AND
DEPARTMENT OF ENVIRONMENTAL PROTECTION

Project Priority List and Intended Use Plan; Water Pollution Control Revolving Fund Projects

   The Pennsylvania Infrastructure Investment Authority (PIIA) and the Department of Environmental Protection have prepared a combined Federal fiscal year 1996 and 1997 sewage construction Project Priority List and the fiscal year 1996 Intended Use Plan (IUP) list of municipal sewerage projects to be considered for a construction loan from funds Pennsylvania expects to receive from fiscal year 1996 Federal appropriation acts to capitalize the Water Pollution Control Revolving Fund (WPCRF) program. In addition, notice is hereby given that the Intended Use Plans for fiscal year 1990, 1993 and 1994 have been updated to utilize Federal funds.

   The FY 1996/97 Project Priority List was developed in conformance with the requirements of section 216 of the Water Quality Act and Federal guidance. Accordingly, the projects included on the Project Priority List have a project priority rating under the Department's Environmental Protection Agency approved Chapter 103 project priority rating system. The act stipulates that states must maintain a Project Priority List of municipal sewerage projects from which to develop the annual IUP list of projects to be funded.

   The projects to be considered for a loan from the WPCRF must meet the Federal requirements for funding in accordance with Title II and Title VI of the Water Quality Act. Accordingly, the projects included in the IUP are rated under Pennsylvania's approved project priority rating system and are expected to meet the requirements applicable to use of the WPCRF loan funds. Projects listed on the FY 1996 and the amended IUP lists are on Pennsylvania's WPCRF Project Priority List and are projects that have or are expected to proceed to construction in the near future. Other projects on the WPCRF sewage construction Project Priority List are projects that are in development or will be developed for future construction loan consideration. Any project removed from an IUP is maintained on the Project Priority List unless otherwise completed.

   The FY 1996 IUP has 19 municipal sewage construction projects listed with a total dollar value of approximately $47.2 million. The WPCRF will be capitalized with approximately $40.5 million of Federal FY 1996 funds from the Environmental Protection Agency and approximately $8.1 million of State funds. Some $1.4 million will be set-aside for program administration costs. After the public hearing and assessment of the comments received, the Final FY 1996 IUP will be completed, and potentially, it may include other projects from the Project Priority List.

   A project must appear on the PIIA approved IUP before it can receive a loan from the WPCRF. The IUP was developed in accordance with the ranking criteria listed in Section 10(b) of Act No. 1988-16. These ranking criteria differ somewhat from the Chapter 103 project priority rating system, as does the methodology used to evaluate projects. In addition, a project's readiness to proceed and the reasonable availability of alternative funds also have a bearing on project selection for the IUP. Consequently, the rank ordered list of projects on the Project Priority List does not dictate the order in which projects will be chosen for inclusion in the IUP.

   Federal guidance and regulations on development of the Project Priority List and Intended Use Plan direct that the project lists be subject to public comment and review before being submitted to the U. S. Environmental Protection Agency.

   The Department has scheduled a public hearing for 10 a.m., June 5, 1996, in the Auditorium of the Rachel Carson State Office Building, located at 400 Market Street, Harrisburg, PA. The hearing is scheduled for the purpose of receiving comments from the public regarding the combined fiscal year 1996/97 WPCRF Project Priority List and the FY 1996 IUP. Interested persons are invited to express their views on the priority rating or ranking of projects on the Project Priority List and the public hearing. Persons wishing to offer comments should contact the Administrative Services Section, Division of Municipal Planning and Finance, Bureau of Water Quality Management, 10th Floor, Rachel Carson State Office Building, P. O. Where written statements are prepared and will be submitted at the hearing, speakers will be asked to restrict the oral portion of the statement to a summary of the written comments. Speakers will be called to present their comments generally in the order of receipt of the notice of intent to appear at the hearing.

   It is not necessary to appear at the public hearing to present comments on the Project Priority List or the IUP list of projects. Interested persons may submit written comments to the Department at the address shown above. Such written comments will be considered equivalent to oral statements presented at the hearing. To be considered by the Department and PIIA, the written comments must be received by the Administrative Services Section on or before the date of the hearing.

   A copy of the FY 1996/97 Project Priority List and the FY 1996 Intended Use Plan is available by obtaining a copy of the Pennsylvania Bulletin and is available for public review in the Administrative Services Section office and in the following offices:
