FEDERAL WATER POLLUTION
CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

 Any person aggrieved by these actions may appeal, pursuant to section 4 of the Environmental Hearing Board Act, 35 P.S. § 7514, and the Administrative Agency Law, 2 Pa.C.S.  To perform the following water obstruction and encroachment activities within Jacob Reiff Park along approximately 315 linear feet of West Branch of Skippack Creek and tribs (Perennial, TSF):

 1. Streambank Restoration (315 feet West Branch)—Plantings (live stakes) are proposed along a portion of the West Branch of Skippack Creek to help alleviate erosion of the streambank. As part of the restoration, rip-rap will be placed (hand placed) below the normal water elevation.

 2. Floodplain Reconnection—A portion of the streambank will be lowered to allow water to overflow during higher flows into a shallow ponding area. The ponding area will be planted with a mix of both native wetland seed mix and live stakes. This will allow for a reconnection of the floodplain in this area and a slowing of floodwaters. In the event of high flow events, a stabilized overflow will allow for water to re-enter the stream.

 3. Re-establish Tributary Channel (Tributary No. 1) (390 feet)—An existing tributary channel is located to the east of the proposed ponding area and conveys flow from a 36" CMP located in Quarry Road. The project includes the re-establishment and stabilization of this tributary.

 4. Tributary Erosion Control—Tributary (energy dissipator—R-5 rip-rap)—An additional tributary is located to the north of the proposed ponding area and conveys flow from an 18" HDPE pipe also located in Quarry Road. A rip-rap apron is proposed. Additionally, the rip-rap apron will act as a level spreader to convert the concentrated channel flow into sheet flow.

 The Jacob Reiff Park site is located near the intersection of Quarry and Upper Mainland Roads in Lower Salford Township, Montgomery County (Collegeville USGS Quadrangles, Latitude 40.241728 N"; Longitude—75.380698 W").

 2. To remove the existing Southbound-Eastbound structure and to construct and maintain a 4-span composite steel plate girder bridge having a span of 63-foot and an underclearance of 76.3-foot over Roaring Brook (HQ-CWF, MF) (waterway WW-232; SB/EB Sta 637+42.15).

 3. To remove the existing slope pipe and construct and maintain a slope pipe conveying 471 l.f. of a tributary Roaring Brook (HQ-CWF, MF) (waterway WW-230; SB/EB Sta 634+00).

 4. To remove the existing structure and restore approximately 194 l.f. of natural channel of a tributary Roaring Brook (HQ-CWF, MF) (waterway WW-239; NB/WB Sta 640+50 Rt).

 5. To remove the existing structure and to construct and maintain 31 l.f. of 30" RCP stream crossing carrying Northbound-Westbound I-84 over a tributary Roaring Brook (HQ-CWF) and to extend the existing stream enclosure an additional 69 l.f. of 30" RCP pipe for a total enclosure length of approximately 175 l.f. (WW-239; NB/WB Sta 639+95- SB/EB Stat 638+04)

 6. The project also proposes to install rock apron outlet protection in various locations impacting approximately 74 l.f. of tributary Roaring Brook (HQ-CWF, MF) (waterways WW-238, WW-239, WW-249, WW-239, WW-236).

 The project also includes the impacts to PEM wetlands totaling 0.12 acre due to roadway realignment and widening. The permittee is required to provide 0.12 acre of replacement wetlands.

 The project is located along Interstate 84 Section 282 (Olyphant, PA Quadrangle, Latitude: 41° 23` 33.7" N; Longitude: -75° 35` 1.9"W) in Dunmore Borough & Roaring Brook Township, Lackawanna County.

 The project includes a cumulative permanent impact of 1.701 acre1 of PEM wetlands, 754 linear feet of watercourse, and 1.057 acre of floodway. Temporary cumulative impacts, for which minimization and restoration shall be implemented, are 0.075 acre of wetlands, 177 linear feet of watercourse, and 0.404 acre of floodway. The applicant has offered compensatory mitigation for permanent impacts to Regulated Waters of this Commonwealth incurred with project construction. The design objectives of the compensatory mitigation are water quality improvement and wetland creation through the construction, operation and maintenance of a new abandoned mine drainage abatement system. The passive system will capture and treat acid mine drainage from a tributary of Camp Hope Run (UNTCHR-04), and the effluent from the system will be used to create 2.2 acres of new wetlands along Camp Hope Run. The Camp Hope Run Landfill and ancillary water pollution control facilities are located along the western right-of-way of SR 0153 approximately 2.1-miles north of the SR 2012/0153 intersection. *Listed impacts for SB-2 and SB-4 (POW wetlands) are waived of compensatory mitigation requirements under § 105.12(a)(6).

