NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 The exemption from the requirement to revise the Official Plan for the Pleasant Hill Lot 42 subdivision, DEP Code No. A3-06965-133-3E, APS Id 1035555, consisting of two new modular homes with flows of 400 gallons per day using Pleasant Hill MHP private sewers, and the Tilden Township and Hamburg Municipal Authority system, is disapproved. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 • Actual hours of outdoor cutting operations shall not exceed 850 hours per year and record of actual hours of operation shall be kept per 40 CFR Part 63 Subpart ZZZZ.

 • Cutting shall be performed indoors in the Steel Yard Building when feasible.

 • A record of material throughput shall be kept at site clearly showing tons of material received; tons of material shipped from facility; and actual hours of indoor and outdoor torch cutting at the facility on a 12-month rolling basis.

 • The owner or operator shall use water sprays or other control techniques on as needed basis to prevent fugitive emissions from becoming airborne.

 The Pennsylvania Department of Transportation (PennDOT District 6-0) is proposing to construct a new roadway connection associated with the Sumneytown Pike/S.R. 309 Connector Project: Section HT2 and is part of the overall S.R. Connector Project which includes Section HAT completed in 2012 and future construction of HT3 in Bucks County. Section HT2 water obstruction and encroachment activities are as follows:

 1. To remove a 100-foot long, 48-inch RCP stream enclosure carrying an unnamed tributary to Skippack Creek (TSF-MF, SCT2) and in its place, construct and maintain a 132.5-foot long, 66-inch diameter RCP stream enclosure plus distilling basin resulting in 157.5 linear feet (499 square feet) of permanent watercourse impact. This activity also includes the placement of riprap apron, grading, temporary bypass, grading to construct new roadway and embankment, perform a stream relocation with the construction and maintenance of regenerative step pools associated with the outfall of a storm- water facility, and the construction and maintenance of three outfalls with riprap aprons. These activities will result in an additional 308 linear feet (2,227 square feet) of permanent watercourse impact, 43 linear feet (327 square feet) of temporary watercourse impact, 9,940 square feet (0.229 acre) of permanent floodway impact and includes the construction and maintenance of clay blocks, and 9,637 square feet (0.221 acre) of temporary floodway impact due to construction access. Impacts to a wetland area (PEM, Wetland 3A) include 194 square feet (0.005 acre) of permanent wetland impact due to stream restoration and clay blocks and 293 square feet (0.006 acre) of temporary wetland impact due to construction access (USGS PA Telford Quadrangle—Latitude: 40.277159 N, Longitude: 75.75.332107 W).

 2. To place fill, riprap, and perform grading to facilitate the construction and maintenance of a stormwater facility within the floodway of an unnamed tributary to Skip- pack Creek (TSF-MF, SCT2) resulting in 4,676 square feet (0.107 acre) of permanent floodway impact and 4,652 square feet (0.107 acre) of temporary floodway impact due to construction access (USGS PA Telford Quadrangle—Latitude: 40.250209, Longitude: 75.329335 W).

 3. To temporarily disturb 22 square feet of floodway associated with an unnamed tributary to Skippack Creek (TSF, SCT2) due to construction access for a proposed stormwater facility (USGS PA Telford Quadrangle—Latitude: 40.250209, Longitude: 75.329335 W).

 4. To place fill and perform grading within wetland areas (PEM, wetland 5 and 5a) associated with the roadway construction and proposed stormwater facilities resulting in 4,398.2 square feet (0.101 acre) of permanent wetland impact and 772.2 square feet (0.017 acre) of temporary wetland impact. This activity also includes the placement of riprap (USGS PA Telford Quadrangle—Latitude: 40.291107 N, Longitude: 75.317485 W).

 5. To remove an existing 125-foot long, 60-inch RCP stream enclosure carrying an unnamed tributary to Skippack Creek (TSF, SCT3, Culvert # 1), and in its place, construct and maintain a 77-foot long, 7-foot by 7-foot precast concrete box culvert resulting in 146 linear feet (483 square feet, 0.018 acre) of permanent water- course impact which includes riprap toe protection and 310 linear feet (2,864 square feet, 0.065 acre) of temporary watercourse impact due to temporary culvert bypass and dewatering operation. Other impacts associated with this activity are 379 square feet (0.009 acre) of permanent floodway impact due to placement of riprap for the culvert with apron for an adjacent 18-inch outfall and 8,133 square feet (0.187 acre) of temporary floodway impact with 719 (0.017 acre) of temporary wetland impact (PFO, Wetland 6) due to construction access (USGS PA Telford Quadrangle—Latitude: 40.294352 N, Longitude: 75.313755 W).

