WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended, and renewed NPDES and WQM permits, applications for permit waivers, and NOIs for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated county conservation district (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Code Chapters 91 and 92a and Individual permits under 25 Pa. Code Chapter 102, including links to Individual Chapter 92a NPDES and WQM Permits, may be reviewed by generating the ''Final Actions Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Hamilton Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should contact a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

 For actions taken on applications for pipelines that are regulated by the Federal Energy Regulatory Commission (FERC).

 Any person aggrieved by this action may challenge it in an appropriate legal forum. The State and Federal courts are currently split on whether the proper forum to challenge a Department permit, authorization or approval for a facility or activity subject to the Federal Natural Gas Act, 15 U.S.C.A. § 717 et seq., is the United States Court of Appeals for the Third Circuit or the Pennsylvania Environmental Hearing Board. See Delaware Riverkeeper Network v. Sec'y, Dep't of Envtl. Prot., 833 F.3d 360 (3d Cir. 2016); Delaware Riverkeeper Network v. Sec'y, Dep't of Envtl Prot., 903 F.3d 65 (3d Cir. 2018), cert. denied, 139 S. Ct. 1648, 203 L. Ed. 899 (2019) and Cole v. Dep't. of Envtl Prot, 1577 C.D. 2019 WL 2420667 (Pa. Cmwlth Ct. June 15, 2021) (Pet. for Allowance of Appeal pending); West Rockhill Twp. v. Dep't of Envtl. Prot., No. 1595 C.D. 2019 WL 2426014 (Pa. Cmwlth. June 15, 2021) (Pet. for Allowance of Appeal pending).

PUBLIC WATER SUPPLY PERMITS

 The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Hamilton Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT UNDER HSCA/CERCLA

Intercourse TCE Site, Leacock Township, Lancaster County.

 The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA), 35 P.S. §§ 6020.101 et seq., has entered into a proposed Consent Order and Agreement (CO&A) with Karma Investments Intercourse, LLC (Purchaser) with regard to the Intercourse TCE Site (Site) located in Leacock Township, Lancaster County, PA.

 In 2004, the Department began investigating groundwater within the Site. Trichloroethylene (TCE) was detected in wells on approximately 150 residential properties within the Site area in excess of the five parts per billion (ppb) Federal Maximum Contamination Level for public water supplies as incorporated by Pennsylvania Safe Drinking Water Act and the five ppb Statewide health standard for groundwater cleanups under the Pennsylvania Land Recycling and Remediation Standards Act. The past and present conditions at the Site constitute a ''release'' and ''threatened release'' of hazardous substances as defined in HSCA. In 2007, the Department selected point of use water treatment systems and bottled water delivery, based on level of contamination, as an interim response. In 2009, the Department selected construction of a new municipal water supply system as a remedial response. Construction of the water supply system was completed in 2020. The Department supervised operation of the water supply system until it was transferred to Leacock Township in September 2021. Currently, the Department has not identified the source(s) of the TCE contamination.

 The Purchaser intends to purchase real property comprising a continuous area drawn from existing Lancaster Tax Parcel Nos. being part of 3506949500000 (aka, 3452 Old Philadelphia Pike, Intercourse, PA 17534); the entirety of 3502484600000 (aka, 3466 Old Philadelphia Pike, Intercourse, PA 17534); the entirety of 3502824900000 (aka 3470 Old Philadelphia Pike, Intercourse, PA 17534); the entirety of 3503447100000 (aka 3474 Old Philadelphia Pike, Intercourse, PA 175340; and part of 3507183900000 (aka Old Philadelphia Pike) (hereinafter ''the Property''). The Property is currently owned by CBH Limited Partnership. CBH Limited Partnership will file a declaration of condominium that will subdivide the real property into two condominium units and common elements. Purchaser will be transferred title to condominium unit one.

 The Purchaser represents that it has no involvement with the Property other than as a prospective purchaser performing due diligence at the Property. The Department has no information that the Purchaser ever used TCE at the Site or has ever been or is presently affiliated with the current owner.

 Under the terms and conditions of the CO&A, the Department and the Purchaser covenant not to sue the other for response costs arising from the release or threatened release of hazardous substances at the Site. In addition, the CO&A provides that the Purchaser will submit payment to the Department in the amount of $3,000 towards the Department's past response costs at the Site.

 This notice is provided pursuant to Section 1113 of HSCA, 35 P.S. § 6020.1113, which states that, ''settlement shall become final upon the filing of the Department's response to significant written comments.'' The Department has reserved the right to withdraw its consent to the CO&A if comments submitted during the public comment period disclose facts or considerations which indicate, in the Department's discretion, that the CO&A is inappropriate or not in the public interest. A person adversely affected by the settlement may file an appeal with the Pennsylvania Environmental Hearing Board. The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department Regional Office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office.
