THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should contact a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

WQM Permit No. 3200406-A1, Sewage, Blacklick Valley Municipal Authority, P.O. Box 272, Twin Rocks, PA 15960.

 This proposed facility is located in Buffington Township, Indiana County and Blacklick Township, Cambria County.

 Description of Proposed Action/Activity: Proposed construction of Sludge Processing Equipment Modification at Blacklick Valley MA WWTP and Route 422 Area Sanitary Sewer Extension Project to serve existing residences with on-lot septic systems.

 The Pennsylvania Infrastructure Investment Authority (PENNVEST) which administers Pennsylvania's State Revolving Fund has been identified as a possible funding source. The Department's review of the Water Quality Management (Part II) Permit has not identified any significant environmental impacts resulting from this proposal.

Northwest Region: Clean Water Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Plan Description: The approved plan provides for the expansion of Connoquenessing Borough's existing wastewater treatment plant (WWTP) from a design flow of 0.08 MGD to a design flow of 0.14 MGD while employing the extended aeration treatment technology. In addition, it concludes with maintaining existing onlot systems for the unsewered areas of the Borough. Plan Description:

 The Act 537 Plan Special Study, Reallocation of Sewage Capacity in Upper Saucon Township's Collection System to service Brinley Court and Traditions of America Land Development Projects (Special Study), dated November 2, 2017 with subsequent revisions, was approved by the Department on August 07, 2018. The Study Areas associated with this Special Study have been designated Existing Service Areas 11 and 12 (ESA-11 and ESA-12).

 The Special Study reallocates Sewage Capacity in Upper Saucon Township's Sewage Collection System for the Brinley Court and Traditions of America Locust Valley Subdivisions. These are Residential Land Developments, consisting of 217 townhouse units for Brinley Court (49,042 GPD at 226 GPD/EDU) and 125 residential units for Traditions of America (28,250 GPD at 226 GPD/EDU). Prior to the Special Study, sewage from the Subdivisions would have entered the Borough of Coopersburg's Sewer System and reentered the Township's Sewer System. The Projects propose the construction and use of public sewer facilities, including two sewage pumping stations and associated force mains.

 A gravity sewage collection system, consisting of about 3,777 LF of eight (8) inch sewer line, will be installed at Brinley Court until the system connects with the Brinley Court Pump Station. From the Pump Station, wastewater will be pumped into a four (4) inch force main (~ 3,400 LF in length) that proceeds in a westerly direction to Main Street, and then overland in a westerly direction to the proposed Traditions of America Locust Valley Pump Station, located at the intersection of Locust Valley Road and Gun Club Road.

 A gravity sewage collection system, consisting of about 5,087 LF of eight (8) inch sewer line, will be installed at the Traditions of America Locust Valley Subdivisions until the system connects with the Traditions of America Pump Station, located at the intersection of Locust Valley Road and Gun Club Road. The Traditions of America Pump Station pumps wastewater into a four (4) and/or six (6) inch force main (~ 1,750 LF in length) that proceeds in a northerly direction along Gun Club Road until its intersection with White Oak Drive. The sewage enters Upper Saucon Township Municipal Authority's existing sewer system at Manhole 1. Wastewater will be treated at the Upper Saucon Sewage Treatment Authority's (USSTA's) Facility, which discharges to Saucon Creek.

 With respect to the Traditions of America Locust Valley Subdivision, the Sewage Facilities Planning Module/Component 3 gave a Brief Project Description in Part A. Project Information.

 The eleven (11) single family homes located in Springfield Township, Bucks County are not being approved from a Planning perspective. Wastewater from these homes will be disposed of via on-lot sewage disposal facilities. Much of the information included in the Special Study can be used during completion of the Sewage Facilities Planning Module/Component 2.

 The Department's review of the Special Study has not identified any significant environmental impacts resulting from the proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the Upper Saucon Township Municipal Authority (USTMA) or the developer (for earthmoving activities).
