Fee Schedule Rates and Department-Established Fees for Consolidated, Community Living and Person/Family Directed Support Waivers Services, Targeted Support Management and the Community Intellectual Disability Base-Funded Program

 The Department of Human Services (Department) is providing final notice of the Fee Schedule Rates for Targeted Support Management and select services funded through the Consolidated, Community Living and Person/Family Directed Support (P/FDS) waivers and Department-established fees for residential ineligible services.

 The Fee Schedule Rates also serve as the Department-established fees under 55 Pa. Code § 4300.115(a) (relating to Department established fees) for base-funded services managed through county programs for individuals with an intellectual disability under the Mental Health and Intellectual Disability Act of 1966 (50 P.S. §§ 4101—4704); 55 Pa. Code Chapter 4300 (relating to county mental health and intellectual disability fiscal manual); and 55 Pa. Code Chapter 6100 (relating to services for individuals with an intellectual disability or autism).

Fee Schedule Rates and Department-Established Fees

 On October 5, 2019, the Department promulgated 55 Pa. Code Chapter 6100, which replaced 55 Pa. Code Chapter 51. Section 6100.571 (relating to fee schedule rates), which addresses the development of Fee Schedule Rates, is effective upon promulgation. As did § 51.52 (relating to fee schedule rate), § 6100.571 requires the Department to use a market-based approach to develop the Fee Schedule Rates.

 The Fee Schedule Rates and Department-established fees were published as final in the Pennsylvania Bulletin, 48 Pa.B. 7716 (December 15, 2018). The Department subsequently revised the Fee Schedule Rates for Community Participation Support services. The rates for Community Participation Support services were published in the Pennsylvania Bulletin, 49 Pa.B. 2685 (May 25, 2019). No other changes have been made to the Fee Schedule Rates for Targeted Support Management and select services funded through the Consolidated, Community Living and P/FDS waivers and Department-established fees for residential ineligible services since they were published in the Pennsylvania Bulletin, 48 Pa.B. 7716.

 The final Fee Schedule Rates and Department-established fees represent the maximum rates that the Department will pay and can be accessed on the Department's web site at http://dhs.pa.gov/provider/developmentalprograms/feeschedulerates/currentrates/index.htm.

 Section 6100.571(c) requires the Department to update the data used to establish the Fee Schedule Rates at least every 3 years. When the data is updated the Department will publish a notice in the Pennsylvania Bulletin of the Fee Schedule Rates. The Department will in the future only publish a notice in the Pennsylvania Bulletin of the Fee Schedule Rates for Targeted Support Management and select services funded through the Consolidated, Community Living and P/FDS waivers and the Department-established fees for residential ineligible services when the rates are changed.
