STATE CONSERVATION COMMISSION

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling (717) 787-8821.

 Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30-days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based.  Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.

PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Sections 302, 303, 304 and 305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent (NOI) to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a (NOI) to Remediate with the Department. A NOI to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified person, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

Ross Residence, 1300 Colwell Lane, Plymouth Township, Montgomery County. Richard D. Mechanicsburg North Petroleum Storage Terminal, 127 Texaco Road, Mechanicsburg, PA 17050, Silver Spring Township, Cumberland County. Arcadis, Inc., 10 Friends Lane, Newtown, PA 18940, on behalf of Chevron Environmental Management Company, 1500 Louisiana Street, # 38134, Houston, TX 77002, and Lucknow Highspire Terminals, LLC, P.O. Box 2621, Harrisburg, PA 17105, submitted a Notice of Intent to Remediate site soil and groundwater contaminated with historical releases of lead, volatile and semi-volatile organic compounds. The site will be remediated to the Site-Specific and Residential Statewide Health Standards. Future use of the site will continue as a bulk-fuels storage and distribution facility. The Notice of Intent to Remediate was published in The Sentinel on January 27, 2020.

Northwest Region: Environmental Cleanup & Brownfields Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

Thermoclad, 4690 Iroquois Avenue, Harborcreek Township, Erie County. Environmental Remediation & Recovery, Inc., 4250 Route 6N, Edinboro, PA 16412, on behalf of Iroquois Avenue, LLC, 4250 Route 6N, Edinboro, PA 16412, submitted a Notice of Intent to Remediate. A localized area of soil containing Volatile Organic Compounds, was excavated and removed off-site. Arsenic is present in soils in the former ballfield area. The Notice of Intent to Remediate was published in the Erie-Times News on February 4, 2020.

AIR QUALITY

PLAN APPROVAL AND OPERATING
PERMIT APPLICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.

 Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate Department Regional Office.

 Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

The Department received a Plan Approval application on 12/16/2019 for the construction and operation of the Shamokin Dam Station, a 1,200-Megawatt natural gas powered Combined Cycle Electricity Generating plant to be located in Shamokin Dam Borough, Snyder County.


Intent to Issue Plan Approvals and Intent to Issue or Amend Operating Permits under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B. These actions may include the administrative amendments of an associated operating permit.

15-0041E: Eastern Shore Natural Gas Company—Daleville Compressor Station (604 Street Rd., Cochranville, PA 19330) to revise a testing requirement condition requiring compliance with the proposed minimum destruction efficiency for CO, VOC and HCHO for the existing natural gas-fired reciprocating internal combustion engine for a natural gas compressor at their facility in Londonderry Township, Chester County.

 The facility is a State-Only, Synthetic Minor facility. The existing permit limits the emissions of nitrogen oxides (NOx) and volatile organic compounds (VOC) from the facility to less than or equal to 24.9 tons per year on a 12-month rolling sum basis.

 The provisions of this plan approval will subsequently be incorporated into a State Only Operating Permit through an administrative amendment in accordance with 25 Pa. Code § 127.450. The Plan Approval will contain recordkeeping requirements and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

15-0009E: AGC Chemicals Americas, Inc. (255 South Bailey Road, Downingtown, PA 19355) to allow for an increase in emissions of dipropylene glycol n-butyl ether (DPnB) from 0.42 lb/hr to 0.63 lb/hr and to modify a test condition. AGC operates under a Non-Title V Facility, State-Only, Synthetic Minor Permit in Caln Township, Chester County. The plan approval will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

23-0119E: Sunoco Partners Marketing & Terminals, L.P. (SPMT) (100 Green Street, Marcus Hook, PA 19061-0426) for the reevaluation of all projects related to the natural gas liquids (NGLs) processing, storage, and distribution operations at its existing Title V facility located in Marcus Hook Borough, Delaware County, as a single aggregated project, as ordered by the Environmental Hearing Board in its remand of the original Plan Approval No. 23-0119E, to determine the applicability of Prevention of Significant Deterioration of Air Quality (PSD) and New Source Review (NSR) requirements. The projects comprising the single aggregated project were previously permitted or authorized under the following authorizations:

 • Plan Approval No. 23-0119 (originally issued February 5, 2013).

 • Plan Approval No. 23-0119A (originally issued September 5, 2013).

 • Plan Approval No. 23-0119B (originally issued January 30, 2014).

 • Plan Approval No. 23-0119C (originally issued November 19, 2014).

