ENVIRONMENTAL HEARING BOARD

Duquesne Light Company v. DEP; Doc. No. 95-240-G

   The Department of Environmental Protection (Department) and Duquesne Light Company have agreed to a settlement of the above matter.

   The Department issued NPDES Permit No. PA 0025615 to Duquesne Light Company (DLCo) authorizing the discharge of wastewater to the Ohio River and Peggs Run. DLCo appealed the imposition of a limitation for total residual chlorine (TRC) at Outfalls 013, 113 and 203 and a free available chlorine (FAC) limitation at Outfall 012.

   The major provisions of the settlement are:

   1.  Modification of the TRC limit at Outfalls 113 and 203 (sewage treatment plant discharges) to monitor and report until September 30, 1988, and thereafter a monthly average limitation of 1.4 mg/l and an instantaneous maximum limitation of 3.3;

   2.  Deletion of the FAC limitations at Outfall 012.

   Persons who are aggrieved by the above settlement have a right to appeal to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457. Appeals must be filed within 20 days of this publication.

   The Environmental Hearing Board is empowered to approve this settlement if no objection is timely filed with the Board.
