THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should contact a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

 Replacement of 2,939 L.F. 10-inch existing sanitary sewer collection system along Broad Street with 15-inch SDR35 PVC sanitary sewer collection system including manholes.

WQM Permit No. 0119401, Sewerage, Lake Meade Municipal Authority, 59 Curtis Drive, East Berlin, PA 17316-9220.

 This facility is located in Reading Township, Adams County.

 Description of Proposed Action/Activity:

 This permit approves modification of sewage facilities consisting of:

 The replacement of approximately 1,600 linear feet of the existing 4" PVC forcemain with 6" PVC forcemain from a point approximately 200 ft west of the intersection of Curtis Drive and Lake Meade Drive up to existing manhole # 61. The project will also include the installation of a new air/vacuum valve at project STA 3+06.

 This facility is located in Woodbury Township, Blair County.

 Description of Proposed Action/Activity:

 This permit approves the construction of sewage facilities consisting of:

 • Two (2) Influent pumps which are at least 5 HP and are capable of lifting 81` of dynamic head.

 • Grinder/Comminuter

 • One treatment tank consisting of two (2) train Continuous flow sequencing batch reactor (CSBR) with a minimum of 0.044 MG and a sludge holding tank with a minimum volume of 0.0042 MG. The dimensions of the CSBR are 13.5` W × 12` H × 42` L and a SWD of 10.5`.

 • For the CSBR aeration tank, two (2) positive displacement blowers rated at 200 SCFM at 5.3 PSIG, 10 HP motor.

 • For the digesters, two (2) positive displacement blowers rated at 20 SCFM at 5.6 PSIG, 2 HP motor.

 • UV disinfection system

 • Post aeration and effluent flow metering

Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

Residential properties are located along Allen Road, Ritner Highway, Alexander Spring Road, and Newville Road. Commercial and industrial facilities are generally located along Routes 11 and 641 and Interstate 81. Various warehouse distribution centers are located along Allen Road, Ritner Highway, Logistics Drive, Commerce Avenue, and Newville Road.

 From September 19, 2008 to February 22, 2018, a total of ninety-seven properties were sampled for volatile organic compounds (VOCs). Of the ninety-seven properties that were sampled, forty-two came back with VOCs detected. During the investigation period, heavy redevelopment took place resulting in multiple residences being demolished; private wells being destroyed; and properties being connected to public water.

 For the purposes of the Department's response, only Properties of Concern will be addressed. Properties of Concern consist of the remaining properties utilizing private wells where the primary constituents-of-concern (CoCs) Trichloroethylene (TCE), 1,1-dichloroethene (1,1-DCE), and 1,1,1-trichloroethane (1,1,1-TCA), and tetrachloroethylene PCE have been detected. Of the twenty-seven remaining properties with detections of CoCs, three properties had at least one CoC detected at a concentration at or above the MCL (maximum contaminant level) in the groundwater supply wells.

 548 Alexander Spring Road had a single exceedance of TCE in 2008 and has a point-of-entry treatment (POET) system installed by the property owner. The 1911 Ritner Highway is a residence that was provided a POET system by the Department. 1921 Ritner Highway, which serves as the office to Cumberland Valley Memorial Gardens had a single exceedance of TCE in 2013 and utilizes bottled water for employees and visitors.

 The highest TCE concentrations for the Properties of Concern were detected at 1911 Ritner Highway at concentrations ranging from to 10.8 to 57.4 g/L. The highest concentrations of 1,1-DCE were also detected at this property at concentrations ranging from 2.93 to 15.5 µg/L. PCE and 1,1,1-TCA were not detected above the MCL in any supply wells.

 The proposed response for the Allen Road TCE Site (Site) will consist of a final response to reduce or eliminate the exposure of residents to water supplies contaminated with trichloroethylene (TCE). This action is taken to protect the public health or safety or the environment.

 After considering institutional controls, bottled water, POET systems, and connection to the public water system as Alternatives 1 through 4 respectively; the Department is proposing Alternative 1, institutional controls, and Alternative 3, POET systems, as the Interim Response for the site.

 The Department has already implemented Alternative 3 as a Prompt Interim Response and proposes Alternative 1 and Alternative 3 as a final response. Alternative 3 was initiated March 1, 2013 for 1911 Ritner Highway when concentrations of TCE exceeded the inhalation risk value of 25 ppb. Alternative 4 was considered but given the prohibitive cost to extend the water supply line along Ritner Highway, Alternative 3 was selected instead for 1911 Ritner Highway.

 Alternative 3 was also considered for 1921 Ritner Highway. Since sample results only show a single exceedance of the TCE during the October 21st, 2013 sampling event and subsequent sample results show CoC's below the MCL, a Point of Entry Treatment system would not be necessary and standard Activity Use Limitations (AUL) would not be applicable. The total cost to implement the proposed response is estimated to be $32,400.

 This response will be carried out as a final remedial response pursuant to Section 504 of the Hazardous Sites Cleanup Act for the exposure of residents to water supplies using contaminated groundwater. Additional response action may be needed to achieve a complete, permanent and final cleanup for the site. Treatment technologies that address aquifer restoration and/or protection of the environment, such as ex-situ or in-situ treatment technologies, may be considered in the future provided a technically feasible and cost-effective approach can be developed.

 This notice is being provided pursuant to Section 506(b) of HSCA. The administrative record which contains the information that forms the basis and documents the selection of this response action is available for public review and comment. In addition, persons may present oral comments, for inclusion in the administrative record, at a public hearing. The Department has scheduled the hearing on December 18, 2019 at 7:00 p.m. at 310 Allen Road, Carlisle, PA 17013. Persons wishing to present comments must register with Mr. DeMars before December 13, 2019 by telephone at the number listed above or in writing at the DEP Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110-8200. If no person registers to present oral comments, by December 13, 2019, the hearing will not be held, but will be replaced with an informational meeting.
