COAL AND NONCOAL MINING
ACTIVITY APPLICATIONSApplications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.31); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); the Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); the Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P.S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District Mining Office indicated above each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.
Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the District Mining Office indicated above each application within 30-days of this publication, or within 30-days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Written comments or objections related to a mining permit application should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.
Requests for an informal conference, or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 (relating to public hearing-informal conferences) or § 86.34 (relating to informal conferences), must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.
Where a National Pollutant Discharge Elimination System (NPDES) number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.
Effluent Limits—The following range of effluent limits will apply to NPDES permits issued in conjunction with the associated coal mining activity permit and, in some cases, noncoal mining permits:

MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.
Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30-days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30-days of this public notice and contain the name, address, telephone number and the interest of the party filing the request and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

FEDERAL WATER POLLUTION
CONTROL ACT, SECTION 401The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30-days of the date of this notice, as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. To construct and maintain an approximately 7,600 feet long and 12-foot wide multi-use paved trail in three segments within the floodway/floodplain of the Crow Creek (WWF-MF), associated with the Crow Creek Trail connecting to township parks, schools, community centers, and businesses within the township. The project will include the following activities:
1. Construct and maintain a 47-foot long and 8-foot wide steel beam bridge at trail section 1F.
2. Construct and maintain an 80-foot long and 8-foot wide steel beam bridge at trail section 2B.
3. Construct and maintain a 16-foot long and 8-foot wide wood/timber beam bridge at trail section 1C.
4. Construct and maintain a 16-foot long and 12-foot wide wood/timber beam bridge at trail section 3A.
5. Construct and maintain a 26-foot long, 15-inch diameter concrete culvert at trail section 1C-2.
6. One temporary stream crossing at trail section 2B-2.
The project is in three segments: Walker Park to West Valley Forge Road, West Valley Forge Road to Sweetbriar Park, and West Beidler Road to North Henderson Road (Norristown, Collegeville, Lansdale, and Valley Forge, PA USGS Quadrangles Latitude: 40.103551; Longitude: -75.381613) in Upper Merion Township, Montgomery County.
Permit No. E09-1041, Pennsylvania Department of Transportation Engineering District 6-0, 7000 Geerdes Blvd., King of Prussia, PA 19406, Wrightstown Township, Bucks County, ACOE Philadelphia District.
The Pennsylvania Department of Transportation (PennDOT District 6-0) is proposing to perform the following water obstruction and encroachment activities associated with the SR 0232 Interchange Improvement Project:
1. To construct and maintain 371 linear feet of new stream channel associated with the relocation of Water Course 3 to existing Wetland Area 1 (PEM). This activity also includes the removal of a 24-inch conveyance and 197-foot-long, 18-inch diameter conveyance pipe under SR 0232 and in its place, construct and maintain a 24-inch diameter, 174-foot-long pipe resulting in 348 square feet of permanent watercourse impact and considered a waived activity. In place of the previous location of the Water Course 3, an existing concrete channel will be converted to 230 linear feet of riprap lined channel to facilitate drainage to proposed stormwater facilities.
2. To place fill within Wetland Area 1 (PEM) associated with the construction and maintenance of two (2) stormwater facilities and a series of constructed wetland stormwater facilities resulting in 157 square feet (0.004 acre) of permanent wetland impact and 580 square feet (0.013 acre) of temporary wetland impact with the intention to create 3,746 square feet (0.086 acre) of new wetlands. This activity also includes impacts to floodway and floodplain which include 3,696 square feet (230 cubic yards) of floodway impact and 26,899 square feet (1,500 cubic yards) of floodplain impact due to placement of fill.
3. To construct and maintain a permanent wetland crossing within Wetland Area 1 (PEM) for access to construct and maintain stormwater facilities stated in Item 4 and will result in 1,739 square feet (0.040 acre) of permanent wetland impact and 348 square feet (0.008 acre) of temporary wetland impact. This activity also includes the installation of a 24-inch diameter pipe to supply hydrology to the remainder of Wetland Area 1.
4. To construct and maintain a 36-inch diameter outfall associated with the discharge from the stormwater facilities to an unnamed tributary to Neshaminy Creek (WWF) resulting in 380 square feet (0.009 acre) of permanent floodway impact. This activity also includes the placement of rock riprap apron.
This project is located on 2nd Street Pike between the SR 0232 Bridge over Neshaminy Creek up to and including the Swamp Road and 2nd Street Pike Intersection in Wrightstown Township, Bucks County (USGS PA Norristown Quadrangle—Latitude 40.254828 N, Longitude 75.007289 W).
Permit No. E46-1180, LCB Berkshire Senior Living Holdings II, LLC, 121 Bellant Circle, Greenville, DE 19807, Lower Merion Township, Montgomery County, ACOE Philadelphia District.
To demolish the existing mill complex, construct and maintain a six-story, 84-unit senior living facility in its place. The complex will include park, walkway, and various public amenities within the 100-year floodway/floodplain of the Gully Run (WWF, MF) associated with the redevelopment of the property into a senior living facility. The project will include three minor road crossings and one overhead electrical utility crossing.