 • Plan Approval No. 23-0119D (originally issued February 26, 2015).

 • Plan Approval No. 23-0119E (originally issued April 1, 2016).

 • Plan Approval No. 23-0119F (originally issued August 15, 2016; only for the storage tanks previously permitted under Plan Approval No. 23-0119B).

 • Plan Approval No. 23-0119J (pending; see corresponding notice in this section of the Pennsylvania Bulletin for further discussion).

 • Particulate Matter [PM]: 10.64 tons/yr

 • PM less than 10 µm in aerodynamic diameter [PM10]: 10.44 tons/yr

 • PM less than 2.5 µm in aerodynamic diameter [PM2.5]: 8.60 tons/yr

 • Sulfur oxides [SOx] (all SOx also treated as sulfur dioxide [SO2]): 1.22 ton/yr

 • Sulfuric Acid Mist [H2SO4],: 0.0676 ton/yr

 • Volatile organic compounds [VOCs]: 169.08 tons/yr

 As the facility is an existing major stationary source, in accordance with 40 CFR 52.21(a)(2)(iv), the Pennsylvania Department of Environmental Protection (DEP) has performed a two-step PSD analysis to determine whether the single aggregated project constitutes a major modification for the following pollutants: CO, CO2e, H2SO4, NO2, Pb, PM, PM10, PM2.5, and SO2. A project is a major modification and subject to PSD requirements if it causes both a significant emission increase and a significant net emissions increase of any of these pollutants (i.e., Steps 1 and 2, respectively), except that GHGs do not trigger a major modification on their own.

 Based on the emissions increases of CO, CO2e, H2SO4, NO2, Pb, PM, PM10, PM2.5, and SO2 for the respective sources and equipment comprising the aggregated project, DEP has determined that the aggregated project causes a significant emission increase of CO, CO2e, and NO2.

 After summing these significant emissions increases with other contemporaneous increases and decreases in actual emissions, DEP has determined that the single aggregated project causes a significant net emission increase of CO2e only. Therefore, the single aggregated project is not subject to PSD requirements.

 In addition, in accordance with 25 Pa. Code §§ 127.203a and 127.203(b)(1)(i), DEP has performed an NSR analysis to determine whether the aggregated emissions increases of NOx or VOCs (i.e., the sum of the emissions increases due to the single aggregated project and the other increases in net emissions occurring over a consecutive 5 calendar-year period), exceed 25 tons/yr.

 DEP has determined the aggregated emissions increases of NOx and VOCs to be the following:

 • NOx: 67.73 tons/yr

 • VOCs: 177.02 tons/yr

 Therefore, DEP has determined that the single aggregated project is subject to NSR requirements for both pollutants, including requirements to obtain emissions offsets and implement Lowest Achievable Emission Rate (LAER) pursuant to 25 Pa. Code § 127.205. In accordance with 25 Pa. Code §§ 127.201(f) and 127.210, SPMT is required to obtain emissions offsets at the offset ratio of 1.3:1. Based on the required offset ratio, SPMT is required to obtain and surrender 88.05 tons of NOx Emission Reduction Credits (ERCs) and 230.13 tons of VOC ERCs for the single aggregated project. SPMT has previously surrendered, and DEP has previously retired, 32.80 tons of NOx ERCs and 131.69 tons of VOC ERCs under previously-issued Plan Approvals for certain sources and equipment under the single aggregated project. Therefore, to fully offset the aggregated emissions of NOx and VOCs, SPMT is required to obtain and surrender an additional 55.25 tons of NOx ERCs and 98.44 tons of VOC ERCs for the single aggregated project. Of these ERC amounts, SPMT shall obtain and surrender 55.25 tons of NOx ERCs and 48.92 tons of VOC ERCs under revised Plan Approval No. 23-0119E, and 49.52 tons of VOC ERCs under Plan Approval No. 23-0119J (see notice for Plan Approval No. 23-0119J in this section of the Pennsylvania Bulletin for further discussion).

 The revised Plan Approval No. 23-0119E will incorporate the applicable terms and conditions of previously-issued Plan Approvals No. 23-0119 through 23-0119F. In addition, the revised Plan Approval No. 23-0119E will include all other monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements, including those specified as follows to meet LAER:

 • The leak detection and repair (LDAR) requirements indicated in the Texas Commission on Environmental Quality's 28LAER program and, to the extent that they are more stringent, those indicated in 40 CFR Part 60, Subpart VVa.

