[National Pollution Discharge Elimination System Program (NPDES)]

DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

(Part I Permits)

   The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

   Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

   Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.

   Following the 30-day comment period, the Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

   The following effluent limitations are proposed for discharge to the receiving waters, Ohio River, Little Blue Run Mill Creek, classified as a WWF-TSF fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply (PWS) is at the Pennsylvania-West Virginia state border.

   Outfall 021:  existing discharge, design flow of 0.03 mgd.

   The following effluent limitations are proposed for discharge to the receiving waters, known as drainage swale tributary to Little Chartiers Creek, which are classified as a high quality-warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the West View Borough Municipal Authority on the Ohio River.

   The receiving water is classified for warm water fishery, water supply and recreation. There is no downstream potable water supply to be considered for the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics.

   The proposed effluent limits, based on a design flow of 68.6 mgd, which includes the flow from a significant industrial user, which revises CBOD and total suspended solids limits beyond secondary.
