Regulation No. 54-91 (# 3170)

 On May 4, 2017, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Pennsylvania Liquor Control Board (Board). This rulemaking amends 40 Pa. Code Chapters 9 and 11. The proposed regulation was published in the May 27, 2017 Pennsylvania Bulletin with a public comment period ending on June 26, 2017. The final-form regulation was submitted to the Commission on April 26, 2018.

 This final rulemaking provides for the conditions under which the Board may accept returns of liquor from licensees and special occasion permittees. In addition, it clarifies existing regulations governing the disposition of liquor and malt or brewed beverages under certain circumstances.

 We have determined this regulation is consistent with the statutory authority of the Board (47 P.S. § 2-207(i)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Environmental Quality Board
Control of VOC Emissions from Industrial Cleaning Solvents; General Provisions; Aerospace Manufacturing and Rework; Additional RACT Requirements for Major Sources of NOx and VOCs
Regulation No. 7-492 (# 3173)

 On May 31, 2017, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board (Board). This rulemaking amends 25 Pa. Code Chapters 121 and 129. The proposed regulation was published in the June 17, 2017 Pennsylvania Bulletin with a public comment period ending on August 21, 2017. The final-form regulation was submitted to the Commission on May 11, 2018.

 This regulation adopts reasonably available control technology (RACT) requirements and RACT emission limitations for stationary sources of volatile organic compound emissions from industrial cleaning solvents that are not regulated elsewhere in Chapter 129 or 130 (relating to standards for products).

 We have determined this regulation is consistent with the statutory authority of the Board (35 P.S. § 4005(a)(1) and (8)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Regulation No. 7-521 (# 3177)

 On August 9, 2017, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board (Board). This rulemaking amends 25 Pa. Code, Chapter 109. The proposed regulation was published in the August 26, 2017 Pennsylvania Bulletin with a public comment period September 25, 2017. The final-form regulation was submitted to the Commission on May 11, 2018.

 This regulation incorporates general update provisions; amends existing permit fees and adds new annual fees; adds new amendments to establish the regulatory basis for issuing general permits; and makes clarifications related to permits and the monitoring, reporting and tracking of back-up sources of supply.

 We have determined this regulation is consistent with the statutory authority of the Board (35 P.S. § 721.4(a) and (c)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Access to and Occupancy of Highways by Driveways
and Local Roads
Regulation No. 18-479 (# 3200)

 On March 8, 2018, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Transportation (Department). This rulemaking amends 67 Pa. Code Chapter 441. The proposed regulation was published in the March 17, 2018 Pennsylvania Bulletin with a public comment period ending on April 16, 2018. The final-form regulation was submitted to the Commission on May 24, 2018.

 This rulemaking amends the highway occupancy permit application procedure to provide notice to the fee title holder that an application has been submitted. In addition, the regulation deletes the term ''own'' and replaces it with ''owner.''

 We have determined this regulation is consistent with the statutory authority of the Department (36 P.S. Section 670-420) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