 • VOC destruction and removal efficiency restrictions of 98% for the West Cold Flare and East Cold Flare.

 • A requirement that SPMT install a secondary seal on the internal floating roof of Tank 609.

(SPMT) (100 Green Street, Marcus Hook, PA 19061-0426) for the installation and operation of two new 600,000-barrel refrigerated ethane storage tanks; a new amine treatment system; a new dehydration train system; two new demethanizers; two new refrigeration systems; two new wet surface air cooling systems; a new elevated, air-assisted Project Phoenix Cold Flare; and all associated piping and components at its existing Title V facility located in Marcus Hook Borough, Delaware County.

 The proposed emissions from this project are as follows:

 • Carbon monoxide [CO]: 29.19 tons/yr

 • Greenhouse gases (GHG) [CO2e]: 29,223 tons/yr

 • Lead [Pb]: 3.63 × 10-6 tons/yr

 • Nitrogen oxides [NOx] (all NOx also treated as nitrogen dioxide [NO2]: 10.08 tons/yr

 • Particulate matter [PM]: 1.28 ton/yr

 The fugitive emissions components associated with this project that are ''in VOC service'' are subject to the Standards of Performance for New Stationary Sources (NSPS) for Equipment Leaks of VOC in the Synthetic Organic Chemicals Manufacturing Industry for Which Construction, Reconstruction, or Modification Commenced After November 7, 2006 [40 CFR Part 60, Subpart VVa]. In addition, the refrigerated ethane storage tanks are subject to the NSPS for Volatile Organic Liquid Storage Vessels (Including Petroleum Liquid Storage Vessels) For Which Construction, Reconstruction, or Modification Commenced After July 23, 1984 [40 CFR Part 60, Subpart Kb].

 DEP has performed two separate evaluations for this project to determine whether it is subject to Prevention of Significant Deterioration of Air Quality (PSD) and/or New Source Review (NSR) requirements, as follows:

 • This project as a stand-alone project.

 • Pursuant to the remand of Plan Approval No. 23-0119E, this and all other projects related to the natural gas liquids (NGLs) processing, storage, and distribution operations at the facility previously permitted or authorized under other Plan Approvals, Requests for Determination, or de minimis emissions increases, as a single aggregated project (see notice for revised Plan Approval No. 23-0119E in this section of the Pennsylvania Bulletin for further discussion).

 DEP has determined that this project is not subject to PSD requirements (under both evaluations). DEP has determined that this project is subject to NSR requirements for NOx (under the evaluation as a single aggregated project) and VOCs (under both evaluations), including requirements to obtain emissions offsets and implement Lowest Achievable Emission Rate (LAER) pursuant to 25 Pa. Code § 127.205. In accordance with 25 Pa. Code §§ 127.201(f) and 127.210, SPMT is required to obtain emissions offsets at the offset ratio of 1.3:1. IP19-000615: University of the Arts (320 S. Broad St., Philadelphia, PA 19102) for the installation of air pollution sources at a private university, in the City of Philadelphia, Philadelphia County. The following significant stationary air emission sources are part of the Plan Approval: three (3) boilers firing natural gas each rated less than 4 MMBtu/hr, six (6) hot water heaters firing natural gas each rated less than 1 MMBtu/hr, and three (3) emergency generators, of which one (1) firing natural gas rated 315 BHP, and two (2) firing diesel fuel rated 114 HP and 435 HP. Additionally, four (4) insignificant fire pumps firing diesel fuel each rated less than 100 HP, five (5) insignificant hot water heaters firing natural gas each rated less than 0.2 MMBtu/hr and two (2) insignificant emergency generators, one (1) firing natural gas and one (1) firing diesel fuel, each rated less than 100 HP, are also included in the Plan Approval for facility-wide emission calculation, and they are required to follow the applicable requirements in the Plan Approval. The plan approval will contain operating, monitoring, and recordkeeping requirements to ensure operation within all applicable requirements.

