STATE CONSERVATION COMMISSION

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling (717) 787-8821.

 Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

 For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. TDD users may telephone the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 The Department has received the following Notices of Intent to Remediate:

Northeast Region: Environmental Cleanup & Brownfields Program Manager, 2 Public Square, Wilkes-Barre, PA 18701-1915.

Church Hill Mall (former Hazleton Custom Cleaners), 1099 North Church Street, Hazle Township, Luzerne County. Quad 3 Group, 37 North Washington Street, Wilkes-Barre, PA 18701, on behalf of Timmus Development Corporation, 1065 North Church Street, Hazleton, PA 18202, submitted a Notice of Intent to Remediate. Soil and groundwater were contaminated with TCE, PCE, and cis-1,2 DCE from a former dry-cleaning operation. Future use of the site will be non-residential. The Notice of Intent to Remediate was published in The Standard Speaker on July 19, 2019.

Mid Atlantic Xpress, 834 South Church Street, Hazleton City, Luzerne County. LaBella Associates, 1000 Dunham Drive, Suite B, Dunmore, PA 18512, on behalf of Mid Atlantic Xpress, 139 US Highway 46, Hackettstown, NJ 07840, submitted a Notice of Intent to Remediate. Soil was contaminated with diesel from the dispenser of an aboveground storage tank. Future use of the site will be residential. Statewide Health remediation standards are planned for this site. The Notice of Intent to Remediate was published in The Standard Speaker on July 2, 2019.

Southwest Region: Environmental Cleanup & Brownfields Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

555 Gold Way, 555 Gold Way, City of Pittsburgh, Allegheny County. PVE, LLC, Waterfront Corporate Park III, Suite 101, 2000 Georgetown Drive, Sewickley, PA 15143 on behalf of Gold Way Associates, LLC, 1802 Frick Building, 437 Grant Street, Pittsburgh, PA 15219 has submitted a Notice of Intent to Remediate. A Phase II ESA (sub-slab soil vapor sampling) identified elevated levels of tetrachloroethylene (PCE) and trichloroethylene (TCE) below the ground/garage level of the building on the Property. Elevated VOC levels were measured with a PID meter during the removal of a steel single-walled underground storage tank (UST) located under the building. Soil sample results from the UST excavation pit identified PCE concentrations in the soil. The proposed future use of the Property is non-residential commercial use. The proposed cleanup standard for the Property is non-residential Statewide Health Standard for PCE & TCE in soil and groundwater. The Notice of Intent to Remediate was published in the Pittsburgh Post-Gazette on July 26, 2019.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities.

 Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.

 Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate Department Regional Office.

 Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

PLAN APPROVALS


Plan Approval Applications Received under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B that may have special public interest. These applications are in review and no decision on disposition has been reached.

Northeast Region: Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18711-0790

54-00041C: Silberline Manufacturing Co., Inc. (130 Lincoln Drive, Tamaqua, PA 18252) has submitted an application to the Pennsylvania Department of Environmental Protection for plan approval to construct a new manufacturing process line with control devices and one (1) new boiler at their facility in Rush Township, Schuylkill County.

 Plan Approval No. 54-00041C is for installation of a new encapsulation process for pigments including one (1) new Particulate Matter (PM) condenser. VOC emission increases from this source are not to exceed 9.08 Tons/year. The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

 Copies of the application, DEP's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18701-1915.

 Any person(s) wishing to provide DEP with additional information, which they believe should be considered prior to the issuance of this permit, may submit the information to the address shown in the preceding paragraph. Intent to Issue Plan Approvals and Intent to Issue or Amend Operating Permits under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B. These actions may include the administrative amendments of an associated operating permit.

43-385A: Cronimet Specialty Metals USA, Inc. (209 Reynolds Industrial Park Road, Greenville, PA 16125), for the proposed construction of 2 burn-off ovens and the change in operation of 3 existing burn-off ovens permitted under GP4-43-385A/B/C in Pymatuning Township, Mercer County. This is a State Only facility. The public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44. This plan approval will, in accordance with 25 Pa. Code §§ 127.450 or 127.505, be incorporated into the State Only operating permit at a later date.

