FEDERAL WATER POLLUTION
CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  The removal of a well pad and access road impacting 11,125 square feet of a palustrine emergent (PEM) wetland (Crooked Creek, PA Quadrangle 41° 46` 55"N, 77° 13` 29"W). The impacts are a result from the previous well pad owner constructing the pad over the emergent wetland in Charleston Township, Tioga County. Along with the restoration of the 11,125 square feet (0.26 acre) of wetlands on-site, the permittee will provide 22,250 square feet (0.52 acre) of off-site compensatory mitigation at the Butters Mitigation Site (Blossburg, PA Quadrangle 41° 44' 55''N, 77° 03' 16''W).

The Remedial Action Plan was acceptable to meet the Statewide Health Standard and was approved by the Department on May 17, 2019.

Sheetz 153, Storage Tank Primary Facility ID # 20-31643, 18425 Smock Highway, Vernon Township, Crawford County. EnviroTrac, Ltd., 176 Thorn Hill Road, Warrendale, PA 16365, on behalf of Sheetz, Inc., 5700 Sixth Avenue, Altoona, PA 16602 submitted a Remedial Action Plan concerning remediation of soil and groundwater contaminated with benzene, toluene, ethylbenzene, xylenes, cumene, naphthalene, MTBE, 1,2,4 trimethylbenzene, and 1,3,5 trimethylbenzene. The Remedial Action Plan was not acceptable to meet a combination Site-Specific and Statewide Health Standards and was disapproved by DEP on May 21, 2019.

25-00783: Haysite Reinforced Plastics, LLC (5599 Perry Highway, Erie, PA 16509). In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection (the Department) has made a preliminary determination to approve an alternate Reasonably Available Control Technology (RACT II) plan and seeks approval of an amendment to the State Implementation Plan (SIP) for the plastics manufacturing facility owned and operated by Haysite Reinforced Plastics, LLC, in Millcreek Township, Erie County. And in accordance with 25 Pa. Code § 127.521, the Department of Environmental Protection intends to re-issue a Title V Operating Permit for the facility. The facility is located at 5599 Perry Highway, Erie, PA 16509. The facility's representative to contact concerning this application is Ms. Heather Ravenscroft, Environmental Compliance Manager.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT II determination, if finally approved, will be incorporated into the revised operating permit for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's SIP and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal; this includes the provisions of the Department's presumptive RACT II requirements in accordance with 25 Pa. Code § 129.97, as they apply to existing sources at this facility.

 The facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments due to its potential to emit VOC and HAP. The facility is therefore subject to the Title V Operating Permit requirements adopted in 25 Pa. Code Chapter 127, Subchapter G.

 The facility's emission sources include two 4 million Btu/hr natural gas fueled boilers; 10 natural gas fueled space heaters and 5 natural gas fueled furnaces, all rated 250,000 Btu/hr or less; 9 flat sheet molding presses; 14 compression molding machines; 5 pultrusion molding machines and saws; a sheet molding compound machine; a mix room; and a sheet sander and a panel saw. The facility is a major facility due to its potential to emit Styrene, both a HAP and a VOC. Actual 2018 emissions are as follows: 24.15 tons VOC, 24.07 tons HAPs, 1.52 ton NOx, 0.01 ton SOx, 1.28 ton CO, and 0.12 ton PM-10. This facility is subject to 40 CFR Part 63 Subpart WWWW, NESHAPs for Reinforced Plastic Composites Production. The facility also has a 30 hp natural gas fueled emergency generator subject to 40 CFR Part 63 Subpart ZZZZ.

 The following is a summary of the proposed amendments to the RACT II determination for this facility that will be submitted to the EPA as a SIP revision:

• Emissions shall not exceed 8.60 # of VOC/ton product for Puller 5 & 6.
Mix Room: • VOC emissions shall not exceed 17.19 tpy based on an emission factor of 10.26 # of VOC/ton product.
• Emissions shall not exceed 12.31 # of VOC/ton product.

Public hearing. If requested by July 8, 2019, a public hearing will be held to accept oral comments on the proposed operating permit revision and the proposed SIP revision. If requested, the hearing will be held on July 15, 2019, at 10 a.m. at the DEP Northwest Regional Office, 230 Chestnut Street, Meadville, PA 16335.  In accordance with the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act, Act 101 of July 28, 1988 as amended, and Chapter 272 of the Pennsylvania Rules and Regulations, 25 Pa. Code, the County of Wayne is hereby soliciting disposal capacity for municipal solid waste (MSW), including construction and demolition (C/D) waste and municipal sewage sludge (Sludge). Disposal capacity shall be provided for a term of ten (10) years. Wayne County hereby seeks responses from qualified facilities to provide processing/disposal capacity for the County-generated MSW, to begin on or after July 1, 2020.

 The County of Wayne will receive sealed proposals until 4 p.m., prevailing local time, Wednesday, July 10, 2019, at the Wayne County Recycling Center, 66 Volunteer Drive, Honesdale, PA 18431.  Notice is hereby given that the Pennsylvania Department of Environmental Protection, District Mining Operations, 25 Technology Drive, Coal Center, PA 15423, has received a request for a public hearing on the draft NPDES Permit amendment for the Bailey Central Mine Complex Coal Refuse Disposal Areas No. 7 & No. 8 (NPDES No. PA0236268/Mining Permit No. 30130701) owned/operated by Consol Pennsylvania Coal Company LLC (CPCC), 1000 Consol Energy Drive, Canonsburg, PA 15317. The draft effluent limitations for the NPDES permit amendment were published in the Pennsylvania Bulletin, Volume 49, No. 15 on April 13, 2019 and Volume 49, No. 17 on April 27, 2019. The site currently has one outfall (801). This permit amendment proposes to add two additional (2) NPDES outfalls associated with Coal Refuse Disposal Area No. 7, a proposed fine coal slurry impoundment, located in Morris Township, Greene County (701 and 702).

 The draft NPDES permit includes effluent limitations for Outfalls 701 and 702 associated with the construction and operation of Coal Refuse Disposal Area No. 7. This includes effluent limitations for iron, manganese, aluminum, pH, alkalinity, total suspended solids and total dissolved solids.

 The Department will hold a public hearing on the draft NPDES permit amendment and application at the Morris Township Community Center, Rt. 18 Browns Creek Road, Nineveh, PA on Wednesday, July 17, 2019, from 1 p.m. until 3 p.m. The nature of the public hearing is to solicit concerns and comments regarding the draft amended NPDES permit for the Bailey Central Mine Complex Coal Refuse Disposal Areas No. 7 & No. 8. The public hearing will be held in accordance with 25 Pa. Code § 92a.83.

 The public hearing is being held at the request of Center For Coalfield Justice and residents, to state their concerns about the proposed effluent limitations and concerns about impacts to the protected uses of the stream.

 A Department representative will be available to receive both written and oral testimony regarding the draft NPDES permit. Testimony will be placed into public record for the draft NPDES permit and considered by Department staff in the review process. A court stenographer will be present to document the expressed concerns.
