FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the Regional Permit Coordination Office as noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. PUBLIC NOTICE OF APPLICATION AND DRAFT STATE WATER QUALITY CERTIFICATION FOR A FERC REGULATED PIPELINE PROJECT


Proposed State Water Quality Certification Required by the Commonwealth of Pennsylvania, Department of Environmental Protection Pursuant to Section 401 of the Clean Water Act for the Conemaugh River Crossing Project

WQ6583220-001, Texas Eastern Transmission, LP, 890 Winter Street, Suite 300, Waltham, MA 02451. Conemaugh River Crossing Project, in Derry Township, Westmoreland County and Blacklick Township, Indiana County, Pittsburgh Corps District. The proposed project starts on the western side of the Conemaugh River in Westmoreland County within Texas Eastern's existing ROW at their existing valve site (Latitude: 40.455036°; Longitude: -79.301894°), and ends on the eastern side of the Conemaugh River in Indiana County approximately 600 feet northeast of another existing valve site (Latitude: 40.458303°; Longitude: -79.294683°)

 On June 11, 2020, the Applicant requested a State water quality certification (SWQC) from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.

 The Project, as proposed, includes the in-situ grouting and abandonment of approximately 1,280 linear feet of the existing 24-inch Line 12 pipeline, and the installation and maintenance of approximately 2,600 linear feet of replacement 24-inch pipeline. Approximately 2,350 linear feet will be replaced in-kind and approximately 250 linear feet will be construction of new 24-inch pipeline to reconnect to the existing system. The Project, as proposed, will require approximately 12.23 acres of earth disturbance, and impacts to 195 linear feet of the Conemaugh River (WWF), 0.002 ac. of floodway impacts, 1.78 ac. of temporary palustrine emergent (PEM) wetland impacts, 0.081 ac. of temporary palustrine scrub-shrub (PSS) wetland impacts, 0.103 ac. of temporary palustrine forested (PFO) wetland impacts, 0.029 ac. of permanent PEM wetland impacts, 0.022 ac. of permanent PSS wetland impacts and 0.103 ac. of permanent PFO wetland impacts.

 PADEP, by this notice, is proposing to issue a SWQC to Texas Eastern Transmission, LP for the Conemaugh River Crossing Project. PADEP is proposing to certify that construction, operation and maintenance of the Conemaugh River Crossing Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP is proposing to further certify that the construction, operation and maintenance of the Conemaugh River Crossing Project complies with Pennsylvania water quality standards and will protect applicable Commonwealth water quality standards provided that the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:

 1. Discharge of Hydrostatic Test Water—Applicant shall obtain and comply with a National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.

 2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.

 3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601.), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management) and all other applicable regulations.

 4. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.

 5. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.

 6. Operation—Applicant shall properly operate and maintain at all times all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 7. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals which ensure the project shall maintain and protect State water quality standards as required by this SWQC. The Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.

 8. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, the Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to PADEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.

 9. Correspondence—All correspondence with and submittals to PADEP concerning this SWQC shall be addressed to the Department of Environmental Protection, Regional Permit Coordination Office, Domenic Rocco, PE, Director, 400 Market Street, Harrisburg, PA 17101, RA-EPREGIONALPERMIT@pa.gov.

 10. Reservation of Rights—PADEP may modify, suspend, or revoke this SWQC if (i) PADEP becomes aware of new facts about the Project that warrant such action; or (ii) PADEP determines that the Applicant has not complied with the terms and conditions of the SWQC. PADEP may require additional measures to achieve compliance with any applicable law or regulation.

 11. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.

 12. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of this SWQC shall not be affected thereby.

WATER OBSTRUCTIONS AND ENCROACHMENTS

Texas Eastern Transmission, LP, 890 Winter Street, Suite 300, Waltham, MA 02451, Conemaugh River Crossing Project.

 The applicant is proposing the in-situ grouting and abandonment of approximately 1,280 linear feet of the existing 24-inch Line 12 pipeline, and the installation and maintenance of approximately 2,600 linear feet of replacement 24-inch pipeline. Approximately 2,350 linear feet will be replaced in-kind and approximately 250 linear feet will be construction of new 24-inch pipeline to reconnect to the existing system within Westmoreland and Indiana Counties. The purpose of the project is to replace aging infrastructure to ensure the continued safety and reliability of Texas Eastern's bulk natural gas transmission system. The project consists of one Chapter 105 Water Obstruction and Encroachment Permit and one Chapter 102 Erosion and Sediment Control Permit. Below are the Chapter 105 permit applications being reviewed by the Department.

E6583220-026. The Westmoreland County portion of the project is located in Derry Township, the project then crosses the Conemaugh River and ends in Blacklick Township, Indiana County, both are in U.S. Army Corps of Engineers, Pittsburgh District. The proposed project starts on the western side of the Conemaugh River in Westmoreland County within Texas Eastern's existing ROW at their existing valve site (Latitude: 40.455036°; Longitude: -79.301894°) and extends to the eastern side of the Conemaugh River in Indiana County approximately 600 feet northeast of another existing valve site (Latitude: 40.458303°; Longitude: -79.294683°).