 Plan approval No 43-385A is for the proposed construction of 2 burn-off ovens and the change in operation of 3 existing burn-off ovens permitted under GP4-43-385A/B/C. This Plan Approval will contain emission restriction, testing, recordkeeping, work practice standard and additional requirement conditions, which will satisfy the requirements of 25 Pa. Code § 127.12b (pertaining to plan approval terms and conditions) and will demonstrate Best Available Technology (BAT) for the source including, but are not limited to, the following:

• Source 101 [Burn-Off Oven], Source 102 [Burn-Off Oven], Source 103 [Burn-Off Oven 3], Source 104 [Burn-Off Oven 4], & Source 105 [Burn-Off Oven 5]:

 • The Burn Off Ovens are authorized to be constructed that meets best available technology (BAT) required under 25 Pa. Code §§ 127.1 and 127.12(a)(5) which shall include installation of a secondary chamber capable of reducing particulate matter emissions to or below 0.02 grains per dry standard cubic foot (gr/dscf) corrected to 12% CO2.

 • The operation of a burn off oven shall not at any time result in the emission of:

  • Particulate matter emissions in excess of:

   • 0.02 gr/dscf corrected to 12% CO2

  • Visible emissions from air pollution control devices in excess of the following limitations:

   • Equal to or greater than 20% for a period or periods aggregating more than three minutes in any 1 hour.

   • Equal to or greater than 60% at any time.

  • Sulfur compound emissions in excess of 500 parts per million, by volume, dry basis, as specified in 25 Pa. Code § 123.21.

  • Odor emissions in such a manner that the malodors are detectable outside the property of the permittee as specified in 25 Pa. Code § 123.31.

 • Burn off ovens shall not be used to burn coatings that contain halogenated hydrocarbons like PVC, or Teflons.

 • Burn off ovens may be used to remove cured hydrocarbon coatings, grease or oils from metal parts.

 • Burn off ovens may be used for the following list of materials: Drying grindings, Shavings, Swarf, Turnings, Chips, Sludge, Pucked grindings (briquette), Burn-off filters, Filter paper cartridges, Cartridges, & Filter rolls only if the material meets one of the following:

   • The precious metal content must be over 0.05 percent by weight;

   • The combined metal or oxide forms of Ni, Co, Mo, W, V, Cu, Zn, Al, Ti, Si, Fe, B, Cr, Mg, Mn, Zr, Nb, Ta, Sn, Ga, In, or Hf in total must be over 5 percent by weight; or

   • The rare earth metals content must be over 10 percent by weight.

  • If, at any time, the Department has cause to believe that air contaminant emissions from a burn off oven covered by this plan approval are in excess of the limitations specified in, or established pursuant to, any applicable regulation contained in 25 Pa. Code, Subpart C, Article III, the permittee shall conduct tests deemed necessary by the Department to determine the actual emission rate(s).

  • All recordkeeping shall commence upon source startup. Records shall be kept for a period of five (5) years and shall be made available to the Department upon its request.

  • The permittee shall maintain records of the material [see Condition # 002(c)] that enters the burn-off ovens. This includes the following:

   • Type of material

   • The weight percent of the recoverable metals

  • The permittee shall comply with applicable monitoring, recordkeeping and reporting requirements set forth in 25 Pa. Code Chapter 135 (relating to reporting of sources), 139 (relating to sampling and testing), the Air Pollution Control Act, the Clean Air Act, or the regulations thereunder as applicable to the source.

  • The permittee shall, upon Department request, provide fuel analysis, or fuel samples, of the fuel used in the burn off oven. The permittee shall install, maintain, and operate a temperature indicator and recorder to measure and record the temperature in the secondary chamber of the burn off oven.

  • Any notification submitted to the Department shall be sent to the appropriate Regional Office responsible for issuing plan approvals in the county in which the burn off oven is located.

  • The permittee shall immediately notify the Department of any malfunction of the burn off oven which results in, or may possibly be resulting in, the emission of air contaminants in excess of the limitations specified in, or established pursuant to, any applicable rule or regulation contained in 25 Pa. Code, Subpart C, Article III (relating to air resources).

  • The permittee shall immediately notify the Department of any malfunction of plant equipment or associated air cleaning device(s) which results in or may possibly be resulting in the emission of air contaminants in excess of any applicable limitation.

  • The burn off oven secondary chamber shall be designed to: a) maintain a minimum temperature of 1400°F during the period of operation; and, b) have a minimum retention time of gas within the secondary chamber of at least 0.5 seconds.

  • The burn off oven secondary chamber shall be maintained at a minimum temperature of 1400°F during the period of operation. This minimum temperature of 1400°F must be established prior to the commencement of parts burn off in the burn off chamber. Instrumentation shall be provided for the monitoring of the secondary chamber temperature. The minimum retention time of gas within the secondary chamber shall be 0.5 seconds.

