the facility. After the public participation requirements of 40 CFR § 51.102 are met, including that public hearings to be held on the dates and at the location advertised below, the relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR Part 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded and/or redacted from the SIP submittal.

Air Quality; Notice of Proposed Revision to the State Implementation Plan for Oxides of Nitrogen

Operating Permit 23-00012

 In accordance with 25 Pa. Code §§ 129.96—129.100, the Department of Environmental Protection has made a determination for an alternate Reasonably Available Control Technology II (RACT II) plan and seeks approval of the amendment to the State Implementation Plan (SIP) for the plastic material and resin manufacturing facility owned and operated by Braskem America, Inc. in Marcus Hook Borough, Delaware County.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT II determination, have been incorporated into this revised operating permit 23-00012 for the facility. After the public participation requirements of 40 CFR § 51.102 are met, including that public hearings to be held on the dates and at the location advertised below, the relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded and/or redacted from the SIP submittal.

 The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:

Powerhouse Boiler 4 & 5 (Source Ids 044 & 045) Condition # 002(b): The following NOx emission limits shall be used for the corresponding fuel type:
(1) Landfill Gas—0.100 lbs/MMBtu (30-day rolling average), in accordance with 25 Pa. Code § 129.99(b).
Condition # 012(b): The owner or operator shall demonstrate compliance with the emission limitations under Condition # 002, of this source, by operating a CEMS for NOx, in accordance with the following procedures:
(1) Monitoring and testing in accordance with the requirements of Chapter 139, Subchapter C (relating to requirements for source monitoring for stationary sources) using a 30-day rolling average.
(i) A 30-day rolling average emission rate for an air contamination source that is a combustion unit shall be expressed in pounds per million Btu and calculated in accordance with the following procedure:
(A) Sum the total pounds of pollutant emitted from the combustion unit for the current operating day and the previous 29 operating days.
(B) Sum the total heat input to the combustion unit in million Btu for the current operating day and the previous 29 operating days.
(C) Divide the total number of pounds of pollutant emitted by the combustion unit for the 30 operating days by the total heat input to the combustion unit for the 30 operating days.
(ii) A 30-day rolling average emission rate for each applicable RACT emission limitation shall be calculated for an affected air contamination source for each consecutive operating day.
(iii) Each 30-day rolling average emission rate for an affected air contamination source must include the emissions that occur during the entire operating day, including emissions from start-ups, shutdowns and malfunctions.
Condition # 016(b): The permittee shall keep records to demonstrate compliance with §§ 129.96—129.99, for NOx, as applicable, in the following manner:
(1) The records must include sufficient data and calculations to demonstrate that the requirements of 25 Pa. Code §§ 129.96—129.99, as applicable, are met.
(2) Data or information required to determine compliance shall be recorded and maintained in a time frame consistent with the averaging period of the requirement.
(3) The records shall be retained by the owner or operator for 5 years and made available to the Department or appropriate approved local air pollution control agency upon receipt of a written request from the Department or appropriate approved local air pollution control agency.
