NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR
NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Following Plans and Reports Were Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department Has Taken Action on the Following Plans and Reports Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

Pursuant to 25 Pa. Code § 127.449(i), this Pennsylvania Bulletin Notice is for a de minimis emissions increase of: 0.071 tpy CO; 0.920 tpy NOx; 0.002 tpy PM; and 0.027 tpy VOC resulting from the re-connection of five (5) natural gas-fired backup generators at the Juniata Locomotive Shop. These units were previously included in the Operating Permit under Source ID 203 (Back-Up Natural Gas Generators), but have since been disconnected and removed from the Operating Permit during the latest renewal in December 2022. The units, however, have not been removed and remain on-site. The currently permitted MTU Emergency Engine (Source ID 217) is out of service for maintenance or possible replacement. During this time, Norfolk Southern will re-connect these small backup generators for emergency purposes at no more than 175 hr/yr each. The generators include: Machine Shop (10 hp); C-Bay (80 hp); Wreck Shop (10 hp); Paint Shop (134 hp); and Boiler House (134 hp). This is the first de minimis increase for this permit term.

Proposed Amendment to State Water Quality Certification Required By Section 401 Of The Clean Water Act For York Haven Power Company, LLC's York Haven Hydroelectric Project.

EA67-023 York Haven Power Company, LLC (YHPC or Applicant), York Haven Hydro Station, P.O. Box 67, York Haven, PA 17370. The York Haven Hydroelectric Project (YHHP) is an existing 19.65 megawatt hydroelectric power generating facility located across the Susquehanna River in York Haven Borough, York County, Conoy Township, Lancaster County and Londonderry Township, Dauphin County (York Haven, PA Quadrangle; Latitude: 40° 07` 12.31" N, Longitude: -76° 43` 11.51" W). YHHP is operated as a run-of-river dam and was constructed from 1901—1904.

 On August 19, 2014, the Pennsylvania Department of Environmental Protection (PADEP) issued Water Quality Certification (WQC) EA67-023 for the YHHP. Among other required activities, WQC EA67-023 requires the design and construction of a Nature-like Fishway (NLF) in the vicinity of the apex of the main YHHP dam and Three Mile Island (TMI). Further, the NLF design required by WQC EA67-023 Section III.A.2. and Appendices A and B is currently an in-river NLF design. In 2015, the Federal Energy Regulatory Commission (FERC) re-licensed the YHHP for continued operation of the YHHP, which included the requirements of WQC EA67-023. The YHPC YHHP is docketed at FERC as project no. P-1888.

 On January 26, 2023, YHPC filed an application with FERC to amend their existing FERC license to reflect a new inland NLF design to replace the prior in-river NLF design. Pennsylvania WQC is required for FERC's amendment of the license to reflect the project design change under the Federal Power Act.

 On June 22, 2023, YHPC requested an amendment of WQC EA67-023, Section III.A.2., Appendices A and B, and inclusion of a new Appendix B-1. The proposed WQC amendment is to modify the required NLF design from an in-river NLF design to an inland NLF design. The inland NLF design is proposed to remain in the vicinity of the apex of the main dam and TMI. The proposed design change will ensure that the design, construction, operation and maintenance of the YHHP, including the revised NLF design, will protect water quality in Pennsylvania through compliance with State water quality standards and associated State law requirements, which are consistent with the requirements of the Federal Water Pollution Control Act (''Clean Water Act'').

 The proposed WQC amendment consists of an inland NLF design; associated design criteria for the inland NLF (new Appendix A); Conceptual Plan for the inland NLF (new Appendix B); and a Project Timeline for the YHHP inland NLF (new Appendix B-1).

 Pursuant to Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), PADEP anticipates issuing a state WQC amendment for EA67-023 to modify Section III.A.2., add new Appendices A and B, and add an Appendix B-1 to WQC EA67-023. If approved, the amended WQC EA67-023 would continue to require compliance with the unchanged portions of the WQC EA67-023 and the State water quality permitting programs, criteria and conditions established pursuant to State law to ensure that the Applicant's YHHP does not violate applicable State water quality standards set forth in 25 Pa. Code Chapter 93.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

PUBLIC NOTICE OF APPLICATION AND DRAFT STATE WATER QUALITY CERTIFICATION FOR A FERC REGULATED PIPELINE PROJECT

EA3007223-001, EQUITRANS, LP, 2200 Energy Drive, Canonsburg, PA, 15317. Swarts and Hunters Cave Well Replacement Project (Project), in Center, Franklin, Morris and Washington Townships, Greene County, USACE Pittsburgh District. The proposed non-linear project starts at Hunters Cave Storage Field (Latitude: 39.9064°; Longitude: -80.2824°) and ends at Swarts Gas Storage Complex (Latitude: 39.9423°; Longitude: -80.2513°), with project impacts at four discrete locations.

 On June 30, 2023, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP23-507-000). The FERC Environmental Assessment for the Project may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP23-507-000).

 On July 5, 2023, Applicant requested a state water quality certification (SWQC) from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.

 The Project, as proposed, includes construction of two horizontal storage wells—one in the Hunters Cave Field and one in the Swarts Complex, approximately 0.7-mile of new 12-inch diameter natural gas pipelines, associated aboveground facilities, existing facility modifications, temporary and permanent access roads, and the use of existing contractor yards in the general Waynesburg area. The Project, as proposed, will require approximately 77.86 acres of earth disturbance, and impacts to 231 linear feet of streams (Rush Run (HQ—WWF) and UNT to Bates Fork (HQ—WWF)), 0.68 acre of floodway, 0.01 acre of temporary PEM wetland impacts, and 0 acre of wetland permanent impacts.

 PADEP, by this notice, is proposing to issue a SWQC to EQUITRANS LP for the Swarts and Hunters Cave Well Replacement Project. PADEP is proposing to certify that construction, operation and maintenance of the Swarts and Hunters Cave Well Replacement Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP is proposing to further certify that the construction, operation and Swarts and Hunters Cave Well Replacement Project complies with Pennsylvania water quality standards and that the construction, operation and maintenance of the project will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:

 1. Discharge of Hydrostatic Test Water—Applicant shall obtain and comply with a National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.

 2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.

 3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management) and all other applicable regulations.

 4. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.

 5. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.

 6. Operation—At all times, Applicant shall properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 7. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals issued ensure the project shall maintain and protect state water quality standards as required by this SWQC. Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.

 8. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to PADEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.

Reservation of Rights—PADEP may modify, suspend or revoke this SWQC if (i) PADEP becomes aware of new facts about the Project that warrant such action; or (ii) PADEP determines that Applicant has not complied with the terms and conditions of this SWQC. PADEP may require additional measures to achieve compliance with any applicable law or regulation.

 11. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.

 12. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of this SWQC shall not be affected thereby.

 Prior to issuance of the final SWQC, PADEP will consider all relevant and timely comments, suggestions or objections submitted to PADEP within 30 days of this notice.