  • Any burn off oven operating must comply with the terms and conditions of this plan approval. The burn off ovens and any associated air cleaning devices shall be:

   • Operated in such a manner as not to cause air pollution.

   • Operated and maintained in a manner consistent with good operating and maintenance practices.

   • Operated and maintained in accordance with the manufacturer's specifications.

 In accordance with 25 Pa. Code § 127.44(f)(1), all the pertinent documents regarding this application (applications, review memos, and draft approvals) are also available for review from 8:00 a.m. to 4:00 p.m. at the Meadville Regional DEP Office (Air Quality). Appointments for scheduling a review must be made by calling the DEP at (814) 332-6340.

 In accordance with 25 Pa. Code § 127.44(f)(2), a 30-day comment period, from the date of publication, will exist for the submission of comments. Any person(s) wishing to provide DEP with additional information, which they believe should be considered prior to the issuance of this permit, may submit the information to Regional Air Quality Program Manager, Pennsylvania Department of Environmental Protection, 230 Chestnut Street, Meadville, PA 16335-3494 and must contain the following:

• Name, address and telephone number of the person submitting the comments

• Identification of the proposed plan approval [43-385A]

• A concise statement regarding the relevancy of the information or objections to the issuance of the permit.

 A public hearing may be held, if the Department of Environmental Protection, in its discretion, decides that such a hearing is warranted based on the comments received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper or the Pennsylvania Bulletin or by telephone, where DEP determines such notification is sufficient. Written comments or requests for a public hearing should be directed to Regional Air Quality Program Manager, 230 Chestnut St., Meadville, PA 16335; Phone # (814) 332-6940.

 In accordance with 25 Pa. Code § 127.45, a person may oppose the proposed plan approval by filing a written protest with the Department's Northwest Region Air Quality Program Manager.

 If a plan approval has not undergone the above public notice process, the change to an operating permit must be treated as a significant modification. In these situations, the Department should follow the procedures described in §§ 127.421 to 127.431 for State only operating permits or §§ 127.521 to 127.524 for Title V operating permits.

37-337C: Hickory Run Energy (NE intersection of McClelland & Edinburg Road, New Castle, PA 16102), for the proposed inclusion of the required ERCs for the facility in North Beaver Township, Lawrence County. This is a Title V facility. The public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44. This plan approval will, in accordance with 25 Pa. Code § 127.450 or § 127.505, be incorporated into the facility operating permit at a later date.

 Plan approval No 37-337C is for the proposed inclusion of the required ERCs for the construction of the facility consisting of a natural gas-fired combined cycle 900 MW electric generation facility consisting of two combustion turbine generators, two heat recovery steam generators, and some ancillary equipment. This Plan Approval will contain emission restriction, testing, recordkeeping, work practice standard and additional requirement conditions, which will satisfy the requirements of 25 Pa. Code § 127.12b (pertaining to plan approval terms and conditions) and will demonstrate Best Available Technology (BAT) for the source including, but are not limited to, the following:

• Site:

 • The facility shall not permit the emission into the outdoor atmosphere of CO2(e) (including SF6) in excess of the following:

  • If Siemens H option is chosen: 3,679,784 tpy based on a 12-month rolling total

 • Emission Reduction Credit Requirements

  • The permittee shall not operate the source(s) until the required emission reduction credits are provided to and processed through the ERC registry in accordance with 25 Pa. Code § 127.206(d)(1) and the Department certifies the required emissions reductions.

  • The permittee shall secure NOx and VOC ERCs. ERCs shall be properly generated and certified by the Department. Upon transfer, the permittee shall provide the Department with documentation clearly specifying the details of the ERC transaction. The facility NOx PTE is based on 1.01 tpy for the Auxiliary Boiler, 1.1 tpy for the Emergency Generator, 0.09 tpy for the Emergency Fire Pump, and the NOx PTE for the Combined Cycle Units. The facility VOC PTE is based on 0.14 tpy for the Auxiliary Boiler, 0.03 tpy for the Emergency Generator, 0.06 tpy for the Emergency Fire Pump, and the VOC PTE for the Combined Cycle Units. The NOx and VOC PTE for the Siemens H are 344.5 tpy and 172.70 tpy resulting in a facility NOx and VOC PTE of 346.7 tpy and 172.93 tpy. The permittee shall obtain the following NOx and VOC ERCs based on the facility NOx and VOC PTE times the offset of 1.15:

   • Siemens H: NOx—398.7 tons and VOC—198.9 tons

  • If the amount of required emission reduction credits increases, the company shall secure emission offsets according to a schedule determined by the Department.