 6. To place fill and perform grading associated with roadway construction within the floodway of an unnamed tributary to Skippack Creek (TSF, SCT3) resulting in 13,993 square feet (0.322 acre) of permanent floodway impact and 4,987 square feet (0.115 acre) of temporary floodway impact (USGS PA Telford Quadrangle—Latitude: 40.295136 N, Longitude: 75.312633 W).

 7. To relocate and restore an unnamed tributary to Skippack Creek (TSF, SCT3) as a result of the replacement and relocation of an existing 54-inch RCP culvert (Culvert # 2) resulting in 129.5 linear feet (1,330 square feet) of permanent watercourse impact, 84 linear feet (1,120 square feet) of temporary watercourse impact due to access and dewatering operations, 224 square feet (0.005 acre) of temporary wetland impact to Wetland 7 (PEM, PFO) due to construction access, 324 square feet (0.008 acre) of permanent floodway impact, and 1,086 square feet (0.025 acre) of temporary floodway impact (USGS PA Telford Quadrangle—Latitude: 40.295251 N, Longitude: 75.312344 W).

 8. To remove an existing 82-foot long, 54-inch RCP culvert carrying an unnamed tributary to Skippack Creek (TSF, SCT3, Culvert # 2) and in its place, construct and maintain a 74-foot long, 7-foot by 7-foot precast concrete box culvert associated with the previously listed stream relocation. This activity will result in 143 linear feet (1,262 square feet) of permanent watercourse impact and 100 linear feet (985 square feet) of temporary watercourse impact due to access and dewatering operations. Additional impacts include 2,178 square feet (0.05 acre) of permanent floodway impact due to the placement of riprap and construction of roadway with 3,450 square feet (0.079 acre) of temporary floodway impact due to construction access. This activity also includes the construction and maintenance of a 36-inch outfall that discharges adjacent to the new culvert (USGS PA Telford Quadrangle—Latitude: 40.295620 N, Longitude: 75.312298 W).

 9. To construct and maintain a 24-inch outfall and place fill associated with roadway construction activities within an unnamed tributary to Skippack Creek (TSF, SCT3B) resulting in 12.4 linear feet (98 square feet) of permanent watercourse impact, 0.8 linear feet (7.7 square feet) of temporary watercourse impact, 212 square feet (0.004 acre) of permanent floodway impact, and 159 square feet (0.003 acre) of temporary floodway impact (USGS PA Telford Quadrangle—Latitude: 40.299612 N, Longitude: 75.309780 W).

 A mitigation site for total wetland impact (HAT and HT2) was constructed during the first phase in 2012 (HAT, DEP Permit No. E46-1005) with continued monitoring and maintenance.  Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. The DEP has taken action on the following plans and reports under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).

 Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports.

 A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

 The DEP may approve or disapprove plans and reports submitted. This notice provides the DEP's decision and, if relevant, the basis for disapproval.

Conemaugh River Crossing Project (Project), in Derry Township, Westmoreland County and Blacklick Township, Indiana County, Pittsburgh Corps District. The proposed project starts on the western side of the Conemaugh River in Westmoreland County within Texas Eastern's existing ROW at their existing valve site (Latitude: 40.455036°; Longitude: -79.301894°), and ends on the eastern side of the Conemaugh River in Indiana County approximately 600 feet northeast of another existing valve site (Latitude: 40.458303°; Longitude: -79.294683°).

 On June 11, 2020, the Applicant requested a state water quality certification (SWQC) from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.

