37-00013H: CEMEX Construction Materials Atlantic, LLC, 2001 Portland Park, Wampum, PA 16157-3913, Wampum Borough, Lawrence County. The Department issued a Plan Approval for re-activation of the bagging machines used to package cement. The facility's cement operations were deactivated in 2010. The facility currently operates under Title V permit 37-00013 as a transfer station/cement terminal. The project includes three bagging machines, each of which is controlled by an existing baghouse. Current emissions, including this project, are below Title V permitting thresholds; however, plan approval 37-00013G, issued on October 6, 2022 was issued prior to the Title V Operating Permit renewal, and so its status as a Title V facility was maintained. The plan approval contains emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act. If the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specifications of the application for plan approval, an initial Operating Permit amendment application addressing the inclusion of the plan approval may be submitted for the facility per 25 Pa. Code Chapter 127. The Department intends to issue a renewal of the State Only Operating Permit for the State Correctional Institution (a.k.a. Forest SCI). The primary sources at the facility include 2 natural gas fueled boilers rated at 25 million Btu/hr each and 1 natural gas fueled boiler rated at 12.5 million Btu/hr, several small natural gas fueled heaters, two 2,931 hp No. 2 oil fueled emergency generators, and a 149 hp oil fueled emergency generator. The facility is a Synthetic Minor. Actual emissions reported from the facility for 2022 were as follows: 3.65 tons CO; 1.87 tons NOx; 0.31 ton PM10; 0.37 ton SOx; and 0.25 ton VOC. 62-00018: Warren State Hospital, 33 Main Dr., Warren, PA 16365, Conewango Township, Warren County. The Department issued the renewal of the State Only Operating Permit for Warren State Hospital. The significant sources at this facility are 6 dual-fueled boilers, various natural gas fueled small space and water heaters, and 10 diesel-fueled emergency power generators. The 7 emergency generators installed prior to 2006 are each limited to a maximum of 325 hours of operation in any 12 consecutive month period. The boilers primarily burn natural gas. Periodic testing of liquid fuels in the boilers shall not exceed a combined total of 48 hours during any calendar year. Two of the emergency power generators are subject to 40 CFR 60, Subpart IIII, the New Source Performance Standards for Stationary Compression Ignition Internal Combustion Engines. Actual emissions reported from the facility for 2022 were as follows: 5.68 tons CO; 6.76 tons NOx; 0.21 ton PM10; 0.05 ton SOx; and 0.40 ton VOC. This facility is a Synthetic Minor. The objective of this mitigation is to establish a combined total of 0.49 acre wetland creation and restoration, and streambank stabilization for the 72 linear feet daylighted section of the culvert. NOTICE OF PUBLIC MEETING

 Notice is hereby given that the Pennsylvania Department of Environmental Protection (Department) will hold a public hearing on September 26, 2023 concerning the applications for a new large industrial minerals (noncoal) surface mining permit and associated NPDES permit submitted by Bishop Brothers Construction Company, Inc., which is located at 1376 Leisure Drive, Towanda PA 18848. The proposed mine site is referred to as the Minard Mine and is located in Athens Township, Bradford County, PA. The mining permit application number is 08230301 and the NPDES permit application number is PA0270041. All interested parties are encouraged to attend the hearing. The application is being reviewed by the Department's Moshannon District Mining Office located at 186 Enterprise Drive, Philipsburg, PA, 16866. The phone number for the Moshannon office is 814-342-8200. The email address for the Moshannon office is RA-EPMOSHANNON@pa.gov.

 The proposed site consists of 360.7 acres and is situated at on the property of Jeanette Minard. The proposed permit area is situated 0.5 mile south of the intersection of Mile Lane Road (SR-4020) and Meadowlark Drive (T-303). The Sayre 7.5 Minute U.S.G.S. Topographic Map contains the area described. Mining of sandstone and sand and gravel is proposed within the permit area.

 The site is located within the Chemung River and Tutelow Creek watersheds. The associated NPDES application proposes discharges of stormwater from the support/processing area and discharges of treated water from the mining pit to Tutelow Creek, which is designated as Warm Water Fishes, Migratory Fishes. The draft NPDES permit document and fact sheet are available on the DEP webpage (see the following details). A draft NPDES permit notice was published in the Pennsylvania Bulletin on August 5, 2023.

 The application includes proposals for three (3) variances to conduct mining activities within 100 feet of the Chemung River and Tutelow Creek; to conduct blasting; and to change the postmining land use from cropland to unmanaged water impoundment and forest to unmanaged natural habitat. The stream encroachment activities consist of: installation of a bridge to cross Tutelow Creek, installation of a culvert to cross unnamed tributary 1 to Tutelow Creek, and three (3) encroachments of Tutelow Creek for mining support activities and mineral extraction as described in the application documents.

 The public hearing will be held at the Athens Area High School Auditorium, 401 W Frederick St, Athens, PA 18810, on Tuesday, September 26, 2023, starting at 6:00 p.m. and ending at 8:00 p.m. or sooner if testimony is complete. Doors will open at 5:30 p.m. The public hearing is for the collection of comments only. Department staff do not directly answer questions during the hearing. During the hearing, Department staff will first give a brief update on the status of the applications, then accept oral comments of three minutes or less regarding the permit applications. A transcript of the public hearing, including all oral comments, will be produced by a stenographer.