  • The facility acquired the following credits and the transfer of ownership was recorded in the Pennsylvania ERC Registry System (May 3, 2019):

   • NOx: 399.1 tons with expiration date of June 30, 2025 from AES Beaver Valley, LLC on March 15, 2018

   • VOC: 198.9 tons with expiration date of March 4, 2026 from Quad/Graphics, Inc. on April 10, 2017

   • VOC: 1.0 ton with expiration date of April 1, 2022 from Viking Energy, LLC on February 28, 2018

  • The facility has the following credits remaining:

   • NOx: 0.4 ton with expiration date of June 30, 2025

   • VOC: 1 ton with expiration date of March 4, 2026

 • This plan approval will supersede plan approval 37-337B issued on June 21, 2016, with an expiration date of May 31, 2021.

• Source 031 (Combined Cycle Unit # 1) & 032 (Combined Cycle Unit # 2):

 • No person may permit the emission from each CCU into the outdoor atmosphere of the following in a manner that exceeds the following:

  • Siemens H

   • Nitrogen Oxides (NOx):

    • Normal operation with or without duct burner: 2.0 ppmvd at 15% oxygen [This condition also assures compliance with 40 CFR 60 Subpart KKKK (60.4320)]

    • Normal operation with duct burner: 29.2 #/hr

    • Normal operation without duct burner: 25.36 #/hr

    • Total normal operation: 109.24 tpy based on a 12-month rolling total

    • Total including startup and shutdown: 172.25 tpy based on a 12-month rolling total

   • Carbon Monoxide (CO):

    • Normal operation with or without duct burner: 2.0 ppmvd at 15% oxygen

16-132O: Clarion Boards Inc. (143 Fiberboard Road, Shippenville, PA 16254). The Department of Environmental Protection intends to issue a plan approval to Clarion Boards Inc. for the installation and initial operation of a replacement bag house control device and the repurposing of the existing (replaced) control device at their facility located in Paint Township, Clarion County. This is an existing Title V facility. It is a major emitter of NOx emissions. VOC emissions are limited facility wide to a total of 49.5 tpy making it a synthetic minor facility for VOC. Public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44.

 Source 107 Mat Reject, also referred to as System 7 by Clarion Boards, will receive the replacement control device. The current control device of Source 107 will be repurposed for use at Source 105 Forming Area and Dust Extraction. The repurposed control device's exhaust will be either recirculated in process or vented indoors. The repurposed control device will not be included in the plan approval because of its' exhausting path.

 The applicant estimates emissions of PM will be generated at a rate of 1.69 lbs/hr. This estimation assumes the control device's flow rate will be 49,358 dscf/min and that the PM concentration will remain constant at 0.004 gr/dscf. Exhaust PM concentration will be limited to 0.004 gr/dscf. Clarion estimates the source will operate for a maximum of 8,280 hours per year. That operation duration would result in 7.0 tpy of PM emissions. The emission estimates and compliance with the emission restriction will be verified through the required stack testing.

 The source is an affected source under 40 CFR Part 64—Compliance Assurance Monitoring. The proposed bag house will be equipped with leak detection system. Additionally, monitoring of the stacks opacity and pressure will be required. Monitoring and associated requirements will be added to the plan approval which satisfy the CAM monitoring standards.

 Fugitive emissions will be prohibited. Monitoring of the baghouse pressure drop will be required. Visible stack emissions will be prohibited. The quality of the filter media (bags) will be monitored through yearly inspections and the use of a triboelectric leak detection system. A copy of the control device manufacturer's operational and maintenance literature will be maintained onsite at all times. Records of all monitoring and maintenance will be kept. Spare bags and parts for monitoring systems will be kept on site. All excursions from normal operating values will be recorded and corrected as needed. A plan to resolve repeated excursions will be developed and implemented as needed.