To construct and maintain a stream restoration project in a 583-foot reach of a Tributary to Brodhead Creek (TSF, MF) (Stream S1) using natural stream channel design techniques for the purpose of improving channel stability, water quality and aquatic habitat. Work will include the installation of three riffle channel sections and thirty-two rock step pools.
3. To relocate approximately 565 linear feet of a Tributary to Brodhead Creek (TSF, MF) (Stream S3) for the purpose of reconstruction and realignment of the existing I80/Exit 308 interchange. The work consists of approximately 568 linear feet of a new watercourse channel using natural stream channel design techniques.
4. To fill a de minimus area of PEM wetland equal to 0.043 acre immediately adjacent to the I-80 fill slope for the purpose of reconstruction and realignment of the existing I80/Exit 308 interchange.
5. To place fill in 2.41 acres of the floodway of Tributary to Brodhead Creek (TSF, MF) (Stream S1) for the reconstruction and realignment of the existing I80/Exit 308 interchange.
6. To place fill in 1.25 acre of the floodway of Tributary to Brodhead Creek (TSF, MF) (Stream S3) for the reconstruction and realignment of the existing I80/Exit 308 interchange.

To remove the existing structure and to construct and maintain a 81.14-foot wide single-span reinforced concrete bulb T-beam bridge carrying SR 0222 across UNT to Schaefer Run (HQ-CWF, MF) having a 54.23-foot span and a 4.96-foot underclearance. Additionally, fill will be placed within the floodway of UNT to Schaefer Run (HQ-CWF, MF) for the purpose of bridge reconstruction and roadway widening.
2. To remove the existing structure and to construct and maintain a 52.56-foot long, 20-foot × 5-foot reinforced concrete box culvert carrying SR 3012 over UNT to Schaefer Run (HQ-CWF, MF) with wingwalls, fish baffles and with the invert depressed 1-foot below the streambed elevation. Additionally, fill will be placed within the floodway of UNT to Schaefer Run (HQ-CWF, MF) for the purpose of bridge reconstruction and roadway widening.
3. To construct and maintain an outfall channel in the floodway of Schaefer Run (HQ-CWF, MF) consisting of a vegetated channel with an approximate 6-foot bottom width and a depth of 1.4 foot.
4. To construct and maintain an outfall channel in the floodway of Schaefer Run (HQ-CWF, MF) consisting of a vegetated channel with and approximate 6-foot bottom width and a depth of 1.3-foot.
5. To construct and maintain an outfall channels in the floodway of a UNT to Schaefer Run (HQ-CWF, MF) at Station 508+00 on both sides of the roadway consisting of a vegetated channel.
6. To construct and maintain an outfall channels in the floodway of a UNT to Schaefer Run (HQ-CWF, MF) at Station 36+00 on both sides of the roadway consisting of a vegetated channel.

To remove the existing structure and to construct and maintain an 87-ft long, 30-in diameter reinforced concrete pipe for the purpose of improving stream hydraulics across S.R. 0224, Section L12, Segment 0100, Offset 2264 in Mahoning Township, Lawrence County. The existing Type M inlet and poor channel geometry result in insufficient conveyance of UNT Mahoning River (WWF) which presents several hazards to the travelling public including shoulder washouts and icing of the roadway as well as flooding to adjacent private property. The applicant also proposes to relocate and regrade approximately 80-ft of UNT Mahoning River upstream of the proposed culvert in order to eliminate the need for an inlet box, which will improve aquatic passage and stream connectivity. A total of 0.04-ac of permanent wetland (PEM/PSS/PFO) impacts and 0.01-ac of temporary wetland (PEM/PSS/PFO) impacts are proposed. The project will result in a total of 212-ft of permanent stream impacts and 252-ft of temporary stream impacts to UNT Mahoning River.