 The applicant will expand the Houtzdale oil and propane business along SR 53 in Woodward Township. The project will result in 0.151 acre of permanent wetland impact.  To construct, operate and maintain approximately 5.6-miles (29,568 ft) of one (1) 8-inch diameter and one (1) 12-inch diameter flex steel natural gas pipeline in McIntyre Township—Lycoming County. Additionally, a 16-inch diameter temporary above ground waterline (TAGWL) will be installed aerially. The pipeline will be placed via open cut trenching within the existing ROW. The purpose of this project is to provide a conveyance of low-pressure natural gas between the Bodine Mountain Compressor & Mountain Meadow Pad B.

 The project will result in a total of 64 LF (770 SF) of permanent and 743 LF (6,423 SF) of temporary stream impacts, 7,854 SF (0.1803 acre) of permanent and 67,031 SF (1.5388 acre) of temporary floodway impacts and 14,723 SF (0.3380 acre) of permanent and 10,464 SF (0.2402 acre) of temporary wetland impacts all for the purpose of constructing a natural gas pipeline for Marcellus well development.

Environmental Remediation & Recovery, Inc., 4250 Route 6N, Edinboro, PA 16412, on behalf of FirstEnergy Corp, 800 Cabin Hill Drive, Greensburg, PA 15601 submitted a Remedial Action Plan concerning remediation of groundwater contaminated with benzene, ethylbenzene, isopropyl-benzene, methyl tert-butyl ether, naphthalene, toluene, 1,2,4-trimethylbenzene, 1,3,5-trimethylbenzene, xylenes. The Remedial Action Plan was acceptable to meet the Statewide Health Standard and was approved by DEP on January 28, 2020.

 Notice is hereby given that the Pennsylvania Department of Environmental Protection (DEP) has received a request from Chesapeake Energy Corporation to waive the 330-foot setback as required by the Oil and Gas Conservation Law (OGCL) (58 P.S. §§ 401—419) regarding the MTL 6HC Well borehole, API No. 015-23541 located in Wyalusing and Tuscarora Townships, Bradford County. The Notice is also given that the DEP will conduct a public hearing for this waiver on Wednesday, February 26, 2020 beginning at 6:00 P.M.—7:30 P.M. at the Wyalusing Township Office, 2473 Old Stagecoach Rd., Wyalusing, PA 18853.

 Chesapeake Energy is proposing to drill the MTL 6H Well which will penetrate the Onondaga formation, therefore the wellbore is subject to the OGCL and 25 Pa. Code Chapter 79. A well subject to the OGCL must be at least 330 feet from the nearest outside boundary line of the lease on which it is located, or if the lease is included in a voluntary unit, the well must be located 330 feet from the nearest unit line. The 330-foot setback applies to the entire length of both the vertical and horizontal well bore.

 Section 406(a) of the OGCL and 25 Pa. Code § 79.11(b) allows an applicant to submit a request to waive the 330-foot setback in their application for a well permit. The public hearing will be held for the purpose of DEP accepting testimony on the above proposed 330-foot waiver request. The public hearing is scheduled as follows:

Invitation for Bids to Perform Mine Drainage Treatment System O&M under Act 181 of 1984

 The Department of Environmental Protection is soliciting interest and bids for a five (5) year contract to operate and maintain mine drainage treatment systems in Centre, Clearfield, Clinton and Sullivan Counties, Pennsylvania. The scope of work focuses on one chemical treatment facility in Burnside Township, Centre County (Site 1) and one chemical treatment facility in Morris Township, Clearfield County (Site 2). Secondary focus is nine (9) passive treatment systems located in Center, Clearfield, Clinton and Sullivan Counties (Site 3).

 A mandatory pre-bid meeting will be conducted on Wednesday, February 26, 2020 at 9:00 AM at the Pine Glen treatment facility entrance road, intersection of SR-0879 (Pine Glen Road) and Short Dog Lane, Burnside Township, Centre County, Latitude: 41° 03` 41.34" Longitude: 78° 01` 37.87" (41.061483, -78.027186). Attendance (or a prior conference) is mandatory to place a bid for this contract.