 The Project, as proposed, includes the in-situ grouting and abandonment of approximately 1,275 linear feet of the existing 24-inch Line 12 pipeline, and the installation and maintenance of approximately 2,670 linear feet of replacement 24-inch pipeline. Approximately 2,330 linear feet will be replaced in-kind and approximately 340 linear feet will be construction of new 24-inch pipeline to reconnect to the existing system. The Project, as proposed, will require approximately 12.0 acres of earth disturbance, and impacts to 195 linear feet of the Conemaugh River (WWF), 0.002 ac. of floodway impacts, 1.78 ac. of temporary palustrine emergent (PEM) wetland impacts, 0.06 ac. of temporary palustrine scrub-shrub (PSS) wetland impacts, 0.03 ac. of permanent PEM wetland impacts, 0.02 ac. of permanent PSS wetland impacts and 0.10 ac. of permanent PFO wetland impacts.

 PADEP published notice of its proposed SWQC in the Pennsylvania Bulletin on August 29, 2020 (50 Pa.B. 4400) and received no comments from the public.

 PADEP certifies that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP further certifies that the construction, operation and maintenance of the Project complies with Pennsylvania water quality standards and that the construction, operation and maintenance of the Project will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:

 1. Discharge of Hydrostatic Test Water—Applicant shall obtain and comply with a National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.

 2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.

 3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management), and all other applicable regulations.

 4. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.

 5. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.

 6. Operation—At all times, Applicant shall properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 7. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals issued to ensure the project shall maintain and protect state water quality standards as required by this SWQC. The Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.

 8. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, the Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to PADEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.

 9. Correspondence—All correspondence with and submittals to PADEP concerning this SWQC shall be addressed to the Department of Environmental Protection, Regional Permit Coordination Office, Domenic Rocco, PE, Director, 400 Market Street, Harrisburg, PA 17101, RA-EPREGIONALPERMIT@pa.gov.

 10. Reservation of Rights—PADEP may modify, suspend or revoke this SWQC if (i) PADEP becomes aware of new facts about the Project that warrant such action; or (ii) PADEP determines that the Applicant has not complied with the terms and conditions of this SWQC. PADEP may require additional measures to achieve compliance with any applicable law or regulation.

 11. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.

 12. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of the SWQC shall not be affected thereby.

 The project begins on the western side of the Conemaugh River in Westmoreland County at an existing valve site (Latitude: 40.455036°; Longitude: -79.301894°), and ends on the eastern side of the Conemaugh River in Indiana County northeast of another existing valve site (Latitude: 40.458303°; Longitude: -79.294683°). The project consists of one Chapter 105 Water Obstruction and Encroachment Permit and one Chapter 102 Erosion and Sediment Control Permit. Below is the Chapter 105 permit application reviewed by the Department.

To construct, operate and maintain water obstructions and encroachments associated with the Conemaugh River Crossing Project, consisting of installation of approximately 2,670 feet of 24-inch diameter replacement Line 12 pipeline and appurtenant facilities and abandonment via grouting of approximately 1,275 feet of existing Line 12 24-inch pipeline. Approximately 1,860 feet of the pipeline will be installed via Horizontal Directional Drilling (HDD) under the Cone- maugh River. The proposed project impacts include 195 linear feet of permanent impacts to the Conemaugh River (WWF); 0.002 acre of permanent floodway impacts; 0.15 acre of permanent impacts to Palustrine Emergent (PEM), Palustrine Scrub-Shrub (PSS), and Palustrine Forested (PFO) wetlands and; 1.83 acres of temporary impacts to PEM and PSS wetlands.

 The permittee is required to compensate for the proposed project impacts by providing 0.23 acre of wetland mitigation. The permittee will purchase 0.23 acre of off-site mitigation bank credits from the approved compensatory mitigation provider.

The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included stream segments impaired for aquatic life in the watershed. The impairments addressed by this document were caused by excessive siltation due to agriculture.

 There currently are no state or Federal in-stream numerical water quality criteria for sediment. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. The proposed TMDL document sets allowable loading of sediment in the UNT Susquehanna River Watershed. The ''TMDLs'' included allocations for nonpoint sources, reserves for future point sources, as well as margin of safety factors. Nonpoint source load allocations were made for cropland, hay/pasture land, and streambank source sectors present in the watershed. Data used in establishing the TMDL were primarily generated using a water quality analysis model (Model My Watershed) made available through the Stroud Water Research Center.

 The following table shows the estimated current sediment loadings within the watershed, the prescribed ''TMDL'' values, and % reductions needed under annual average conditions.