 The Plan Approval will contain testing, recordkeeping, emission restriction, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

The facility's main sources include a three natural gas fired brick kilns, various material sizing and handling equipment, several small natural gas/No. 2 fuel oil fired space heaters, and emergency diesel generators. The facility has potential emissions of 144.5 tons per year of carbon monoxide, 83.3 tons per year of nitrogen oxides, 249.9 tons per year of sulfur oxides, 107.7 tons per year of particulate matter, 8.25 tons per year of volatile organic compounds, 24.9 tons per year of total hazardous air pollutants (HAPs), and 50,657 tons per year of carbon dioxide equivalents (greenhouse gases). The emission limits, throughput limitations and work practice standards along with testing, monitoring, record keeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. These operating permit conditions have been derived from the applicable requirements of 40 CFR Parts 52, 60, 62, 63, 64 and 25 Pa. Code Article III, Chapters 121—145. The initial operating permit was issued on April 22, 2008. Kinder Morgan Bulk Terminals, Inc. owns and operates a bulk material handling facility. The main sources of emissions are the transfer points from transferring of material, stockpiling of material, and roadway emissions. Sources include hoppers, conveyors, storage domes, stockpiles, one on-site emergency generator and one portable emergency generator, two (2) waste oil heaters, and a gas pumping station with a 2,000-gallon gasoline storage tank. The emergency generators and waste oil heaters are deemed as insignificant sources. The gasoline storage tank (Source ID 107) is subject to 40 CFR Part 63, Subpart CCCCCC. Potential emissions from the facility are: PM—54.82 TPY, PM10—26.79 TPY, PM2.5—5.57 TPY, NOx—11.6 TPY, CO—3.01 TPY, SOx—3.74 TPY, VOC—2.49 TPY, and HAP—1.27 TPY. In the initial operating permit, there was a limit of 99.0 tons per 12-month rolling period for PM-10 as a result of PM-10 being used as a pre-curser for the NSR pollutant PM-2.5. This has been revised to state that PM-2.5 shall be restricted to 99.0 tons per 12-month rolling period, as PM-10 is no longer used as a pre-curser for PM-2.5. The permit will contain monitoring, recordkeeping, reporting, and work practice standards designed to keep the facility operating within all applicable air quality requirements.

46-00132: Lansdale Crematory Inc. (701 Derstine Ave, Lansdale, PA 19446) for operation of a human crematory in Lansdale Borough, Montgomery County. The permit is for a non-Title V (State only) facility. Sources of air emissions include three (3) human crematory units. The renewed permit will include monitoring, recordkeeping, and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

The operating permit contains applicable requirements for emission limitations, work practice standards, testing, monitoring, recordkeeping, and reporting standards used to verify facility compliance with Federal and State air pollution regulations.

COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

Coal NPDES Draft Permits

Compliance Schedule

 (1) The Department has determined that the water quality based effluent limitations (WQGEL) identified in Part A for outfall 002 are necessary to fulfill the present requirements of the Casselman River TMDL.

 (2) Whereas the final WQBEL set out in Part A for outfall 002 are significantly more stringent than past effluent limits for this outfall, and whereas the final effluent limits assigned in Part A cannot be met without modifications to the existing treatment facilities, the permittee shall comply with the interim effluent limits set forth in Part A during the compliance period and shall comply with the following paragraphs. The permittee shall:

 a. Within the six months following permit issuance, conduct an evaluation of the existing treatment facilities for Outfall 002 and determine what modifications are required for each facility to meet the effluent limitations set out in Part A. By the end of the first six months following permit reissuance, the permittee shall submit a report to the Department evaluating the treatment options and identifying the facility modifications required to meet the WQBEL set in Part A.

 b. As part of the report described in paragraph (a), the permittee shall also submit a Treatment Plan to the Department for approval including specifications of the facility modifications, proposed schedule for construction will be performed as soon as possible. In addition, the permittee shall submit complete applications for all permits or permit amendments necessary to install and operate the modifications to the Department for review. Following approval of the Treatment Plan and issuance of all necessary permits for the facility modifications, construction and the revised treatment systems shall commence no later than one year after reissuance of this NPDES permit. Construction and start-up of the facility modifications shall be completed, and attainment of the WQBEL set in part A for Outfall 002 shall be achieved, by no later than eighteen months after reissuance (renewal) of this NPDES permit.