36-05146D: EPP Renewable Energy, LLC (3049 River Road, Conestoga, PA 17516) for the recommissioning of the Source ID # 201 landfill gas-fired engine at the EPP Renewable Energy LLC landfill gas-to-energy plant at the Frey Farm Creswell Landfill located in Manor Township, Lancaster County. The expected change in facility emissions as a result of the change will be an increase in potential emissions of 21.5 tons of NOx, 66.7 tons of CO, 21.5 tons of SOx, 9.3 tons of PM10, 3.3 tons of VOCs, and 8.1 tons of Formaldehyde. The plan approval will include emission limits and work practice standards along with monitoring, recordkeeping, testing, and reporting requirements to ensure the facility complies with the applicable air quality regulations. DEP's review of the information submitted by the applicant indicates that the air contamination sources as recommissioned will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirements (BAT) of 25 Pa. Code §§ 127.1 and 127.12 and 40 CFR Part 60 Subpart XXX—Standards of Performance for Municipal Solid Waste Landfills That Commenced Construction, Reconstruction, or Modification After July 17, 2014. Based on these findings, the Department proposes to issue a plan approval for the proposed recommissioning of the engine. After the project has been implemented, if DEP determines that the source is operating in compliance with the plan approval conditions and the specifications of the application for plan approval, the requirements established in the plan approval will be incorporated into the facility's operating permit pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.

36-03137: NESL Martin Limestone Co., Inc.  To authorize a previously completed private driveway crossing of Cold Run (HQ-CWF, MF) consisting of a 6`-5" by 4`-7" galvanized pipe arch culvert depressed 6-inches below the existing streambed elevation with upstream and downstream wingwalls.  To remove existing structure and to install and maintain a (1) 61.4 linear foot 12-foot × 5-foot box culvert with 1-foot uniform depression in UNT Sweet Root Creek (HQ-CWF, MF). The project proses to permanently impact 72 feet of stream channel with 177 feet of temporary impacts. There is 0.002 ac of permanent wetlands (EV) impacts. This is all for the purpose of improving transportation safety and roadway standards. The project is located in Southampton Township, Bedford County (39.8279°, -78.5057°).

 1. Construct and maintain two (2) 8" PVC sewer line crossings under Dunlap Creek (WWF) via directional bore,

 3. Construct and maintain six (6) 8" PVC sewer line crossings under six (6) PEM wetlands via open trench.

 4. Construct and maintain one pump station within the 100-year floodplain of Dunlap Creek.

 For the purpose of constructing a sewerline extension. The project will result in approximately 80 LF of permanent impacts and approximately 110 LF of temporary impacts to Dunlap Creek and unnamed tributaries to Dunlap Creek, approximately 4.6 acres of temporary impacts and approximately 2.0 acres of permanent impacts to PEM wetlands, and approximately 0.17 acre of temporary impact and approximately 0.05 acre of permanent impacts to the 100-year floodplain. Mitigation will include restoring the areas disturbed by the utility line crossing back to original condition and elevation and stabilizing these disturbed areas. The project includes a number of new sewer lines, starting approximately 500 feet northeast of the intersection of Keeny Row and Tower Hill Road (Quadrangle: Carmichaels, PA, Latitude 39° 57` 11"; Longitude: -79° 52` 43"), and ends approximately 500 feet southeast of the intersection of Filbert Orient and Paradise Lake Road at the Filbert pump/treatment station (Quadrangle: Salem, PA, Latitude: 39° 57` 23"; Longitude: -79° 51` 39"), Redstone Township, Fayette County.

 To amend the existing permit to construct Phase II of the Robinson Fork Mitigation Bank. Phase II consists of restoration, enhancement and conservation activities within approximately 122.83 acres of the Robinson Fork watershed, immediately adjacent to Robinson Fork Mitigation Bank—Phase I. These activities would include activities affecting uplands, floodplains, stream channels and wetland areas of the Robinson Fork watershed; including the main stem of Robinson Fork, Beham Run tributary and numerous unnamed tributaries.

 The project proposal consists of the following activities: Wetland resources—enhancement of 0.57 acre, re-establishment of 9.61 acres, and rehabilitation of 0.68 acre. An additional 0.02 acre of existing wetlands will be protected under the overall site protection instruments. Riverine and floodplain resources—Restoration of 13,323.86 linear feet of the stream and floodplain, rehabilitation of 1,759.43 linear feet of the stream channel and floodplain, enhancement of 15,447.73 linear feet of stream channel and floodplain and 5,454.24 linear feet of stream channel and floodplain protected under the overall site conservation easements. Upland resources—107.19 acres will be protected under the overall site conservation easements. Some of the areas will involve vegetation habitat management, invasive plant species control and vegetative plantings. The project may provide compensatory mitigation credits through the applicant's existing permit MB9915-0001. This application is being jointly evaluated as a mitigation bank by the Army Corps of Engineers under the 2008 Mitigation Rule.
