Interstate Pollution Transport Reduction; Final 2022 Ozone Season Nitrogen Oxide Emission Limits for Nonelectric Generating Units

 The Department of Environmental Protection (Department) is providing notice of the final Nonelectric Generating Unit (non-EGU) 2022 Ozone Season (OS) Nitrogen Oxide (NOx) emission limitations established under 25 Pa. Code § 145.8(d) (relating to transition to CAIR NOx trading programs).

 The Department published notice of the proposed NOx emission limitations at 52 Pa.B. 1068 (February 12, 2022) to allow for a 17-day public comment period, which closed on February 28, 2022. The Department did not receive any comments during the public comment period.

 Specifically, 25 Pa. Code § 145.8(d) establishes a non-EGU NOx Trading Program budget of 3,619 tons of NOx, less a specified adjustment amount, to serve as a Statewide OS NOx emissions cap for new and existing non-EGUs. This NOx emissions cap also applies to Clean Air Interstate Rule exempt EGUs that are subject to the NOx Budget Trading Program. If total emissions from all the units exceed the Statewide NOx emissions cap of 3,438 tons, the owners and operators of non-EGUs must comply with the NOx emission limitations established under 25 Pa. Code § 145.8(d). The final NOx emissions limitations for individual units ensure that non-EGUs in this Commonwealth continue to meet the emission limits of the NOx Budget Trading Program.

 The Statewide cap for 2021 was not exceeded. Therefore, non-EGUs do not need to purchase allowances to meet their 2021 OS NOx emission limitations established under 25 Pa. Code § 145.8(d). The NOx emissions for the 2021 OS (May through September) reported to the United States Environmental Protection Agency by the owners and operators of the affected non-EGUs are 644 tons. The Department's permanent retirement of 3,438 NOx allowances under 25 Pa. Code § 145.8(b) covers all the NOx emissions from the affected non-EGUs in 2021. Table 1, as follows, lists the final non-EGU 2022 OS NOx emission limits.

 In addition to the 3,438-ton non-EGU cap previously described, 25 Pa. Code § 145.8(d)(12) provides 181 tons of NOx emissions annually for non-EGUs and the other units that need to address their emissions through accounting adjustments, including units that previously participated in the NOx Budget Trading Program. The Department may use a portion of the 181 tons of the budgeted NOx emissions, if necessary, to address accounting mistakes or miscalculations. This year, the Department is not using any of the 181 tons of NOx for accounting adjustments or to make corrections.

 The following table, ''Final Non-EGU 2022 OS NOx Emission Limits,'' lists the following: the 'facility name,' 'ORIS code,' the 'unit ID' for each non-EGU unit, the '2021 NOx mass (tons)' or the 2021 OS emissions, the '2021 heat input (MMBtu)' for the 2021 OS, the 'county' location of the facility, the calculated '2022 rate (lbs/MMBtu)' and the '2022 OS Limit (tons NOx).'