 (3) The permittee shall implement the treatment facility modifications necessary to achieve the WQBEL set in Part A according to the following compliance schedule:

a. Submit a report describing its evaluation of treatment facility modification which will assure compliance with the effluent limitations assigned in Part A As soon as possible, but no later than within six months, of permit reissuance.
b. Submit a treatment plan and complete applications for all permits necessary for the treatment equipment to the Department for approval. As soon as possible, but no later than within six months, of permit reissuance.
c. Commence construction of system modifications required to meet the WQBELS in Part A. As soon as possible, but no later
than within 12 months, of permit reissuance.
d. Complete treatment plant modifications/additions. Compliance with final limits. As soon as possible, but no later
than within 18 months, of permit reissuance.
e. Submit progress reports. Reports shall include updates, attainment, or any progress made toward milestones, summary of results of any supplemental sampling and a discussion of compliance or non-compliance with interim and final requirements. Every 6 months after permit reissuance until completion of the compliance period.

 (4)

 a. Pursuant to 40 CFR § 122.62, the permittee may make request to the Department for approval of a modification of the time period for completing step (d) of the compliance schedule in the table above (completion of construction and start-up of the treatment facility modifications within eighteen months of NPDES permit reissuance). The permittee's request for approval of a modification must demonstrate that the respective compliance schedule step cannot be completed within the prescribed time period. The permittee shall also provide an alternative time frame for completion of construction and start-up of the treatment technology; the alternative must be based on completing construction as soon as possible. The permittee's economic inability to comply with any of the obligations of this Compliance Schedule shall not be grounds for any extension of time.

 b. The permittee shall submit a request for modification of the compliance schedule pursuant to this paragraph in writing to the Department within 10 working days of the date the permittee becomes aware or reasonably should have become aware of the event impeding performance. The written submission shall include all necessary documentation specifying the reasons for the delay, the expected duration of the delay, and the efforts which have been made to minimize the length of the delay. The initial written submission may be supplemented within ten working days of its submission.

 The Department will decide whether to grant all or part of the extension requested on the basis of all documentation submitted by the permittee and any other information available to the Department and will notify the permittee in writing of its decision. In any subsequent litigation, Penn Coal Lands, Inc. shall have the burden of proving that the Department's refusal to grant the request extension was an abuse of discretion based upon the information then available.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. The site is located near intersection of Philmont Avenue and Huntingdon Pike (Route 232) (Hatboro and Frankford, PA, USGS Maps; Latitude: 40.118076; Longitude: -75.06477).

 This amendment to Permit No. E46-1177 requests the inclusion of the following activities:

 a. To extend the existing 12 feet wide pedestrian trail approximately 585 linear feet in and along the 100-year floodway of Huntingdon Valley Creek between Huntingdon Valley Creek and Philmont Avenue to provide an egress and recreational activities.

 b. To stabilize approximately 150 linear feet of the existing streambank of Huntingdon Valley Creek due to severe existing bank erosion.

 c. To install a new outfall structure beneath the new proposed trail.

 No additional permanent or temporary impact to the Huntingdon Valley Creek are necessary for completing the proposed work.

 All conditions specified in the original permit remain in effect and are to be complied with as part of this amendment.

This activity will result in 174 linear feet (545 square feet) of temporary waterway impact and is located directly adjacent to the existing stream.

 4. To construct and maintain 229 linear feet (2,360 square feet) of new stream channel (New Stream 80, WWF-MF) associated with the day-lighting of an existing storm pipe at the Park Road Bridge location south of SR 0422. This activity will result in 23 linear feet (483 square feet) of permanent waterway impact and 17 linear feet (204 square feet) of temporary waterway impact to the existing water course (Stream 80, WWF-MF).

 5. To relocate, construct, and maintain a 30-inch stream enclosure to carry the newly created stream (Stream 80, WWF-MF) and an unnamed tributary to Sanatoga Creek (Stream 2, WWF-MF) at Park Road Bridge south of S.R. 0422 that will impact a wetland (Wetland 2, PSS). This activity will result in 253 square feet (0.006 acre) of permanent wetland impact, 1,291 square feet (0.030 acre) of temporary wetland impact and downstream riprap apron is included within the 54-inch RCP stream enclosure extension impact.

 No resource impacts are associated with the Pleasantview Road Bridge replacement.  The Constable Loop natural gas pipeline project consists of constructing approximately 3.6 miles of 12-inch steel natural gas pipeline located in Meshoppen Township, Wyoming County and Auburn Township, Susquehanna County. The project will result in 404 lineal feet of stream impacts and 61,654 square feet (1.42 acre) of palustrine emergent (PEM) wetlands to provide safe reliable conveyance of Marcellus Shale natural gas to market. Note: Impacts 1 through 4 are located within Wyoming County and impacts 5 through 37 are located within Susquehanna County.
