 Formal complaints have been issued by the Pennsylvania Public Utility Commission. Answers must be filed in accordance with 52 Pa. Code (relating to public utilities). Answers are due August 19, 2019, and must be made with the Secretary, Pennsylvania Public Utility Commission, 400 North Street, Harrisburg, PA 17120, with a copy to the First Deputy Chief Prosecutor, Pennsylvania Public Utility Commission.

Pennsylvania Public Utility Commission; Bureau of Investigation and Enforcement v. Rudy's Lawn and Landscape, Inc.; Docket No. C-2019-3006140

COMPLAINT

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement Prosecutory Staff hereby represents as follows:

 1. That Rudy's Lawn and Landscape, Inc., Respondent, maintains its principal place of business at 297 Felker Hill Road, Lindley, NY 14858.

 2. That Respondent was issued a certificate of public convenience by this Commission authorizing transportation of property on November 21, 2018, at Application Docket No. A-2018-3005832.

 3. That Respondent, by Commission Secretarial letter dated November 21, 2018, was informed to submit a copy of a current satisfactory safety rating from the U.S. Department of Transportation or another state, within 180 days, or complete a safety fitness review by a Commission enforcement officer. A satisfactory safety fitness rating must be achieved by Respondent in order to maintain a certificate of public convenience to operate as a common carrier of property between points in the Commonwealth of Pennsylvania.

 4. That Motor Carrier Enforcement Officer Steven Watkins was assigned to perform Respondent's Safety Fitness Review. Officer Watkins left a phone message with Respondent on November 28, 2018 requesting a return call but was not contacted by Respondent. Officer Watkins' continued attempts to contact Respondent by telephone and e-mail in an attempt to schedule the SFR but was unable to reach Respondent. A letter was sent first-class mail requesting Respondent contact Officer Watkins. On January 8, 2019, a certified letter was sent but Respondent has failed to respond to all attempts.

 5. That Respondent, by failing to achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa.C.S. § 501(c) and, for failure to maintain adequate, efficient and safe service and facilities, violated 66 Pa.C.S. § 1501.

 Wherefore, the Bureau of Transportation Investigation and Enforcement Prosecutory Staff hereby requests that the Commission revoke the certificate of public convenience issued to Rudy's Lawn and Landscape, Inc. at A-2018-3005832.

COMPLAINT

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:

 1. That all authority issued to Almighty Trucking, LLC, (respondent) is under suspension effective June 04, 2019 for failure to maintain evidence of insurance on file with this Commission.

 2. That respondent maintains a principal place of business at 100 North Wilkes Barre Boulevard, Suite 410, Wilkes-Barre, PA 18702.

 3. That respondent was issued a Certificate of Public Convenience by this Commission on January 11, 2019, at A-8921727.

 4. That respondent has failed to maintain evidence of Liability and Cargo insurance on file with this Commission. The Bureau of Investigation and Enforcement's proposed civil penalty for this violation is $500 and cancellation of the Certificate of Public Convenience.

 5. That respondent, by failing to maintain evidence of insurance on file with this Commission, violated 66 Pa.C.S. § 512, 52 Pa. Code § 32.2(c), and 52 Pa. Code § 32.11(a), § 32.12(a) or § 32.13(a).

 Wherefore, unless respondent pays the penalty of $500 or files an answer in compliance with the attached notice and/or causes its insurer to file evidence of insurance with this Commission within twenty (20) days of the date of service of this Complaint, the Bureau of Investigation and Enforcement will request that the Commission issue an Order which (1) cancels the Certificate of Public Convenience held by respondent at A-8921727 for failure to maintain evidence of current insurance on file with the Commission, (2) fines Respondent the sum of five hundred dollars ($500.00) for the illegal activity described in this Complaint, (3) orders such other remedy as the Commission may deem to be appropriate, which may include the suspension of a vehicle registration and (4) imposes an additional fine on the respondent should cancellation occur.

 1. That all authority issued to Scalise Trucking, LLC, (respondent) is under suspension effective May 27, 2019 for failure to maintain evidence of insurance on file with this Commission.

 2. That respondent maintains a principal place of business at 245 Saint Clair Street, Bridgeville, PA 15017.

 3. That respondent was issued a Certificate of Public Convenience by this Commission on November 16, 2018, at A-8921549.

 4. That respondent has failed to maintain evidence of Liability and Cargo insurance on file with this Commission. The Bureau of Investigation and Enforcement's proposed civil penalty for this violation is $500.00 and cancellation of the Certificate of Public Convenience.

 4. That respondent has failed to maintain evidence of Liability and Cargo insurance on file with this Commission. The Bureau of Investigation and Enforcement's proposed civil penalty for this violation is $500.00 and cancellation of the Certificate of Public Convenience.
