THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should contact a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

PUBLIC WATER SUPPLY PERMITS

 The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

LAND RECYCLING AND
ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Whispering Pines Environmental Recovery LLC, 2012 Whispering Pines Lane, Duncansville, PA 16635, on behalf of Green Land Enterprises, P.O. The following significant stationary air emission sources are part of the Plan Approval: thirty-three (33) air heaters firing natural gas each rated less than 4 MMBtu/hr, seven (7) fire pumps firing diesel fuel each rated 430 HP, four (4) boilers firing natural gas each rated less than 2 MMBtu/hr, one (1) hot water heater firing natural gas rated 0.30 MMBtu/hr, and one (1) emergency generator firing diesel fuel rated 896 HP. Additionally, five (5) insignificant air heaters firing natural gas each rated 0.25 MMBtu/hr and one (1) insignificant emergency generator firing natural gas rated 49 HP are also included in the Plan Approval for facility-wide emission calculation, and they are required to follow the applicable requirements in the Plan Approval. The relevant RACT II requirements are being submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's SIP and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal; this includes the provisions of the Department's presumptive RACT II requirements in accordance with 25 Pa. Code § 129.97, as they apply to existing sources at this facility. The following is a summary of the proposed amendments to the RACT II determination for this facility that will be submitted to the EPA as a SIP revision:

 The City of Philadelphia, Air Management Services (AMS) issued on 01/23/2020 a renewal Title V/State Operating Permit for the following facility:

OP16-000039: Vicinity Energy Philadelphia (formerly known as Veolia Energy Philadelphia)—Schuylkill Station (2600 Christian Street, Philadelphia, PA 19146) for the operation of boilers and parts degreasing stations at a steam generating facility in the City of Philadelphia, Philadelphia County. The facility's air emission sources include a tangential fired boiler rated 795 MMBtu/hr that uses No. 6 oil as primary fuel and No. 2 oil for ignition, a front wall fired boiler rated 761 MMBtu/hr that operates on No. 6 oil and natural gas, and three parts degreasing stations that use non-halogenated solvents. The facility is a major source of Nitrogen Oxides (NOx). The issued Title V/State Operating Permit incorporates a change of ownership from Veolia Energy Philadelphia to Vicinity Energy Philadelphia. The intent to issue the Title V/State Operating Permit was published on December 7, 2019 in the Pennsylvania Bulletin under Veolia Energy Philadelphia—Schuylkill Station.

 The City of Philadelphia, Air Management Services (AMS) issued on 01/27/2020 a revision of the Title V/State Operating Permit for the following facility:

OP18-000028: The Children's Hospital of Philadelphia (3401 Civic Center Boulevard, Philadelphia, PA 19104), which is a revision for the Title V/State Operating Permit (V14-015) that was issued on March 5, 2018, for the operation of boilers, peak-shaving generators, emergency generators, and fire pump at a hospital facility in the City of Philadelphia, Philadelphia County. The facility's air emission sources include the following:

 • Thirteen (13) boilers firing natural gas and No. 2 oil, of which three (3) rated 20.922 MMBtu/hr, one (1) rated 10.461 MMBtu/hr, seven (7) rated 32.659 MMBtu/hr, and two (2) rated 30.615 MMBtu/hr.

 • Four (4) peak-shaving generators with oxidation catalysts firing natural gas each rated 1085 HP.

65-00181: Chestnut Ridge Foam, Inc. (443 Warehouse Drive, P.O. Box 781, Latrobe, PA 15650), Synthetic Minor Operating Permit on January 22, 2020, the Department of Environmental Protection (DEP) authorized a synthetic minor State-Only operating permit for a specialty foam manufacturing facility located in Derry Township, Westmoreland County. The facility was previously designated as a Title V facility and has elected to take a facility-wide emissions limit not to equal or exceed 50.0 TPY VOC to become a synthetic minor. The permit also includes Reasonably Available Control Technology (RACT II) requirements for this facility in accordance with 25 Pa. Code §§ 129.96—129.100. The permit includes emission limits, operating requirements, monitoring requirements, recordkeeping requirements, and work practice standards for the site to ensure that the facility complies with all applicable Federal and State air quality regulations.

24-00119: Advanced Heat Treating (1057 Trout Run Rd, Saint Marys, PA 15857), on January 22, 2020, the Department issued the renewal of the State-Only Operating Permit of a metal heat treating facility located in Saint Marys City, Elk County. Permitted air contamination sources are two tempering furnaces, five draw furnaces, and miscellaneous natural gas usage. Several tempering and draw furnaces are subject to requirements established through PA 24-119B. In this renewal, three tempering furnaces no longer operated are removed from the operating permit.

The Minor Modification of State Only Operating Permit is issued under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code § 127.462. The modification addresses a change to the Responsible Official, change to fuel type in the three (3) existing boilers from No. 4 oil to No. 2 fuel oil, and add No. 2 fuel oil to one of the boilers. The requirements of 40 CFR Part 60 Subpart Dc and 40 CFR Part 63 Subpart JJJJJJ now apply to Boiler 4 (Source ID B08), which was previously a natural gas-fired only boiler. The modified permit will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

46-00013: Clemens Food Group (aka Hatfield Quality Meats, Inc.) (2700 Clemens Rd., Hatfield, PA 19440-0902). On January 27, 2020 an Administrative Amendment of Title V Operating Permit for this facility is issued under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code § 127.450 to incorporate the requirements of two (2) plan approvals into the operating permit for a facility located in Hatfield Township, Montgomery County.

 46-0013E was previously issued for the replacement of existing control devices on the sludge dryer at the wastewater treatment plant (WWTP) with new venturi scrubber and new packed tower scrubber. Plan Approval 46-0013F was previously issued for the replacement of existing control devices at the Rendering Plant with a new venturi scrubber and a packed tower scrubber, as well as to permit the change of the packing material for an existing control device (packed tower scrubber—Source ID: C02).

 The amended Title V Operating Permit will contain monitoring, recordkeeping, reporting and work practice standards to keep the facility operating within all applicable air quality requirements.

09-00222: Telex Metals, LLC (105 Phyllis Drive, Croydon, PA 19021). On January 23, 2020 a Minor Operating Permit Modification is issued under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code § 127.462 to State Only (Natural Minor) Operating Permit No. 09-00222 for its metal refining facility, which is located in Bristol Township, Bucks County. The Minor Operating Permit Modification authorizes changing the hydrochloric acid (HCl) removal efficiency (99%) and outlet HCl emission concentration (0.1 ppmv) restrictions for the HCl metal refining line and associated packed tower wet scrubber to an HCl emission rate restriction of 150 lbs/yr.

06-03164: Sunoco Pipeline, L.P.—Beckersville Pump Station (536 Alleghenyville Road, Mohnton, PA 19540). Pursuant to 25 Pa. Code § 127.449(i), this Pennsylvania Bulletin Notice is for a de minimis emissions increase of 0.01 tpy NOx, 0.02 tpy CO and 0.07 tpy VOC resulting from the replacement of the existing 8-inch pig receiver with a new pig receiver not to exceed 20-inches in size at the Beckersville Pump Station located in Brecknock Township, Berks County. This is the second de minimis emissions increase at the facility during the term of the current operating permit.
