   The Independent Regulatory Review Commission met publicly at 10:45 a.m., Thursday, June 4, 1998, and took the following action:

State Architects Licensure Board--General Revisions; Regulation No. 16A-413

Order

   On March 13, 1997, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Architects Licensure Board (Board). This rulemaking amends 49 Pa. Code Chapter 9. The authority for this regulation is found in sections 5(a); 6(a), (b), (c) and (d); 8(b) and (c); 10(b); 11(a); 12(a) and (c); 13(h); and 14 of the Architects Licensure Law (63 P. S. §§ 34.5(a); 34.6(a), (b), (c) and (d); 34.8(b) and (c); 34.10(b); 34.11(a); 34.12(a) and (c); 34.13(h); and 34.14). The proposed regulation was published in the March 29, 1997 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on April 20, 1998.

   The Board is revising its existing regulations to clarify and simplify requirements for licensure by examination and reciprocity. The Board is eliminating provisions which reflect outdated standards and procedures of the National Council of Architectural Registration Boards. Finally, the Board is amending its regulations regarding complaints to conform to court decisions regarding the separation of prosecutorial and adjudicatory functions.

   The Senate Consumer Protection and Professional Licensure Committee approved the regulation on April 28, 1998. The House Professional Licensure Committee approved the regulation on May 6, 1998.

   We have reviewed this regulation and find it to be in the public interest. The proposed regulation eliminates obsolete provisions and improves the clarity of the regulation.

Therefore, It Is Ordered That:

   1.  Regulation No. 16A-413 from the State Architects Licensure Board, as submitted to the Commission on April 20, 1998, is approved; and

   2.  The Commission will transmit a copy of this Order to the Legislative Reference Bureau.
