NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

Plan Description:

 Approval of a revision to the official plan of Franklin Township, Adams County. The project is known as Alan D. Mahone. The plan provides for a Small Flow Treatment Facility (SFTF) proposal to replace cesspools serving three mobile homes on 6.18 acres. Two of the mobile homes will be removed and replaced by a new single-family residential dwelling with total estimated sewage flows of 400 gpd. The third mobile home will be gutted of the kitchen and bedrooms in order to create a den for lounging. The bathroom in this structure will also be connected to the proposed SFTF, which will discharge to Clear Run. The proposed development is located at 3465 Old Route 30 in Franklin Township, Adams County. The Department's review of the plan revision has not identified any significant impacts resulting from this proposal. The DEP Code Number for this planning module is A3-01914-415-3s and the APS Id is 1037078. Permits for on lot sewage disposal systems must be obtained in the name of the property owner.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Final Report is intended to document remediation of the site to meet the site-specific standard.

1325 Fruitville Pike, Lancaster, PA 17601, Manheim Township, Lancaster County. ECS Mid-Atlantic, LLC, 52-6 Grumbacher Road, York, PA 17406, on behalf of Fruitville Pike Partners, 209 Pinetree Way, Lancaster, PA 17601 submitted a Remedial Investigation, Risk Assessment, Cleanup Plan and Final Report concerning remediation of site groundwater contaminated with lead. The combined Report is intended to document remediation of the site to meet the site-specific standard.

A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

09-0244: MM Metals USA, LLC (4000 Chemical Road, Plymouth Meeting, PA 19462) on June 25, 2021 for a minor modification to the plan approval for the installation of a new low-carbon ferrochrome alloy manufacturing facility to be located in Falls Township, Bucks County. Post-control Particulate Matter (PM), Volatile Organic Compound (VOC), Nitrogen Oxide (NOx), and Hazardous Air Pollutant (HAP) emissions are less than major source thresholds for the Philadelphia Metropolitan Area; the facility is classified as a Natural Minor Facility. The requirements of 40 CFR Part 63 Subpart RRR apply to the melt furnace operating as part of Aluminum Production. The melt furnace is classified as a Group 1 Furnace and is subject to the dioxins/furans-related requirements of Subpart RRR. The general opacity requirements of 40 CFR Part 63 Subpart YYYYYY apply to the plasma furnace. The minor modification addresses a change to the control device used to reduce particulate matter emissions from the ferrochrome furnace exhaust and slag tapping operations. There is no increase in facility-wide emissions from the modification, and the chromite ore dyer baghouse has sufficient capacity to handle the exhaust from the metal and slag tapping operations. The minor modification of the plan approval is issued under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code § 127.462 with additional authority from 25 Pa. Code § 127.14(c)(3). The minor modification of the plan approval includes monitoring, testing, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

15-0081B: Johnson Matthey, Inc. (1401 King Road, West Chester, PA 19386-1467) on June 23, 2021, to allow modification to the existing Vertical Wet Scrubbers, (Nitric-Scrubbers) (Source ID: C02) controlling the Acid Metal Stripping Room (source ID: 102) to ensure compliance with the allowable limits for HCI and HN03 and to require only one scrubber unit to operate at any given time, in West Whiteland Township, Chester County.
