THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended, and renewed NPDES and WQM permits, applications for permit waivers, and NOIs for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated county conservation district (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Code Chapters 91 and 92a, including links to Individual NPDES and WQM Permits, may be reviewed by generating the ''Final Actions Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Hamilton Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

This permit approved operation of an Environmental Products Division (EPD) pressure sand filtration plant and raw water intakes on Gottshall Run, Rauchtown Creek, and Falling Spring. During review of the Water Allocation Permit Application, it was determined that the Rauchtown Creek Intake was never installed. Therefore, the permit is hereby amended to remove permission to use Rauchtown Creek as a source of supply. In addition, several Special Conditions quoted outdated Chapter 109 Regulations and have been removed from the amended permit.

This permit grants Crawford Township Authority the right to withdraw a maximum of 95,000 gallons per day (gpd) from Gottshall Run and 7,000 gpd from Falling Spring, when available, with both intakes located in Crawford Township, Clinton County. A passby flow of not less than 1.015 cubic feet per second or 657,000 gpd shall always be allowed to overflow the existing Ravensburg Dam Weir.

Plan Description:

 The exemption from the requirement to revise the Official Plan for the Cynthia L. Brensinger Subdivision, DEP Code No. A3-06929-067-2E, APS Id 1042660, is disapproved. The proposed subdivision consists of one new single-family residential lot with an individual on-lot sewage disposal system. The proposed subdivision is located on Weil Road in District Township. This plan is disapproved because it does not qualify as an exemption from the requirement to revise the Official Plan. It does not qualify because the subdivision proposes the use of on-lot sewage disposal systems in an area within 1/4 mile of water supplies documented to exceed 5 PPM nitrate-nitrogen as per Chapter 71 § 71.51(b)(1)(ii), and additionally because the subdivision proposes the use of on-lot sewage disposal systems in an area within a high quality or exceptional value watershed as per Chapter 71 § 71.51(b)(1)(iii).

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

New Castle Power Station, 2189 State Route 168 South, West Pittsburgh, PA 16160, Taylor Township, Lawrence County. Civil & Environmental Consultants, Inc., 333 Baldwin Road, Pittsburgh, PA 15205 on behalf of New Castle Power, LLC, 2189 State Route 168 South, West Pittsburgh, PA 16160 has submitted a Remedial Investigation Report/Cleanup Plan concerning remediation of site groundwater contaminated with Arsenic, Iron, Lithium, Manganese, Selenium, and Sulfate. The report/plan is intended to document remediation of the site to meet the site-specific standard.

Barry Ct, Canonsburg, PA 15317-5854) on July 6, 2021, the Department of Environmental Protection issued an initial synthetic minor State-Only Operating Permit for the operation of the MarkWest Nancy Stewart natural gas compressor station located in Mount Pleasant Township, Washington County. This facility is subject to the applicable requirements of 25 Pa. Code Chapters 121—145 and the applicable Federal new source performance standards and national emission standards for hazardous air pollutants. The permit includes emission restrictions, operating requirements, monitoring requirements, work practice standards, and recordkeeping requirements for the site.

32-00408: MGK Technology Homer City Plant (57 Cooper Avenue, Homer City, PA 15478), on June 23, 2021 the Department issued a State Only Operating Permit renewal for the steel preparation, fabrication and surface coating facility located in Homer City Borough, Indiana County. Emission sources at the facility are a paint building, shot blast units, plasma machine, welding machines, dry off ovens, burn off oven, and unpaved roadways. The facility has the potential to emit: 7.92 tpy VOC, 4.4 tpy NOx, 2.81 tpy CO, 22.04 tpy PM10. The facility is a natural minor and is subject to State Regulations. The permit includes additional operation requirements, monitoring requirements, and recordkeeping requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.