To mitigate for permanent impacts to PSS and PFO wetlands, Texas Eastern intends to purchase off-site mitigation credits.

EROSION AND SEDIMENT CONTROL

 The following parties have applied for Erosion and Sediment Control Permits for earth disturbance associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities.

 Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

ESG831120001-00. The Department of Environmental Protection (Department) provides notice of receipt of an application for a Chapter 102, Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities. The application is currently under technical review for the Conemaugh River Crossing Project.

 This authorization is required for earth disturbance activities associated with oil and gas exploration, production, processing or treatment operations or transmission facilities when earth disturbance is five acres or greater. Review of this application is being coordinated among the Department and the associated county conservation districts.

PUBLIC COMMENTS FOR WATER OBSTRUCTIONS AND ENCROACHMENTS, STATE WATER QUALITY CERTIFICATION AND EROSION AND SEDIMENT CONTROL

 A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department office during the 30-day public comment period.

 Following the 30-day comment period, the program manager from the appropriate Department office will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to United States Court of Appeals for the 3rd Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790.

PUBLIC NOTICE OF APPLICATION AND DRAFT STATE WATER QUALITY CERTIFICATION FOR A FERC REGULATED PIPELINE PROJECT


Proposed State Water Quality Certification Required by the Commonwealth of Pennsylvania, Department of Environmental Protection Pursuant to Section 401 of the Clean Water Act for the Lilly Compressor Station.

WQ1183220-001. Texas Eastern Transmission, LP, 890 Winter Street, Suite 300, Waltham, MA 02451. Lilly Compressor Units Replacement Project, in Cresson Township, Cambria County, U.S. Army Corps of Engineers, Pittsburgh District. The proposed project is located at the Lilly Compressor Station situated off Texas Lane (Latitude: 40.43889°; Longitude: -78.592453°).

 On January 10, 2020, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP20-37-000). The FERC Environmental Assessment for the Project, which was issued on July 16, 2020 may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP20-37-000).

 On May 6, 2020, the Applicant requested a State water quality certification (SWQC) from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.

 The Project includes replacement of four existing compressor units and related facilities with two new gas turbine units and associated facilities to comply with future air emission reduction requirements. The Project also includes the construction of a new compressor building to house the two new compressor units. The existing compressor units are in two separate compressor buildings, both of which will be removed from service but remain in place. Additional facilities to be updated or installed include a generator building, an electrical control building with battery extension, a service entrance building, and an auxiliary building, as well as the installation of four filter separators. In addition, the project will result in the installation of a new stormwater management retention basin, The Project, as proposed, will require approximately 31.8 acres of earth disturbance. The Project also includes impacts to a stream and wetlands. Impacts include construction and maintenance of a temporary timber mat equipment bridge across a tributary to Little Conemaugh River (CWF, MF) and associated floodway and temporary impacts to 0.07 acre of PEM wetlands.

 PADEP, by this notice, is proposing to issue a SWQC to Texas Eastern Transmission, LP for the Lilly Compressor Units Replacement Project. PADEP is proposing to certify that construction, operation and maintenance of the Lilly Compressor Units Replacement complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP is proposing to further certify that the construction, operation and maintenance of the Lilly Compressor Units Replacement Project complies with Pennsylvania water quality standards and will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:

Texas Eastern Transmission, LP, 890 Winter Street, Suite 320, Waltham, MA 02451, Lilly Compressor Units Replacement Project in Cresson Township, Cambria County, U.S. Army Corps of Engineers, Pittsburgh District. The proposed project is located at the Lilly Compressor Station situated off Texas Lane (Latitude: 40.43889 °; Longitude: -78.592453°).

 The Project includes the construction and maintenance of a temporary timber mat equipment bridge across a tributary to Little Conemaugh River (CWF, MF) and associated floodway. The project will also temporarily impact 0.07 acre of PEM wetlands.

EROSION AND SEDIMENT CONTROL

 The following parties have applied for Erosion and Sediment Control Permits for earth disturbance associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities.

 Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

The Department of Environmental Protection (Department) provides notice of receipt of an application for a Chapter 102, Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities. The application is currently under technical review for the Lilly Compressor Units Replacement Project, which will consist of upgrades to the existing compressor station site. The project is located in Cresson Township, Cambria County, PA.

 This authorization is required for earth disturbance activities associated with oil and gas exploration, production, processing or treatment operations or transmission facilities when earth disturbance is five acres or greater. Review of this application is being coordinated among the Department and the associated county conservation districts.

PUBLIC COMMENTS FOR WATER OBSTRUCTIONS AND ENCROACHMENTS, STATE WATER QUALITY CERTIFICATION AND EROSION AND SEDIMENT CONTROL

 A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department office during the 30-day public comment period.

 Following the 30-day comment period, the program manager from the appropriate Department office will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to United States Court of Appeals for the 3rd Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790.
